In 1977 the City of Milwaukee adopted an ethics code for its elected officials, supervisory personnel,
boards and commissions. The ethics code provides the best vehicle to assure the community that its
officials recognize that the holding of public office is a public trust. Ethical conduct is truly a matter of
performing one's duties and responsibilities in accordance with established rules and guidelines of good,
sound judgment. Showing strict regard for ethical conduct is essential in order to maintain high public
esteem. Our public officials are very concerned with this issue. The community, in turn, should be
equally concerned with the rights and reputation of its dedicated public officials. Public cooperation is
required to assist the Ethics Board in maintaining Milwaukee's reputation for high ethical standards and
conduct.
Role of the Ethics Board
The major concern of the Ethics Board is the preservation of the high ethical standards of the City of
Milwaukee. The Ethics Board addresses this concern by:

Issuing confidential advisory opinions to covered persons with respect to their own situation or
plans. A factual summary will be issued annually deleting all personal references.

Investigating sworn complaints. The board provides a format and process for filing complaints.
While a complaint and the findings of the Board may become matters of public record, only the
complainant's name will be released until the Board has concluded its review.

Requiring annual financial statements. The Board reviews a simple form which asks for
information on the issues that could give rise to conflicts of interest. No detailed financial
disclosure is required. The individuals required to file such statements are listed by position in
the Positions Ordinance.

Who Is Covered?
The Ethics Ordinance of the City of Milwaukee specifically covers:

Office holders or candidates for public office


Employees in the classified service.
Exempt employees.
Citizens serving on boards or commissions.

What Concerns Are Addressed?


The major concern of the Ethics Board is to maintain the high ethical standards of Milwaukee's City
government. The ordinance prohibits:

Business associations, financial interests or other activities which could give rise to conflicts of
interest in fact or appearance.

Ladies and Gentlemen of the Ethics Board!


This is a FORMAL COMPLAINT by Mary Glass, Chair/CEO/CVO of Milwaukee
Professionals Association LLC, for this body to investigate inappropriate behavior Code of
Conduct by Alderman Russell Stamper II, charter officers, city officer, appointed BID #32 Board
Members appointed by the mayor and non-profit organization engaged in Class B licensing
process for District 15.
Selling of beer, wine and liquor is lawful in the city of Milwaukee.
There is a process for acquiring a Class B license. MC COLE filed a Class B application.
MC COLE, investor, property owner, taxpayer and employer is my client. He was certified July 7,
2014. His meeting for compliance was held October 20, 2014. He was in FULL COMPLIANCE.
His Class B license was placed on HOLD arbitrarily and capriciously by Alderman Russell Stamper
II. After 156 days, he is without a Class B License. Questionable and bizarre behavior has
breached the TRUST of the Class B process and those responsible for representing the city.

The Code of Conduct by Alderman Russell Stamper II, 15th District, is at the core of this
Formal Complaint. His LACK of due diligence for due process; failure to represent his charter
officer office as Alderman of District 15; failure to represent the License Committee as a member;
failure to communicate with MC COLE, Class B customer and taxpayer after 3 weeks of contact by
MC COLE; Alderman Stampers on-off and NO SHOW of meetings with MC COLE; his failure to
provide MC COLE the same Class B License treatment as he conveyed to DONALD LEWIS, Urban
Caf, 2451 W. Fond du Lac Avenue, Milwaukee, WI 53206; his failure to show good faith in
representing his office for the 15th District and a charter officer representative doing business
with a taxpayer when speaking with and visiting BID 32 without recognizing MC COLE; his
overwhelming bias statements during the 10-20-2014 reference the social influence of Walnut
Way Sharon Adams; his bartering and coercing behavior at the License Committee Meeting and
in-the-neighborhood conveying his will of what MC COLES business should be - A Soul Food
Restaurant.
Whereas, MC COLE, property owner, investor and employer, 1810-1822 W. Fond du Lac, is
my client seeking the Class B License for 156 days, you will notice that others will be referenced.
Specifically, DONALD LEWIS, Urban Caf, 2451 W. Fond du Lac Avenue and HOPE COLBERT, 1376
W. Wright Street BOTH SOUGHT Class B License. They are seen in the Video of the License
Committee Meeting of October 20, 2014.

