Dear Mr. Heimlich:
This will confirm our telephone conversation of October 6, 2014, regarding a
Freedom of Information Act (FOIA) (5 ILCS 140/1 et seq. (West 2012)) request that you
submitted to the Office of the Illinois Attorney General. Specifically, your request dated and
received by this office on October 2, 2014, seeks "copies of any and all records [related to Save-
A-Life Foundation] maintained by the Attorney General's office, including the Charitable Trust
Bureau, dating from July 9, 2010 to the present. This request includes, but is not limited to,
reports and correspondence."
Per our conversation, you have clarified that your request seeks to confirm
whether this office's investigation of Save-A-Life Foundation is open. If the investigation is
open, you indicated that you would like to receive a letter from this office to that effect. If the
investigation is closed, you would like to receive copies of the requested records.
Your request for records is denied pursuant to sections 7(l)(d)(i) and 7(l)(d)(ii) of
FOIA (5 ILCS 140/7(l)(d)(i), (ii) (West 2013 Supp.)). Section 7(l)(d)(i) prohibits the disclosure
of "[rjecords in the possession of any public body created * * * for law enforcement purposes
* * * to the extent that disclosure would unavoidably * * * interfere with pending or actually and
reasonably contemplated law enforcement proceedings conducted by any law enforcement * * *
agency that is the recipient of the request." Some records are being withheld because they
contain information that relates to an open investigation and pending law enforcement
proceedings. Accordingly, some records are exempt from disclosure.

Section 7(l)(d)(ii) of FOIA prohibits the disclosure of "[rjecords in the possession
of any public body created * * * for law enforcement purposes * * * to the extent that disclosure
would unavoidably * * * interfere with active administrative enforcement proceedings conducted
by the public body that is the recipient of the request[.]" Some records are being withheld
because they contain information that relates to open administrative enforcement proceedings.
Accordingly, some records are exempt from disclosure.

General, and the undersigned. You have a right to have the denial of your request reviewed by
the Public Access Counselor (PAC) at the Office of the Illinois Attorney General. 5 ILCS
140/9.5(a) (West 2012). You may file your request for review with the PAC by writing to:

calendar days of the date of this partial denial letter. 5 ILCS 140/9.5(a) (West 2012). Please note

You also have the right to judicial review of your denial by filing suit in the
appropriate Illinois court. 5 ILCS 140/11 (West 2012).
