SPECIFICATION FOR 20 KG CAPACITY CORRUGATED CARTONS


FOR PACKAGING OF WHITE BUTTER.

1. CONSTRUCTION;The cartons should be universal folding type made from double wall 5 ply corrugated
fiber board by using "A" grade Kraft paper.
2. GRAMMAGE :The Grammage of all the Plies should be 120.GSM
3. DIMENSIONS:The carton will have internal dimension of size required as under and should be supplied
in folded form.
400 mm. x 250 mm. x 230 mm.
Tolerance limit 5 mm.
4. WEIGHT;The weight of the cartons should be Minimum 460 gms.
5. BURUSTING STRENGTH:The burusting strength should be minimum 12.5 kgs/cms2

General Terms and Conditions for supply of Corrugated Boxes and 25 kg Cap.
HDPE Woven Sacks (Outer) various Milk Scheme in Maharashtra State.
1.

Tender Document can be downloaded in the form prescribed by the Dairy Development

Commissioner, Maharashtra State, Mumbai in his office at Administrative Building, Khan Abdul
Gaffarkhan Road, Worli Sea Face, Mumbai-18 for the supply of stores up to the date and time
mentioned on the tender form.

Tenderers should quote rates for F.O.R. destination and submit the original quotation in

tender form and submit duplicate copy on an ordinary typed form along with a covering letter
attached herewith. They should state the earliest delivery period necessary to start the supply.
3.

The origin of stores offered whether Indian or Foreign and in the case of the former state in

which it is manufactured should be clearly stated against each article.

Tenderers should submit in 2 envelopes as below :

A)

Technical Envelope
This envelope should contain technical information of the unit such as

Compulsory Documents :i)

Scanned copy of the payment towards Tender Document Purchase form.

ii)

Draft in respect of EMD or documents showing exemption for payment of EMD such as
copies of SSI Registration/CSPO registration/NSIC registration/ DGS & D registration, if
any as detailed under condition 10 ( c ).

iii)

Clearance certificate from the concerned sales tax officer, certifying that the VAT paid
up to December end for the proceeding year has been remitted/or certificate from the
competent authority granting exemption from remittance of VAT/ Sales Tax, if any.

iv)
v)

Copy of D.G.S & Ds rate contract if awarded. If not, please mention so.
If the tenderer is a trader, he should produce current year authorization latter in
prescribed format from the manufacturer whose product he has quoted.

vi)

A copy of valid BIS licence issued to the manufacturer if a tenderer has participated in
the tender for supply materials with ISI mark.

vii)

Declaration letter stating that all terms and conditions for the supplies stipulated by
the department are acceptable to the firm.

N.B.

If any of the documents from the compulsory documents mentioned above, is not
furnished in the technical envelope; the tender will be treated as invalid.

Additional Documents :1. List of installed machinery, the location and month capacity of the factory.
2. Details regarding participation of such Tender Enquiry in the past if any.
3. Details regarding past performance and M.S.T./C.S.T. Registration number.
4. Information in the following format regarding specifications if a tenderer has participated
in the tender for supply of material without ISI mark.

B) Commercial Envelope :
In this envelope the tenderer shall submit PRICE TENDER FORM
( purchased for himself and duly signed and attested ) showing all inclusive rates.
Tenders not submitted as per the above prescribed manner, will be treated as
invalid.
5. Opening of Tender :
The Tenderers are at liberty to be present of or authorise their representative to be
present for opening of Technical Tender Envelope at the time and date specified on the
Tender Form. Commercial Tender Envelopes of Tenderers, whose samples are found as per
specification/suitable for dairy use, will be opened at the time and date will be intimated in due
course of time.

The Dairy Development Commissioner, Maharashtra State, Mumbai does not pledge

himself to accept the lowest or any tender and reserves to himself the right of accepting the
whole or any part of the tender or portion of the quantity offered against any item and the
Tenderer shall supply the same at the rate quoted. The Tenderer is at liberty to quote for the
whole or any portion of the quantity of any item.

Where offers by the tenderer are for stores imported with the assistance of the State

Trading Corporation, the Tenderer should specifically stipulate that the offers made are in
accordance with the price fixation formula of the State Trading Corporation.

8.

In the event of the order being placed against any of the Tenderers and if the Tenderer

fails to supply any stores according to the terms and conditions of acceptance of tender, or fails
to replace any stores rejected by the Dairy Development Commissioner or by any person on his
behalf within such times as may be stipulated. The Dairy Development Commissioner, or any
officer on his behalf shall be entitled to purchase such stores from any source and at such price
as the Dairy Development Commissioner or any officer on his behalf shall in his sole discretion
think fit
If action as stipulated above is taken ;
i)

The offer of the defaulting contractor will not be considered.

ii)

The defaulting contractor will be penalised to the extent of the difference in the rates of
10% of the value of the earlier order, whichever is higher.

iii)

If the defaulting contractor fails to pay the penalty, he will be permanently deleted from
the list of approved contractors of the C.S.P.O. and the Registration deposit of the
contractors will be forfeited to Government.

