In re: RICHARD LETIS

MOTION
ON BEHALF OF RESPONDENT:
ON BEHALF OF OHS:

Weronika K. Costas, Esquire

Thorin Freeman
Assistant Chief Counsel

APPLICATION: Reopening

The respondent moves the Board to reopen the proceeding to enable him to apply for relief
from removal, including adjustment of status, as the husband of a United States citizen.

See

section 240(c)(7) of the Immigration and Nationality Act, 8 U.S.C. 1229a(c)(7); 8 C.F.R.
1003 .2(c). The respondent is the beneficiary of an approved immediate relative visa petition
and has now submitted an application for adjustment of status. The Department of Homeland
Security opposes the motion.
We recognize the patience the Immigration Judge showed in this case regarding the filing of
the respondent's application for adjustment.

However, given the totality of the circumstances

presented here, including the medical issues of the respondent's citizen wife, we will grant this
motion to reopen to provide the respondent one last opportunity to perfect his application for
adjustment.
ORDER:

Accordingly, the following order will be entered.

The motion to reopen is granted and the record is remanded to the Immigration

Judge for further proceedings consistent with this opinion and for the entry of a new decision.

FOR THE BOARD

The respondent appeared via video teleconferencing from the Butler County Jail, Hamilton,

Ohio, with the Immigration Judge sitting in Cleveland, Ohio.
