I.

LAWS ON VIOLATIONS OF LAND TRANSPORTATION LAWS

A. R.A. 7924 The Metropolitan Manila Development Authority
(MMDA) Law
Section 5(f) of said law states that:
Sec. 5. Functions and Powers of the Metro Manila
Development Authority The MMDA shall:

Install and administer a single ticketing system,


fix,
impose and collect fines and penalties for all kinds of
violations of traffic rules and regulations, whether moving
or non-moving in nature, and confiscate and suspend or
revoke drivers licenses in the enforcement of such traffic
laws and regulations, the provisions of R.A. 4136, and P.D.
1605 to the contrary notwithstanding. For this purpose, the
authority shall enforce all traffic laws and regulations in
Metro Manila, through its traffic operation center, and may
deputize members of the PNP, traffic enforces of local
government units, duly licensed security guards, or
members of non-governmental organizations to whom may
be delegated certain authority, subject to such conditions
and requirements as the authority may impose.

R.A. 4136 the Land Transportation and Traffic Code


Sec. 2 of said law, provides:
Sec. 2. Scope of Act. The provisions of this Act shall
Control, as far as they apply, the registration and operation of
motor vehicles and the licensing of owners, dealers, conductors,
drivers, and similar matters.
Section 27 of said law empowers the Land Transportation Office (LTO)
through its Commissioner and Deputy Commissioner, to register motor vehicles
and issue drivers licenses nationwide, and provides for the confiscation,
suspension and revocation of the same.

C. RA 8506
The law banning the registration and operation of vehicles with right hand
steering wheel in any private or public street, road or highway.

R.A. 8749
The Clean Air Act of 1999
Sec. 46, of said law provides:
Sec. 46. Violation of Standards for Motor
Vehicles No motor vehicle shall be registered with the DOTC
unless it meets the emission standards set by The Department x x.

The Seat Belt Use Act of 199
Sec. 12, of said provides:
Sec. 12. Penalties and Fines. In the enforcement
of this Act, the LTO shall impose fines against drivers,
operators, owners of vehicles, manufacturers, assemblers,
importers and/or distributors for violation of this Act.

The Metro Manila Council, MMDA, the policy-making body, promulgates


Ordinances, Traffic Regulations, (Annex E ), Fines/Penalties (Annex F), with its
amendments and increases of fines for violations of land transportation laws in
coordination with the LTO. Its applicability and enforceability depends on the
existence and amendments of the Land Transportation Laws that mandates its
regulatory powers1
Violations Fines, Penalties Imposed by the LGUs on Traffic Laws Violations
Presently imposed ordinances of some LGUs regulating transportation and
traffic are:
1.

Ordinance Numbered 033, series of 2000 (Annex G)


An ordinance seeking an effective solution to the serious parking
problems in the areas within the jurisdiction of the City of Baguio.

Sections 19 and 20 of said ordinance prescribes the parking fees


payable for the use of parking spaces (Sec. 19) and the towing fees
required (Sec. 20).
Sec. 21 of the same ordinance prescribes the fine and other
penalties imposed upon owners, operators and drivers of illegally parked
or stalled vehicles.