9.

In the case of non-delivery and or delayed delivery against an order placed with the
Tenderer, the Dairy Development Commissioner, Maharashtra State, Mumbai reserves to
himself the right to impose such penalty in his sole discretion as he thinks fit.

10(a)

Tenders should be accompanied by Earnest Money Deposit as per Tender Notice in


the form of Demand Draft of Scheduled Bank payable at Mumbai in the name of the
Dairy Development Commissioner, Maharashtra State, Mumbai. The Earnest Money
will be forfeited if the Tenderer fails to execute the contract if his Tender is accepted.
Tender without Earnest Money will be treated as invalid Tender.

10(b)

Successful Tenderer will be required to pay a sum fixed by the Dairy Development
Commissioner, Maharashtra State, Mumbai as Security Deposit and enter into an
Agreement for performance of the contract.

10(c)
i)

Following categories are exempted from payment of Earnest Money Deposit :

Factory located in Maharashtra State quoting for the items registered with DGS & D, New
Delhi.

ii)

Government and Semi Government Undertaking.

iii)

SSI Units permanently registered with Directorate of Industries, Maharashtra State and for
the items manufactured by them (Registration should be valid)

iv)

SSI Units registered with NSIC located anywhere in the country for the
items manufactured by them.

v)

Suppliers registered with CSPO ( Maharashtra State ) only for the item mentioned in the
certificate ( registration should be valid one)
Relevant attested copy of the certificate be attached to the quotation.

All the original documents of which copies have been attached to the technical
tender should be made available for verification at the time of opening of technical
tender.
10(d) The successful Tenderers should pay the Security Deposit @ 3% of the rate contract
/ quantity contract of purchase value. However, the following categories of Tenderers are
exempted from the payment of Security Deposit.
1) Supply registered with DGS & D New Delhi having factories in Maharashtra.
2) The Supplier registered with CSPO on the list of approved supplier for the value of
stores amounting to Rs.25,000/- only.
3) The SSI Units permanently registered with director of Industries and the units registered
or associated with Maharashtra State Khadi and Village Industries Board upto purchase
value of Rs.50,000/-.
4) As per 3 above for purchase of stores more than Rs.50,000/- Security Deposit will be
charged @ 3% of the total value limited to Rs.50,000/-.

Testing charges, if any, will have to be borne by the supplier.


Open testing of samples will be carried out in presence of the tenderers present at
the time of open testing. The exact date, time and venue to the open testing will be
informed separately.

II.5

The number and manner of tests to be conducted is the prerogative of


the
tendering authority i.e. Dairy Development Commissioner, M.S., Mumbai and his
decision in this regard will be final and binding to all.

Tenderers convicted on an offence under the Mumbai Prohibition Act, 1949 of the
Mumbai Opium Act, 1936, will be considered ineligible for being given contract.

13 Release of controlled materials :- Tenderers who do not stipulated conditions regarding


release of controlled materials may be given preference.

14 Extension of time :i)

As soon as it is apparent that contract dates cannot be adhered to, an application


shall be sent to the Dairy Development Commissioner, Maharashtra State, Mumbai.

ii) Without prejudice to the foregoing rights if such failure to deliver in proper time
as aforesaid shall have arisen from any cause which the
Dairy Development Commissioner may admit as a reasonable ground for an
extension of the time (and his decision shall be final). He may allow such additional
time as he considers to be justified by the circumstances of the case.
iii) Provided always that any failure or delay on the part of sub-contractors though their
employment may have been sanctioned shall not be admitted as a reasonable
ground for any extension of time or for exempting contractor from liability for any
such loss or damage, as aforesaid and provided further that no extension shall be
allowed unless application for it shall in the opinion of the Dairy Development
Commissioner, Maharashtra State, Mumbai.

