Decisions on complaints are generally issued within 90 days of receipt of the

Describe the facts and circumstances that support the complaint. (Provide as much detail as
possible. Attach additional pages if necessary.)
Between the dates, October 25 - November 2, 2014, my investigative team was drawn into an investigation
which included the possible / probable ethical and / or criminal misconduct by a senior Frederick County
employee (Department Head).
In an email, dated Nov. 13, 2014, sent to Ms Thall at the County Attorney's office and to Mr. Smith at the
State's Attorney office, I wrote, "I strongly encourage each of your offices to meet with us, face-to-face, in order
to review and discuss this very important matter".
Additionally, on the same date, correspondence, via email, was sent to the CA and SA which stated, "I believe
a review and discussion of the range of artifacts would be in the best interests of your office, as well as the CA,
to determine the scope of these activities and where they fall onto the ethical and / or criminal misconduct spectrum".
Ms. Thall's response included, "It is up to you to decide whether you wish to share your information with the Ethics
Commission. I cannot provide you with legal advice in this matter and do not believe that it would be appropriate
for us to meet".
As a citizen and a layman, I reached out to Ms. Thall and Mr. Smith for assistance in determining what percentage of
evidence should be considered for inclusion in an Ethics Complaint and what percentage should be directed toward
State's Attorney for criminal investigation. A request of this nature is intended to file the appropriate facts into an
Ethics Complaint document, which will not be returned for lack of information or denied for reasons that could not,
or would not, exist if Ms. Thall used the prestige of her office to assist a citizen.
I strongly believe Ms. Thall's actions and refusal to assist in the determination of ownership for evidential data and
documentation place a full and unnecessary burden on an individual citizen. For Ms. Thall to have information,
to the extent she has been made aware and knowledgeable of ethical and / or criminal misconduct by a
senior county employee, demonstrates gross negligence, bordering on obstruction of justice.
Ms. Thall may have fine print in the description of her professional responsibilities which provides her the flexibility
to say no to the requests which have been placed in front of her regarding this matter. However, the importance
and disturbing evidence of this matter should trump any fine print. As a legal professional for the county, who derives
her income from the taxpayers, Ms. Thall should be working with layman citizens to resolve issues, rather than turning
a blind eye or deaf ear to those who advocate for accountability in our county government.
