APPLICATION: Reopening
The respondent moves the Board to reopen the proceeding to enable him to apply for relief
from removal, including adjustment of status, as the husband of a United States citizen.
See
section 240(c)(7) of the Immigration and Nationality Act, 8 U.S.C. 1229a(c)(7); 8 C.F.R.
1003 .2(c). The respondent is the beneficiary of an approved immediate relative visa petition
and has now submitted an application for adjustment of status. The Department of Homeland
Security opposes the motion.
We recognize the patience the Immigration Judge showed in this case regarding the filing of
the respondent's application for adjustment.
presented here, including the medical issues of the respondent's citizen wife, we will grant this
motion to reopen to provide the respondent one last opportunity to perfect his application for
adjustment.
