Subject: Consideration of a Resolution Authorizing the City Administrator to enter
into an agreement between the City of Carmel-by-the-Sea and the
Transportation Agency for Monterey County for the allocation of $13,000.
to the City of Carmel-by-the-Sea as approved by the Transportation
Agency Board of Directors.
RECOMMENDATION(S):
Authorize the City Administrator to enter into an agreement between the City of Carmel-by-
the-Sea (City) and the Transportation Agency for Monterey County (TAMC) for the allocation
of $13,000. to the City as approved by the Transportation Agency Board of Directors.

EXECUTIVE SUMMARY:
TAMC is authorized to assign a defined portion of its annual Regional Surface Transportation
Program (RSTP) apportionment to Caltrans in exchange for state funds for specified fiscal
year(s). TAMC is authorized to use these exchanged funds (hereinafter RSTP Exchange
Funds) to assist local agencies to promote projects which otherwise qualify for RSTP funds.
One of the duties of the TAMC is to administer the provisions of the Transportation
Development Act in apportioning Local Transportation Funds (LTF) for bicycle and pedestrian
projects to the Cities, County, and Monterey-Salinas Transit system. The TAMC Board has
approved the allocation of $13,000. to the City toward the installation of bike racks within the
City.

ANALYSIS/DISCUSSION:
In response to the allocation of $13,000., and the deadline of August 27, 2014 to invoice
TAMC for reimbursement of these funds, the City purchased bike racks in the amount of
$13,176.58. At a later date staff will present a list of recommended installation locations to
the Planning Commission for approval. At this time, staff anticipates installing bike racks
using the Public Services Departments in-house labor force. The cost of miscellaneous
materials and in-house labor to install bike racks would be funded from the Public Services
Departments maintenance budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARMEL-BY-THE-SEA
AUTHORIZING THE CITY ADMINISTRATOR TO ENTER INTO AN AGREEMENT WITH
TRANSPORTATION AGENCY FOR MONTEREY COUNTY FOR THE ALLOCATION OF
$13,000.00 TO THE CITY OF CARMEL-BY-THE-SEA AS APPROVED BY THE
TRANSPORTATION AGENCY BOARD OF DIRECTORS

WHEREAS, the Transportation Agency for Monterey County (TAMC) is the state-
designated Regional Transportation Planning Agency for Monterey County; and

WHEREAS, as authorized by Section 182.6(g) of the Streets and Highways Code, the
TAMC has entered into a separate agreement with the State of California, through the
Department of Transportation (Caltrans), to assign a defined portion of its annual Regional
Surface Transportation Program (RSTP) apportionment to Caltrans in exchange for state
funds for specified fiscal year(s); and
WHEREAS, the TAMC is authorized to use these exchanged funds (hereinafter RSTP
Exchange Funds) to assist local agencies to promote projects which otherwise qualify for
RSTP funds; and

WHEREAS, as authorized by Chapter 2, Title 21, Rule 6640 of the Transportation
Development Act, one of the duties of the TAMC is to administer the provisions of the
Transportation Development Act in apportioning Local Transportation Funds (LTF) for the
Transportation Development Act 2% (TDA 2%) program for bicycle and pedestrian projects
pursuant to Article 3 of that law, and to the Cities, County, and Monterey-Salinas Transit;

WHEREAS, as authorized by the J oint Powers Agreement for the Monterey
County Regional Development Impact Fee Agency, the TAMC is designated to administer
and allocate regional development impact fee revenues (RDIF) to projects identified in the
approved Strategic Expenditure Plan; and

WHEREAS, the TAMC Board has approved the allocation of funds toward the projects
listed in Exhibit A; and

WHEREAS, it is contemplated by TAMC and the Recipient that the amount of funding
and the projects may change from time to time as set forth below; and

WHEREAS, the TAMC has requested the Monterey County Auditor-Controller to
establish a separate fund for the Federal Apportionment Exchange Program and such a
separate fund has been established.

WHEREAS, the TAMC requires an executed Master Agreement with the City of
Carmel-by-the-Sea in order to disperse the allocated funds for the Installation of Bike Racks

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE
CITY OF CARMEL-BY-THE-SEA DOES:

1. Authorize the City Administrator to enter into an agreement with TAMC to take
receipt of RSTP Exchange Funds for the Installation of Bike Racks, as approved by
the TAMC Board of Directors, for $13,000.

Subject: Local Agency Funding Allocation Agreement

RECOMMENDED ACTION:
APPROVE the Local Agency Funding Allocation Agreement.
SUMMARY:
The Local Agency Funding Allocation Agreement memorializes conditions and requirements for local
agencies to use local, state or federal funds passed through by the Transportation Agency for Monterey
County. Each agency receiving an allocation of funds will be required to enter into this agreement with
the Agency.
FINANCIAL IMPACT:
In total, the Agency allocates an estimated $16.65 million this cycle to the local jurisdictions from the
Regional Surface Transportation Program, Transportation Development Act 2%, Regional Development
Impact Fees, and Local Transportation Funds.
DISCUSSION:
The Local Agency Funding Allocation Agreement is designed to comply with a State requirement that the
Transportation Agency for Monterey County enter into contracts with its member agencies for the
reimbursement of Regional Surface Transportation Program funds. This agreement is a revision of a
previous version approved by the Transportation Agency Board at the March 2014 meeting, which dealt
specifically with the Regional Surface Transportation Program. This new version of the Local Agency
Funding Allocation Agreement now covers all sources of discretionary funding that passes through the
Transportation Agency, including Transportation Development Act 2%, Regional Development Impact
Fees, and Local Transportation Funds. The agreement details state and federal requirements for funds
and other fiscal provisions required to comply with state and federal regulations.
These Funding Allocation Agreements anticipate that specific projects and amounts may vary for any
member agency over time and that the parties will only need to approve revised Exhibit A documents,
rather than the entire Master Agreement. Each Exhibit A will identify the project for which funds are
allocated, the source of the funding, as well as the timing and amount of such funds for each identified
project, in order to ensure compliance with state and federal requirements. Exhibit As will be updated
each time new funds are allocated or existing allocations are modified.

In addition, the Funding Allocation Agreements will need to be updated with each agency every three
years. Each individual project will have a three year timely use of fund date, timed to the day the award
was approved by the TAMC Board of Directors. All projects awarded to an agency will be included in the
Agreement, including past awards and fair share allocations.
While the majority of the provisions in the Funding Allocation Agreement reflect the language of the
agreement that the Transportation Agency signs with the State to receive Regional Surface
Transportation Program funds, Agency staff has also included project completion requirements in this
agreement. As part of the Funding Allocation Agreement, the recipient agrees to provide to the
Transportation Agency a short report summarizing total project costs and milestones, including before
and after photos of the project, for each funded project within sixty days of completion.
With the distribution of fair share funds approved by the Board in February and competitive funds in
August, the next step for jurisdictions is to enter into a Local Agency Funding Allocation Agreement with
the Transportation Agency for Monterey County to request their funds to be programmed to a project.
Once a Funding Allocation Agreement has been executed, then jurisdictions may submit a claim
reimbursement form for funds.
