Charge Description: On or about Saturday, November 15, 2014 the defendant knowingly lacking lawful authority to
do so, intentionally confined or restrained any other person, to wit: X.X.X., without said person's consent. This
offenseoccurredinChisagoCounty,Minnesota.

STATEMENTOFPROBABLECAUSE

OnNovember15,2014,atapproximately19:55hours,SergeantPuelstonreceivedareportofadistraught
femaleattheresidenceof45970GovernmentRoad,Harris,ChisagoCounty,Minnesota.Dispatch
advisedthattheyreceivedareportofanadultfemalewhostatedshewasinsidetheresidenceand
neededhelpandfeltlikeshecouldnotleave.WhileinroutetotheresidenceSergeantPuelstonwas
informedbydispatchthattheadultfemaleinformedthemthatshebelievedsheheardthesuspectcocking
agun.Dispatchalsostatedthatthecallerwaswhisperingandamalecouldbeheardinthebackgroundat
times.Dispatchrelayedthattheywereinformingthecallertogetoutoftheresidenceifshewasable.
Uponarrivingattheresidence,OfficerEngebretsonobservedanadultfemale,whowaslateridentifiedas
X.X.X.,runoutoftheresidencetowardslawenforcement.X.X.X.reportedthatthesuspectwasinsidethe
residenceinthelivingroomarea.SergeantPuelstonandDeputyStensonapproachedtheresidencefrom
thewestside.Theyobservedanadultmaleexitthehouseandstandonthestoop.SergeantPuelstonand
DeputyStensonsecuredthesuspect,whowaslateridentifiedasJESSEMICHAELERICSON,dateof
birthJune1,1966,hereinaftertheDefendant.
OfficerEngebretsonspoketoX.X.X.,whoinformedherthattheDefendantwasintheresidenceandthat
shehadnotseenanyweapons,butheardwhatshebelievedwasthecockingofagun.X.X.X.appearedto
beveryupset,wascrying,andstatedthatshewasscared.X.X.X.toldOfficerEngebretsonthatshehad
gottenintoafightwithherhusbandwhileattheMotel6inRoseville.ShesaidthattheDefendantofferedfor
hertostepintohisvehicletocalmdown.ShesaidthattheywenttoastoreandafterwordtheDefendant
wassupposedtotakeherbacktoherhusband.InsteadtheDefendantdroveontoInterstate35.X.X.X.told
theDefendantthatshewantedtogobacktoherhusband,buttheDefendanttoldherthatthiswouldbe
reallyquickandheneededtocheckonhisdog.TheDefendantthenbroughtX.X.X.totheresidencein
Harris,butX.X.X.didnotknowwhereshewas.X.X.X.saidthatshewasfrightened,butshewas
concernedaboutupsettingtheDefendantandbeingharmed.
X.X.X.furtherstatedthatattheresidence,shecontinuedtotelltheDefendantthatshewantedtogohome,
buttheDefendantkepttellingherthatsheshouldnotworryaboutitandhewouldtakecareofher.The
Defendantalsotoldhertogoupstairsandtakeherclothesoffandhewouldwashthemforher.X.X.X.'s
statementtoOfficerEngebretsonwascomingoutinbitsandpiecesasX.X.X.wasupsetandcrying.
X.X.X.madecommentsabouthowstupiditwasforhertogetintothecar,butshedidn'tknowwhattodo
andtheDefendantmusthavedonethisbeforebecauseheseemedsocomfortableandsmoothas
everythingwashappening.
SergeantPuelstonspokewiththeDefendant,whostatedthathehadjustpickedupafemaleinthe
Rosevilleareaandbroughtherbacktothisresidence.TheDefendantstatedthathewasnotsurewhatwas
happeningandhedidnotbelievethathehaddoneanythingwrong.TheDefendantstatedthatX.X.X.must
havecalled911becauseshewashavingapanicattack.Lawenforcementperformedasweepofthe
residenceanddidnotlocateafirearm.
SergeantPuelstonwentoutsideoftheresidenceandspokewithX.X.X..SergeantPuelstonobservedthat
X.X.X.appearedtobehyperventilating,breathingveryquickly,wasvisiblyshaking,havingtremors,and
statingthatshedidnotwanttoseehimagain.SergeantPuelstoninformedherthatshewouldnothaveto
seetheDefendantagainandaskedhertoexplainwhathappened.X.X.X.explainedthatatapproximately
1830hours,shewaslocatedintheparkinglotoftheMotel6inRoseville,Minnesotawithherhusband.She
statedthatshegotintoanargumentwithherhusbandandthatshehadobservedtheDefendantsittingina
whitetruck.TheDefendantbeganspeakingwithherandinformedherthatshecouldgetintohistruckto
havesometimetocooldownfromtheargumentwithherhusband.X.X.X.gotintohistruckandtheydrove

