If the California legislature deems that 2 + 2 = 5 and creates a law to that effect, an ALJ will uphold that 2 + 2 = 5 law or statute
and rule against anyone challenging 2 + 2 = 5. We find that type of judicial enforcement logic to be ill conceived. The share of
cost spend down rule for IHSS recipients has not changed in 25 years and is a RIDICULOUSLY LOW 600 dollars a month.
During our hearing and in filed papers we requested Judge Dahstedt give ONE EXAMPLE of someone living in a home on 600
dollars a month since the IHSS program stands for IN HOME SUPPORTIVE SERVICES. Any monthly income over 600 dollars a
month would require the IHSS recipient to spend down to 600 dollars each month BEFORE IHSS will even pay one penny. We
gave our monthly overhead costs for reference. Judge Dahlstedt ignored our request to give us just ONE EXAMPLE of someone
living on 600 dollars a month in a home yet enforced this outdated legislative statute that has not kept up with the times nor has
changed in 25 years even though cost of living has DOUBLED in that time. If the average person would find a statute completely
outdated, outmoded, or false, or if an ALJ cannot come up with ONE example in defense of an outdated, outmoded, or false law
or statute, the law or statute should not be defended or enforced by Judge Dahlstedt or any judge. We are appealing Judge
Dahlstedt's ruling and hoping to find one ALJ to do the right thing and only enforce statutes and laws that have at the very least a
miniscule modicum of common sense and truth behind them.