Our Formal Complaint include the Code of Conduct and vigilante behavior of members of the
neighborhood in leadership of organizations receiving government funding and philanthropic
funding on behalf of neighborhoods in the vicinity of MC COLE site; member of the
neighborhood that receive CDBG funding and other government development funding;
member of the neighborhood BID #32 failed to invite and discuss MC COLEs Class B License on
their Monthly Agenda as they did for DONALD LEWIS, Urban Caf; TAXATION WITHOUT
REPRESENTATION [MC COLE has automatically paid BID assessment ], SHARON ADAMS,
Virginia DuPriest YMCA-CDC have WORKED behind the scenes to BLOCK MC COLES Class B
License.
Therefore, we include:

SHARON ADAMS BUSINESS INVESTMENT DISTRICT #32
BUSINESS INVESTMENT DISTRICT #32
Additionally, we have added the wrongful behavior of Alderman Russell Stamper while
dealing with the Approval of Class B license for DONALD LEWIS with mandates and coercing
with demands of Tabernacle Church, 2500 W. Medford, Milwaukee, 53205 to limit sell of beer,
wine liquor from 9:00am 4:00pm on Sunday, during DONALD LEWISs SOUL FOOD SUNDAY
MEALS. This is an infringement. NOTICE DURING THE VIEWING OF THE VIDEO HOW
DONALD LEWIS acquiesce halfheartedly TO GET THE CLASS B LICENSE.
This type of behavior is not only out-of-order; it sends the wrong message for doing business
with the city of Milwaukee.

We have repeatedly informed and asked for assistance from Mayor Barrett,
Treasurer Coggs, City Attorney Langley, Comptroller Matson, Common Council
President Michael Murphy, city Clerk Owczarski and they have remained
unresponsive. A special review was asked of Common Council President
Murphy who is responsible for behavior oversight of the members of the
Common Council NO RESPONSE.

We have Oath of Office, U. S. Constitution, State Statute and city


ordinances that have been violated by being complicit and in lockstep with improper behavior known. We see Explicit BIAS given to a
colleague here they know a wrong is/has been done but NO one
says so.
This is criminal.

Ordinance & Statute


WI - 6.1109(1)(b) (b) "Business improvement district" means an area within a municipality
consisting of contiguous parcels and may include railroad rights-of-way, rivers, or highways
continuously bounded by the parcels on at least one side, and shall include parcels that are
contiguous to the district but that were not included in the original or amended boundaries of the
district because the parcels were tax-exempt when the boundaries were determined and such
parcels became taxable after the original or amended boundaries of the district were determined.
MILWAUKEE - 303-7. Conflict of Interest Prohibited; 1. Except in accordance with the board's
advice under sub. 2 and except as otherwise provided in sub. 3, no official or other city employe
may: a. Take any official action substantially affecting a matter in which the official or employe, a
member of his or her immediate family, or an organization with which the official or employe is
associated has a substantial financial interest. b. Use his or her office or position in a way that
produces or assists in the production of a substantial benefit, direct or indirect, for the official or
employe, one or more members of the official's or employe's immediate family either separately
or together, or an organization with which the official or employe is associated.
303-5. Standards of Conduct. 1. The common council reaffirms that an official or other
city employe holds his or her position as a public trust, and any effort to realize substantial
personal gain through official conduct is a violation of that trust. This chapter does not prevent
any official or other city employe from accepting other employment or following any pursuit
which in no way interferes with the full and faithful discharge of his or her duties to this city.
The common council further recognizes that officials and other city employes are drawn from
society and, therefore, cannot and should not be without all personal and economic interest in
the decisions and policies of government; that officials and other city employes retain their rights
as citizens to interests of a personal or economic nature; that standards of ethical conduct for
officials and other city employes need to distinguish between those minor and inconsequential
conflicts that are unavoidable in a free society, and those conflicts which are substantial and
material and that officials and other city employes may need to engage in employment,
professional or business activities, other than official duties, in order to support themselves or
their families and to maintain a continuity of professional or business activity, or may need to
maintain investments, which activities or investments do not conflict with the provisions of this
chapter.

