Dear Mr. Denton Sorensen:

I am Atty. Juan Viada dela Cruz, Managing Partners of Viada and Associates Law Firm. I
have been in consolidation with the case of Captain Henry Hacek pertaining to his
involvement in the allision of the MV Gargantuan with the Gyro Power Barge. The
unfortunate incident was already under the jurisdiction for investigation of the Board of
Marine Inquiry.

You recall that you made a witness statement and participated in the visually recorded
interview in relation to the investigation conducted by the Board of Marine Inquiry into
an offense of negligence of duty allegedly committed by Captain Henry Hacek.

Often it is enough for me to read the statements or watch the visually recorded interview and
render a decision based on these means alone. However, sometimes, particularly in cases where
there is ambiguity and complexity in some of its aspects, I need to speak to the witness myself in
order to make certain and detailed inquiries regarding the evidence provided by the latter.
Thereafter, I can already make my final decision.

The meeting where this takes place is known as a pre-trial witness interview.

In this case, I need to speak to you regarding about the evidence that is contained in your
statement and visual recording of interview in order for me to fully understand the evidence
presented and to ensure that I have acquired all the relevant information in order to make a
sound decision.

The interview will be in private. The only people present in the meeting will be the both of us.
But as matter of procedure, the interview will be recorded in order to document it accurately in
case we need to refer back to it and to negate any presumption on the part of the defense that I
will manipulate you in willingly fabricating or suppressing any evidence.

You may bring someone to provide emotional support as long as they are not connected
in the case in any way. They cannot take an active part in the interview or answer
questions on your behalf. Please call my office in advance of the interview and inform
me who is going to attend to support you.

Some food and drinks will be provided.

I would highly appreciate if you would contact our office to arrange a time for the
meeting. The meeting will be held at your convenience and your reasonable expenses
will be reimbursed. Enclosed with this letter is an expenses form.

If you have any questions, or concerns about the interview, please do not hesitate to
call me and I will be very glad to address any queries you.
