To consider: amendment u/s 419 of WBM Act, 1993 of West Bengal Municipal
Building Rules, 2007
In this connection the Chairman reported in the meeting that many Municipalities had already
amended West Bengal Municipal Building Rules, 2007 form for convenience of Rate payers. In
few cases the rule is too stiff for the people so that they can not get sanction of their Building
Plan obeying West Bengal Municipal Building Rules, 2007. Naturally, unauthorized
constructions are increasing gradually day by day. Then he proposed the following amendment
in the West Bengal Municipal Building Rule 2007 for this Municipality with effect from 1st
November 2011.

Building in Municipal areas

A. Building Sites

4. Application for approval of building sites and for permission to construct or reconstruct
building other than huts. In case if there were any approved building plan no need of
approval of site plan required before submission of building plan.
8. Control of development of parks, public open spaces, ponds, wetlands, canals, river and
other water front and brick fields.-

In case of abandoned brick field where the land has already been filled up and developed
and there are existing residential buildings the C-in-C may develop the Land and may give
permission to sanction building plan.

9. Sub-division of plots in municipal areas


2.f. where sub division of plots already registered without prior approval of
U.L.B. post facto sanction may be given.

15.Engagement of technical personnel in municipal areas 1) Every person who intends to

erect, add to or alter any building above 9.50 meter shall, subject to the provisions of the Act and
these rules, engage a engineer (Degree or Diploma) as stated below to supervise the construction
compulsorily and he should inform the municipal authority in writing the name and address of
the person with qualification with his consent letter and at the time of construction both of them
inform this office in writing about the status of the building as sanctioned by the Municipality

58. Habitable room.(1) No habitable room shall have an area less than 6.50 sq.meters having
a minimum width of 2.40 meter in one side.

60. Kitchen.(1) No kitchen shall have a floor area of less than 2.8 meters sq. meters and width
of less than 1.2 meters.
Provided that if any kitchen is to be used for eating purposes also, such floor area shall not be
less than 9.5 sq. meters and the width shall not be less than 2.4 meters.
(2) No kitchen shall have a height less than 2.5 meters measured from the surface of a floor to
the lowest point in the ceiling or the underside of any slab except for the portion to accommodate
any floor trap for any upper floor.
(3) Every room to be used as a kitchen shall have,-(a) unless separately provided with any pantry, meant for the washing of kitchen
utensils which shall land directly or through a sink to a granted and trapped
connection to a waste pipe;
(b) an impermeable floor;
(c) a window of not less than 1 sq. meter in area opening directly to an interior
Or exterior open space, or into any shaft;
(d) a flue duct, if necessary;
(e) a refuse chute for discharge of solid wastes, in case of any building exceeding
Eighteen meters in height.

62. Bathroom and water closet.(1) No bathroom shall have a floor area of less than 1.8 sq.
meters and width less than 1.2 meters and a height less than 2.2 meters measured from the
surface of a floor lowest point of the ceiling or the underside of any slab :
Provided that if it is a combined bathroom and a water closet, such floor area shall not be less
than 2.4sq. meters.
(2) No water closet shall have a floor area of less than 1.2 sq. meters and a width less than 1.0
meter.

80) Stair case -For residential building Height upto 9.5 m and plot area up to 200 sq m the
minimum width of stair ways to be provided is 0.90 mt. and minimum one number of stair case
to be provided .

Extra Addition
1)Security deposit to be kept over 9.5 m height building of any usage in the following manner

For Residential use

2) For existing building at least 2 photographs of the building from different angel required to be
submitted with the site/building plan.

After prolonged discussion, the members unanimously accepted the proposals of the Chairman
and the same would be sent to the competent authority for their information in this regard. The
Chairman was authorized to take follow up action in the matter.

To consider: amendment u/s 419 of WBM Act, 1993 of West Bengal Municipal
Building Rules, 2007;

In continuation of earlier B.O.C. meeting held on 29.7.2011 in its Item No. 10, the members
further unanimously agreed to the following amendment u/s 419 of West Bengal Municipal
Building Rules, 2007 of WBM Act, 1993:-

Rule 46 Plot Size above 400 sqm. Which was amended as 60% in the B.O.C.dated
29.7.2011 vide its Item No. 10 be further amended as 65%.
for commercial use Plot size above 700 sq. metres has been amended as 60% from 50%.

Rule 50 :(i) Open space for Residential use:Width of plot 3.0 to 4.0 has been amended as 3.0 to 4.999
Width of plot 5.0 to 6.0 has been amended as 5.0 to 6.999