2. No official or other city employe may use his or her public position or office to obtain financial
gain or anything of substantial value for the official's or other city employees private benefit or
that of his or her immediate family, or for an organization with which he or she is associated. This
subsection does not prohibit an elected official from using the title or prestige of his or her office
to obtain contributions permitted and reported under ch. 11, Wis. Stats.
3. No person may offer or give to an official or other city employe, directly or indirectly, and no
official or other city employe may solicit or accept from any person, directly or indirectly,
anything of value if it could reasonably be expected to influence the official's vote, the official's or
other city employe's official actions or judgment, or could reasonably be considered as a reward
for any official action or inaction on the part of the official or other city employe. This subsection
does not prohibit an official or other city employe from engaging in outside employment.

4. No official or other city employe may intentionally use or disclose information gained in the
course of or by reason of his or her official position or activities in any way that could result in the
receipt of anything of value for himself or herself, for his or her immediate family, or for any
other person, if the information has not been communicated to the public or is not public
information. This provision shall not be interpreted to prevent such official or other city employe
from reporting violations of this chapter or other illegal acts to the proper authorities.
5. No official or other city employe may use or attempt to use his or her position to influence or
gain unlawful benefits, advantages or privileges for himself or herself or others.
6. No official or other city employe, member of an official's or other city employe's immediate
family, nor any organization with which the official or other city employe or a member of the
official's or other city employe's immediate family owns or controls at least 10% of the
outstanding equity, voting rights, or outstanding indebtedness may enter into any contract or
lease involving a payment or payments of more than $3,000 within a 12-month period, in whole
or in part derived from city funds, unless the official or other city employe has first made written
disclosure of the nature and extent of such relationship or interest to the board and to the
department involved in regard to the contract or lease. Any contract or lease entered into in
violation of this subsection may be voided by the city in an action commenced within 3 years of

the date on which the ethics board, or the department or officer acting for the city in regard to
the allocation of funds from which such payment is derived, knew or should have known that a
violation of this subsection had occurred. This subsection does not affect the application of s.
946.13, Wis. Stats.
7.a. No official or other city employe may represent a person for compensation before a
department or any employe thereof, except:

a-1. In a contested case which involves a party other than the city with interests adverse
to those represented by the official or other city employe;
or a-2. At an open hearing at which a stenographic or other record is maintained;
or a-3. In a matter that involves only ministerial action by the department.

b. This subsection does not apply to representation by an official acting in his or her official
capacity.
8. No former official or other city employe: a. For 12 months following the date on which he or
she ceases to be an official or employe, may, for compensation, on behalf of any person other
than a governmental entity, make any formal or informal appearance before, or negotiate with,
any officer or employe of a department with which he or she was associated as an official or
employe, within 12 months prior to the date on which he or she ceased to be an official or
employe.
b. May for compensation act on behalf of any party other than the city in connection with any
judicial or quasi-judicial proceeding, application, contract, claim, or charge which might give rise
to a judicial or quasi-judicial proceeding in which the former official or other city employe
participated personally and substantially as an official or other city employe.
9. The city attorney may not engage in the private practice of law for compensation during the
period in which he or she holds office.
10. This section does not prohibit an elected official from making inquiries for information on
behalf of a person or organization or from representing a person or organization before a
department if he or she receives no compensation therefor beyond the salary and other
compensation or reimbursement to which the elected official is entitled by law.
