Citation
1. These Regulations may be cited as the Environmental Protection and Management
(ControlofNoiseatConstructionSites)Regulations.
Definitions
2.IntheseRegulations,unlessthecontextotherwiserequires
construction site means any premises on or in which works of the following
descriptionarebeingcarriedout:
the erection, construction, alteration, repair or maintenance of buildings,
structuresorroads
the breaking up, opening or boring under any road or adjacent land in
connection with the construction, inspection, maintenance or removal of
works

anyotherworkofengineeringconstruction
construction work means works of any description listed in the definition of
constructionsiteandanyotherrelatedworks,includingtheloadingorunloading
ofmaterialsfromcranesorvehiclesforthepurposesofsuchworks
publicholidayhasthesamemeaningasintheHolidaysAct(Cap.126)
residentialbuildingincludesanybuildingwhichisusedsolelyorpartlyasahostel,
hotel,servicedapartment,residenceorprivatedwelling.
Permissiblenoiselevel
3.(1)Theowneroroccupierofanyconstructionsiteshallensurethatthelevelofnoise
emittedfromhisconstructionsitedoesnotexceed
in the case of any construction work which has commenced before 1st October
2007,themaximumpermissiblenoiselevelssetoutintheFirstScheduleand
inthecaseofanyconstructionworkcommencingonorafter1stOctober2007,the
maximumpermissiblenoiselevelssetoutintheSecondSchedule.
(2) Notwithstanding paragraph (1), the DirectorGeneral may, if satisfied that there is
justifiable technical reason to do so in any particular case, by notice in writing require the
owneroroccupieroftheconstructionsite
toensurethatthelevelofnoiseemittedfromhisconstructionsitedoesnotexceed
suchothermaximumpermissiblenoiselevelsastheDirectorGeneralmayspecify
and
tocomplywithsuchothertermsandconditionsastheDirectorGeneralmaythink
fittoimpose.
(3)Forthepurposesofparagraph(1),noiselevelreadingsshallbetaken
onemetreawayfromtheoutsideofanyaffectedbuildingregardlessofthedistance
betweentheaffectedbuildingandtheboundaryoftheconstructionsiteor
if a suitable location cannot be found one metre away from the outside of any
affectedbuilding,atsuchotherlocationastheDirectorGeneralmayspecify.
(4) If there are other sources of noise affecting the measurement of the level of noise
emittedfromaconstructionsite,themaximumpermissiblenoiselevelssetoutintheFirstand
SecondSchedulesshallbeadjustedinaccordancewiththeThirdSchedule and the adjusted
valueshallbetakenasthemaximumpermissiblenoiselevel.
(5) Paragraph (b) of Parts I and II of the Second Schedule shall not apply to any
constructionsiteinwhichthefollowingworksarecarriedout:
repairandmaintenanceworktopublicroadsand
repairworktoanysewer,drain,water,gasorelectricityline.
(6) For the purposes of these Regulations, construction work shall be deemed to have
commencedonthedatespecifiedinapermittocarryoutstructuralworksinthatconstruction

site granted by the Commissioner of Building Control under theBuilding Control Act (Cap.
29).
Equipmenttomeasureandrecordnoiseleveltobesetup
4. The DirectorGeneral may, by notice in writing, require the owner or occupier of any
constructionsite
to set up equipment to measure and record the level of noise emitted from his
construction site over such duration as may be directed by the DirectorGeneral
and
tosubmittherecordsofthenoiselevelreadings,includingallrelevantfactswhich
mayinfluencethevaluesofthenoiselevelreadings.
Prohibitionofconstructionworkatcertainsitesduringcertainperiods
4A.(1)Theowneroroccupierofanyconstructionsitelocatedlessthan150metresfrom
anyhospital,homefortheagedsickorresidentialbuildingshallensurethatnoconstruction
workiscarriedoutathisconstructionsiteonthedaysandduringthetimesspecifiedinthe
FourthSchedule.
(2) Notwithstanding paragraph (1), the DirectorGeneral may, if he is satisfied that it is
necessary in the public interest or for justifiable technical reason to do so in any particular
case, permit in writing any construction work to be carried out during a prohibited period
specifiedintheFourthSchedule.
(3) A permit granted under paragraph (2) shall specify the period during which the
construction work may be carried out and shall require the owner or occupier of the
constructionsitetocomplywithsuchothertermsandconditionsastheDirectorGeneralmay
thinkfittoimpose.
(4)Fortheavoidanceofdoubt,regulation3appliestoanyconstructionworkpermittedto
becarriedoutpursuanttoapermitgrantedunderparagraph(2).
Penalty
5.Anypersonwhofailstocomplywithregulation3(1)or4A(1),oranynoticeissuedby
theDirectorGeneralunderregulation3(2)or4,oranytermorconditionofapermitgranted
underregulation4A(2),shallbeguiltyofanoffenceandshallbeliableonconvictiontoafine
notexceeding$40,000and,inthecaseofacontinuingoffence,toafurtherfinenotexceeding
$1,000foreverydayorpartthereofduringwhichtheoffencecontinuesafterconviction.

factor corresponding to the difference between the maximum permissible noise level in the First and

levels.
