Pursuant to Rule 56 of the Federal Rules of Civil Procedure and Local Rule Civil

56.1, Plaintiffs, by and through their counsel of record, moves this court for summary

judgment on their Equal Protection claims for declaratory and injunctive relief, on the

grounds that Defendants are unlawfully discriminating against Plaintiffs in violation of

the Equal Protection Clause of the Fourteenth Amendment. This motion is supported by

the attached Memorandum of Points and Authorities, the accompanying Statement of

Facts and Declaration of Christine P. Sun, and all exhibits and statements previously

submitted to this Court and the Ninth Circuit, and incorporated by reference.

Plaintiffs request that the Court enters an order granting summary judgment,

permanently enjoining Defendants, their officials, agents, employees, assigns, and all

11

other persons acting in concert or participating with them from implementing or

12

enforcing the states illegal policy and practice of denying drivers licenses and state

13

identification cards to Deferred Action for Childhood Arrivals grantees; and orders such

14

further relief as this Court deems just and equitable.