15. The Dairy Development Commissioner, Maharashtra State, Mumbai. reserves the rights to
call for break-up of the quotations where necessary.
16. Office of Small Scale Industries quoting their registration number with Directorate of
Industries, Maharashtra and National Small Scale Industries Corporation (Government of
India) shall be only for items of approval programme of manufacture of the contesting Small
Scale Industries Unit. Likewise the offers of State Industries Co-operative Association,
Maharashtra State shall be on behalf of the member of Industrial Cooperative Societies only
and those of M.S.S.I.D.C. shall be on behalf of S.S.I units registered with the Directorate of
Industries of Maharashtra State and restricted to products of their own manufacture. S.S.I.
units holding single page registration certificate will not be considered for EMD exemption
and other facilities/concessions etc.
17. Conditional offers received in commercial tender envelope other than the specified
conditions mentioned in the tender enquiry are liable for rejection. However, in the interest
of Govt. the tendering authority i.e. Dairy Development Commissioner, Maharashtra State,
Mumbai, can accept or reject such offer on merits, and his decision, in this regard will be
final and binding to all.
18. The prices should be firm during the validity period of the contract and no prices escalation
on any account shall be taken into consideration tenders stipulating price escalation clause
are liable for rejection.
19. The payment will be normally made within 30 days from the date of receipt of material as
per specifications at destination.
20. The contractor will be required to supply the quarterly as per actual requirement of material
of milk schemes under rate contract and the contractor will be required to supply (+) 25% of
the tendered quantity under quantity contract, There is no any limit for minimum quantity to
be purchase during contract period at the accepted rate tenderers will be required to supply
material as per the delivery schedule given by the officer authorised by the Dairy
Development Commissioner, Maharashtra State, Mumbai
21. NOTE :i) Tender sample analysis reports will not be furnished to tenderers.
ii) Quotations offered by the tenderers.
Tenderers should if not in a position to quote for entire quantity and for delivery
as required, state specifically the quantity which they can deliver at the prices quoted
and according to the required delivery. Silence on the point will entail responsibility
for supply at quoted prices in full quantities as per required delivery.
iii) Packing :- Packing proposed to be employed should be clearly stated.
iv) Failure to observe any of the conditions mentioned above will result in the quotations
being summarily rejected.

v) Goods should be dispatched at carriers risk failing which they should be properly
covered by transit insurance with Government Insurance Fund, Free Press Journal
Marg, Mumbai-32. However, the supplier will be responsible until the entire stores
contracted for, arrive in good condition at destination.
22. GENERAL INSTRUCTIONS :a) The Tenderer should quote all inclusive (i.e.basic rate,State and Central levies, packing
freight charges,Transport charges,etc.) F.O.R.destination rate, excluding octroi. The octroi
exemption certificate will be issued by the consignee wherever applicable. The rate of
MST/CST/VAT included in the above rate should be shown separately.
The contractor will have to follow provisions under Rule 194(1) and 194(2) of Bruhan
Mumbai Municipal Corporation Octroi Rules 1965 when the material is supplied to Bruhan
Mumbai Milk Scheme.
b) Fall price :- It is a condition of the contract that the price at which the Contractor will supply
the stores should not exceed the lowest price charged the contractor to any customer during
the currency of the rate contract and that in the event of the prices going down, below the
rate contract prices the contractor shall promptly furnish such information to the Dairy
Development Commissioner to enable him to name the contract rates for subsequent
supplies.
c) Exact earliest and clear delivery period should be quoted.
d) It will be the responsibility of the Tenderer to inform this office within the validity period of the
quotation in the event of the stores offered ex-stocks being sold elsewhere. Failure to
comply with this instruction shall be constructed to mean that the stores are available exstock during the validity period.
e) Tenderers should indicate the rate in metric system of weight and measures or in any
equivalent weights and measures before showing conversion rates.
f) Ex-stock offer or those on Tenderers own import licence will only be preferred.
g) Inspection of material supplier will be carried out by consignee at destination.
h) The Tenderers should please note that the rate of each item and other details should be
given as required under each column. If the specifications are different than those
prescribed in the tender they should be shown in a separate page but the rate for these
items should be indicated on the form. Some procedure should be followed for alternative
quotations for the same item.
i) The samples for the quoted items must be submitted along with quotation.
j) Samples destroyed in tests will not be returned and no payment made thereof.
k) The Tenderers will have to supply the stores exactly as per tender enquiry specification and
will be responsible to replace the defective supply at his risk and cost.

l) The supplier should undertake to extend the validity of the Bank Guarantee if offered as
Security Deposit in case the supply of stores is delayed beyond the validity period of the
Bank Guarantee.
m) Any correspondence regarding subsequent reduction in price after tender is opened unless
asked for by way of negotiations, will not be entertained at all.
n) The Tenderer should attach a copy of the power of attorney in respect of the persons who
attend the office for tender opening, further follow up work and also who is authorized to
sign tenders, agreement and other relevant documents.
o) If there are any specific Government directives such as reservation of items for units in
Maharashtra non-eligibility of price preference to SSI Units etc. for particular item, the same
would be applicable irrespective of the fact that it has not been incorporated in the Tender
Notice.
p) The Tenderer should invariably quote a list of documents enclosed with the Tender and
the list should be duly signed by the authorized person.
q)

Preference will be given to the from manufacturer. Wherever an offer for an item is other
than manufacturer such quotation must be accompanied by letter of commitment from
manufacturer that they would be supplying goods to the concerned Tender/Supplier secured
the order.