toaHolidaygasstation.X.X.X.informedSergeantPuelstonthattheDefendantimmediatelybegancalling
her"babe"and"honey."X.X.X.statedthatafterthegasstationtheygotontoInterstate35Enorthbound.
X.X.X.statedthatshebecameincreasinglynervousandaskedtheDefendantwheretheyweregoing.The
Defendantinformedherthatheneededtogotohisresidencetocheckonhisdog.X.X.X.informed
SergeantPuelstonthatshetoldtheDefendantonseveraloccasionsthatsheneededtogobacktoMotel6
andherhusband.TheDefendantrespondedtoX.X.X.thatheneededtogotohishousetocheckonhis
dog.TheDefendanttoldX.X.X.thathelivedintheCambridgeareahowever,hisresidenceisactually
locatedinHarris,whichis15mileseastofCambridge.
X.X.X.statedthatastheycontinuednorthboundonI-35shebecameincreasinglynervousaboutwhatwas
happeningandthatshehadnoideawhereshewaswhentheyarrivedattheresidence.Shestatedthatthe
Defendantbroughtinsomegrocerieswhentheyenteredthehouseandsheobservedhimslidealandline
phoneunderneathastackofnewspapersonthekitchentable.Shelaterdiscoveredthatthephonehad
alsobeenunpluggedatsomepoint.SheinformedSergeantPuelstonthattheDefendantthenaskedherto
comeupstairswithhimbutshecontinuedtosaynoandbegancrying.SheexplainedthattheDefendant
grabbedherarm,andwristinanattempttobringherupstairs.ShecontinuedtotelltheDefendantno.The
Defendantwouldtouchherbuttocks,includingcaressitandgrabitaswellasplacehisarmaroundher
waistandrubherbackandshoulders.X.X.X.statedthatshefeltlikeshewasunabletoleavethe
residenceandbelievedthattheDefendanthadunpluggedthephonetopreventherfromcallingout.
TheDefendantwentupstairsbyhimselfandX.X.X.hadpluggedthephoneinandcalledherhusband.She
informedherhusbandthatshedidn'tknowwhereshewasandcouldonlyseeanenvelopewithanaddress
fromRushCity.TheDefendantthenreturnedtotheroomandagainaskedX.X.X.tocomeupstairswith
him.X.X.X.reiteratednoandstatedsomethingaboutthefactthatshewascoldorthatherclotheswere
slightlydamp.TheDefendantrespondedthathewouldwashherclothesforherandthatshecouldwear
someofhisclothes.TheDefendantalsotoldherthathewouldbringherbacktoRosevilleinthemorning,
butX.X.X.toldhimnoandthatshewantedtoleavenow.ShestatedthattheDefendantbecame
increasinglyagitatedandbeganstompingupanddownthestairs.Sheexplainedthatoneofthesetimes
shebelievedsheheardtheDefendantcockingagun.X.X.X.informedSergeantPuelstonthatatthispoint
shewasthinkingthatshewasgoingtodie.
Afterreturningupstairs,X.X.X.pickedupthephoneandheardtheDefendantspeakingonwhatsounded
likeasexlineashewassayingsexuallyexplicitthings.Shestatedthatshehungupthephone,butthen
pickeditupagainandcontinuedtoheartheDefendant'svoiceonthephone.Shestatedthatshebelieves
theDefendantthenheardheronthephoneandshehungup.X.X.X.pickedupthephoneathirdtimeand
gotadialtoneatwhichpointshecalled911.X.X.X.statedthatatthispointtheDefendantcame
downstairsandbeganturningoffthelightsandhadatsomepointlockedthedoortotheresidence.During
thistime,X.X.X.statedthatshewasbecomingincreasinglyscaredandtheDefendantwasgoinginside
andoutsidetheresidenceandpacingaround.Atsomepoint,X.X.X.statedshefeltshehadanopportunity
tofleefromtheresidenceandsheranoutthefrontdooratwhichtimeshemadecontactwithOfficer
Engebretson.
Sgt.PuelstonplacedtheDefendantunderarrestandtransportedhimtotheChisagoCountyJail.Atthejail,
theDefendantwasreadhisMirandarightsandheindicatedthatheunderstoodhisrightsandwaswilling
toprovideastatement.Sgt.PuelstonfoundtheDefendanttobeevasiveandwouldnotfullyanswerthe
questions.TheDefendantstatedthathesawX.X.X.getintoafightwithherhusbandandheofferedtotake
hertogetfoodandcalmherdown.HestatedthattheygotfoodatHardee'sandthenwenttoagasstation.
Hesaidthatafterthegasstation,hestartedheadingtohishouse.TheDefendantstatedthathetoldX.X.X.
thatshecouldstayathishouseanddealwithherproblemsinthemorning.HestatedthatX.X.X.agreedto
gotohishouse.TheDefendantstatedthatonceathisresidence,heunloadedsomegroceriesandfedhis
cat.TheDefendantexplainedthatX.X.X.startedmakingsomecallsandshethenhadapanicattack.The

Defendantsaidthathewastryingtocalmherdownandthenshelefttheresidenceinordertogetsomeair.
Inadditiontootherpriorconvictions,theDefendanthasbeenconvictedofFelonyKidnappingfroman
incidentin2012,GrossMisdemeanorFifthDegreeCriminalSexualConductfromanincidentin2010,and
FelonyThirdDegreeCriminalSexualConductfromanincidentin1990.
