Sub: Consent for Redevelopment of Building Known as ______ C.H.S.L., on Plot bearing
CTS No._____, admeasuring ______sq.mtr. situated at ______________________, hereinafter
referred to as the said Society, through Developer M/S. _______________________.

am/are bonafide member/s and holding 5 (Five) fully paid shares of Rs.50/- (Rupees Fifty only)
each bearing distinctive Nos.______ to _____ (inclusive) of the capital of __________C.H.S.L.,
entered in the Share Certificate No._____ and I/we occupy Flat No._______ in ______ wing on
______ Floor of the aforesaid society (hereinafter referred to as the said society) and hereby
unconditionally declare, undertake and accord herewith my / our free and unqualified and
irrevocable consent and concurrence as under:
1. Pursuant to the decision taken/ resolution passed by the members of the said Society at
their Special General Body Meeting held on ____________, Society has unanimously
appointed M/S. ____________________________. as Developer for redevelopment of
our Society.
2. I/We have gone through all the commercial terms and conditions for redevelopment. I/
We hereby accord herewith my/our final, unqualified, and irrevocable consent, approval
and acceptance of the proposal of the redevelopment of the property of the said Society
by the Developers and I/We further agree and undertake that I/We am/are aware that
the commercial terms will not change in circumstances by reason of lapse of time
including the delay due to any legal action, if any, against the dissenting members.

4. I/We am/are aware that the members occupying the flats in the buildings of the said
Society will have to shift to the alternate accommodation as mutually agreed upon
between the said Society and the Developer, subject to such terms and conditions
agreed with the said Developer and I/We as such member do hereby give my/our
irrevocable consent for the same and agree to vacate the existing premises (flat) in
my/our possession and hand over vacant and peaceful possession of my/our existing
premises (flat) to the said Developer through the said Society and to shift to the alternate
accommodation within the stipulated period as and when requested by the Developer
and the said Society.
5. This consent for vacating and shifting to alternate accommodation is given by me/us as
the member for myself/ourselves and on behalf of all my/our family members and others
occupying my/our existing premises (flat) and shall be binding on me/us and my/our
family members.
6. I/We declare that in case I/we shall decide to sell or transfer my/our shares of the
accommodation/flat in the building than in such event, I/we will give first preference to
the said Developer to purchase my/our share/flat as per mutual terms and shall obtain
written permission (approval) from the said Society after following requisite procedure for
transfer under the Maharashtra Co-op. Societies Act & Rules there under. If the said
Developer is not interested in my/our share or refuses my/our proposal, then I/we shall
sell my/our share/flat in open market. Further in such event I/we shall inform the said
Purchasers thereof about this Consent-cum-Declaration executed by me/us and shall
obtain and furnish to the said Society such Affidavit or Consent-cum-Declaration from
the said purchasers incorporating his consent to the said redevelopment on the basis of
similar terms and conditions and further facts, as per the progress of redevelopment up
to the date of such sale or transfer and also furnish such documents of transfer as may
be executed between us by the said purchaser.
7. I/We undertake to take all required action and sign and execute all relevant documents
which I/We may be required and/or called upon or directed by the Developers / Society
to take and/ or execute at the cost of the Developers to facilitate/ supplement the
process of redevelopment of the property of the Society.
8. I/We hereby declare that the aforesaid premises No._____ is not mortgage to any
bank/financial institution and is free from all encumbrances, claims and demands. I/We
hereby indemnify and shall keep indemnified the said Developers i.e. M/S.
__________________________. from against all claims, actions, demands and suits
from any person/s in respect of the said premises No._____.

9. I/We undertake not to obstruct the Redevelopment work or to do any act which will
adversely affect the same. Further, I/We hereby declare that I/We will not approach any
court of law or any other authority for stay and/or object to the work of re-development
unless violation of any terms and conditions agreed for re-development and this
irrevocable consent shall be binding on me/us and also on my/our legal heirs/executors
and successors.
10. I/We hereby undertake to abide by the decision of the said Society and I/We further
declare that I/We shall extend my/our full co-operation to the Managing Committee of the
said
Society
in
force
as
well
as
to
the
said
Developer
i.e.
M/S.
11. I/We state that the contents of the above declaration have been read over, translate and
explained to me/us in my/our vernacular language and which I/We have understood and
agreed upon in true spirit of co-operation and mutual benefit.
Whatever stated hereinabove is true and correct to the best of my/our knowledge and
belief.
