Considering that violence and intelligence gave mankind the first place in the
food chain and that denial is the main cause of unresolved problems,
Noting that man, despite the fact that he is endowed with intelligence, he
often acts instinctually creating disasters and tragedies,
Noting that mans lack of responsibility in his relation with the environment
and his tendency towards an irrational consumption of resources can lead to the
extinction of other species, including the human species,
Considering the survival of the human species prior to other interests,
Considering the law a support for achieving and maintaining the balance in
society and the capacity of the human nature to be brought up as being underused,
Noting that the man lacking opportunities and equal chances for personal
development has a tendency to commit crimes,
Noting that taking up positions in society, on criteria that do not include
competence, leads to tragedy and major disruptions in the harmonious
development of society,
Considering mans criminal and antisocial behaviour as a serious disturbing
element in creating and maintaining balance in society,
Considering prevention as an essential component in reducing crime and
antisocial acts,
Considering competition as a source of development and empathy as a key
for conflict resolution,
Noting the lack of an effective means of holding parents responsible or, when
applicable, childrens legal representatives, regarding their education and the
inability of certain teachers to share successfully their knowledge to children,
Considering that Romania's future can be assured by intelligent, strong,
balanced and research-oriented people who show respect for the environment and
their peers,
Having faith in the value of the human being and the capacity of the human
nature to be brought up, I propose for debate and approval the law STAN,
designed to make Romania, by improving the quality of the human resources
and the development of competition, one of the most competitive countries in
the world.

Law STAN
On the improvement of the quality of human resources
General provisions
Art. 1
Considering that Romania's future can be assured by intelligent, strong,
balanced and research-oriented people who show respect for the environment
and their peers, the object of this law is to regulate the legal framework for
improving the quality of human resources through:
a) increasing the degree of involvement and holding parents or, where
applicable, the legal representatives, responsible for their children's education;
b) holding teachers responsible for continuously improving the quality of
education and creating a climate favourable to the assimilation of information
during the classes allocated to the subjects taught in the school program;
c) the integration on the labour market on criteria of competence.
Art. 2
With a view to this law:
a) are considered children all human beings under 18 years old, and students,
the people attending a public or private pre-university educational institution;
b) by antisocial behaviour one understands the behaviour that deviates from the
rules of good cohabitation in society and is directed to produce psychological,
material, moral or mixed damage.
Rights and obligations
Art. 3
(1) People have a duty to give birth to children from 25 years of age and only
when they are ready mentally and are fully aware of the material and financial
efforts they must provide for their children's education.
(2) The state has an obligation to ensure free of charge for its citizens:
a) contraception;
b) medical examination during pregnancy;
c) two abortions.
Art. 4
The parents or, when applicable, the legal representatives are required to get
involved in the education of children and to take the necessary steps so that
they:
a) obtain at least minimum marks / ratings to promote school subjects;
b) do not exhibit antisocial behaviour and do not commit crimes.
Art. 5
The parents or, when applicable, the legal representatives of children are
forced, once a month, to contact the school-master / form teacher to know the
evolution and behaviour of children at school in their relationship with their
peers and teachers.
Art. 6
Teachers are obliged to:

a) create during the hours allocated to the subjects taught in school a pleasant
climate favourable to the assimilation of information;
b) identify and implement effective methods of teaching and learning so that
students can easily retain and apply effectively what they have learnt;
c) be objective in providing notes and ratings;
d) exclude any form of abuse or discrimination in the relation with the students.
Art. 7
Teachers are absolutely prohibited to show any form of physical or emotional
violence on students, except for self-defense situations.
Art. 8
The school-master or the form teacher, during the educational classes, has a
duty to guide students to investigate various hypotheses, ideas, daily events,
phenomena, including astronomical phenomena, to be open to new, to protect
the environment and, at the right age, to have close relationships with people
close to their age who do not exhibit antisocial behaviour and do not tend to
commit crimes.
Art. 9
The school-master or the form teacher is obliged to inform the parents or, when
applicable, the legal representatives of children when they do not get minimum
marks / ratings for promotion to two school subjects at the most or exhibit
antisocial behaviour in relation with their teachers and peers.
Art. 10
The headmaster of the school is obliged:
a) to inform the parents or, when applicable, the legal representatives of
children if, one month after being informed by the school-master or the
form teacher, the children continue to exhibit antisocial behaviour and do
not get minimum marks / ratings for promotion to two school subjects at
the most;
b) to inform the School Inspectorate / Bucharest School Inspectorate if, one
month after informing the parents or, when applicable, the legal
representatives of children, continue to exhibit antisocial behaviour and
do not get minimum marks / ratings for promotion to two school subjects
at the most.

Art. 11
(1) The County School Inspectorate, upon notification from the headmaster of
the school, has the obligation to inform the General Directorate of Social
Assistance and Child Protection which will sue the parents or, when applicable,
the legal representatives of children for non-involvement in the education of the
child / children.
(2) The County School Inspectorates / Bucharest School Inspectorate are
required to publish the situation of schools on their websites at the end of the
school year.
Art. 12
Schools are required to organise activities of ecology and environmental
protection in October and April each year.
Art. 13
Students have a duty:
a) to obtain at least minimum marks / ratings to promote school subjects;
b) not to copy in exams, thesis and tests;
c) not to have an antisocial behaviour;
d) not to commit crimes.
Art. 14
Students have the right:
a) to assess twice during the school year at the end of November and at the end
of March:
1) the teachers ability to share their knowledge successfully in the
classes allocated to the taught subjects;
2) the teachers ability to create during school classes a pleasant climate
favourable to the assimilation of information.
b) to take part free of charge, outside school classes, three times a week, in
classes of chess, martial arts, MMA (Mixed Martial Arts), Kickboxing, K1,
boxing, Graeco-Roman wrestling, bodybuilding, music classes, dance, painting,
photography, poetry, reading and theatre.
Art. 15
The public authorities are obliged to provide, free of charge, the spaces
necessary for the development of classes of chess, martial arts, MMA (Mixed

Practising bodybuilding is not recommended to students who have not turned
15 years of age.

Art. 19
(1) The County Councils, in collaboration with the County School
Inspectorates, the sports associations, the cultural associations and the people
certified as instructors involved in the training of children in the fields of chess,
martial arts, MMA (Mixed Martial Arts), Kickboxing, K1, boxing, GraecoRoman wrestling, bodybuilding, music, dance, painting, photography, poetry,
reading and theatre, are required to hold for a week competitions between
schools in that county in early December each year.
(2) Violence in schools and consumption of drugs are compulsory competition
topics for martial arts, dance, music, painting, photography, poetry, reading and
theatre.
(3) The County Councils have the right to make exhibitions of painting sales,
photo sales, to select the best poems, stories / tales, songs and market them.
50% of the resulting amount reverts to the author or authors and 50% is
considered income to the local budget.
(4) The publics access inside the locations where the competitions take place is
based on tickets, and the amounts from the tickets sales are considered income
to the local budget.
(5) The economic agents may support financially the contests.
(6) The holders of the Ist, IInd and IIIrd places for each subject, are entitled to
participate in the national contest.
Art. 20
(1) The Ministry of National Education will hold at the beginning of April
every year the national contest of chess, martial arts, MMA (Mixed Martial
Arts), Kickboxing, K1, boxing, Graeco-Roman wrestling, bodybuilding, music,
dance, painting, photography, poetry, reading and theatre.
(2) The holders of the Ist, IInd and IIIrd places at the county contests take part in
the national contest.
(4) The local authorities have an obligation to ensure for children, where
appropriate, free transportation in order to participate in the actions Policeman
for a Day, Riot Policeman for a Day ", "Soldier for a Day".

Art. 23
The economic agents are obliged:
a) to carry out in the month of October of each year a forecast of the available
jobs for a period of one year, to establish general and specific conditions for
the employment expected to be available and to send the information:
1) to the County Employment Agency or, if applicable, to the Municipal
Agency for Employment in Bucharest;
2) depending on the specific jobs expected to be available, to the County
School Inspectorate / Bucharest School Inspectorate or to the institutions
of higher education in the county where the economic agents run their
activity;
3) to the institutions of higher education in the immediate vicinity of the
county where the economic agents run their activity, if in the county
where the economic agents run their activity there are not institutions of
higher education or the specific conditions for the employment which are
expected to be available require a certain qualification.
b) to update in the month of April every year:
1) the forecast of the employment expected to be available drawn up in
October the previous year;
2) the general and specific conditions for the employment expected to be
available.
c) to hold competitions or examinations for the available employment;
d) not to favour one or more candidates to obtain an available job or jobs; the
employment is made available strictly on the basis of competence criteria.
Art. 24
(1) The County School Inspectorates / Bucharest School Inspectorate and the
institutions of higher education have an obligation to let pupils and students
know:

(7) The remarried parents, more than once, of children who commit crimes or
do not graduate from school are penalized by 30% of the net salary income, for
a period of three months, and visit to prison. If one or both parents do not have
the financial means, he or they shall perform community service.
Art. 26
The students who have reached the age of 16 years, exhibit antisocial
behaviour, cheat at examinations, end-of-term examinations or tests, have resits
or do not graduate from school are punished with community service and visit
to prison.
Art. 27
(1) If at the evaluation of the end of March, more than 70% of students believe
that one or more teachers does/do not successfully share his/their knowledge in
the classes allocated to the subjects taught and during the school program
does/do not create a pleasant climate, favourable to the assimilation of
information, then he or they shall be penalized by written observation.
(2) The teacher or teachers who have been penalized by written observation and
at the evaluation at the end of November of the year following the assessment
in March, more than 60% of students believe that he or they does/do not
successfully share his/their knowledge within the classes allocated to the
subjects taught and during the school hours does/do not create a pleasant
climate, favourable to the assimilation of information, are penalized by written
warning.
(3) The teacher or teachers who have been penalized by written warning and at
the assessment at the end of March in the year when he was or they were
penalized by written warning, 50% of the students consider that he or they do
not share their knowledge successfully in the classes allocated to the subjects
taught and during school hours does/do not create a pleasant climate favourable
to the assimilation of information are penalized by cancellation of the labour
contract.
(4) The violation of article 6, letter c) is punishable by reducing the basic salary,
accumulated, when appropriate, with the management, monitoring and
evaluation compensation, by up to 7% over a period of 1-2 months.

Art. 30

(1) The applications and legal proceedings taken by people who consider
themselves wronged by the economic agents at the competition or examination
held for employment are exempted from stamp legal fees.
(2) Upon request, the people who consider themselves wronged by the
economic agents at the competition or examination held for employment
benefit from a counsel for the defence appointed by the judge.
Art. 31
The public institutions are obliged to organize in the period The week School

Art. 32
(1) The law Stan is completed with other regulations in force.
(2) The law Stan comes into force at the beginning of the new school year after
its publication in the Official Gazette of Romania.
(3) Not later than six months after the publication of this law in the Official
Gazette of Romania, the Ministry of National Education and the Ministry of
Labour, Family and Social Protection will draft the legal documents arising
from the application of the law, which will also be published in the Official
Gazette.
This law was adopted by the Romanian Parliament, in compliance with art. 75
and art. 76 paragraph (1) of the Romanian Constitution, republished.
