On November 10,2012, I, r icholas Clark stopped a CMV at the Northbound Weigh Station for a Safe~v lnspeot on, I
.noticed the White Freight ner Truck Tractor did not display a name or USDOT Number. I Identified the driver [of tie
CMVas Marbin Rodolfo C millo Sanchez of Charlotte North Carolina. Mr. Sanchez stated that his fri{~nd just
purchased the truck in At ~nta,GA. I asked him for a Bill of Sale or any Related paperwork and he1gave me a C ~eorgia
Certificate of Title, Insura ce,and North Carolina Temp. Registration Card. I asked him for a Bill of Sale and he
stated his friend had addi ional paperwork. Cerenio Esli Barrios-Cifuentes was traveling in anothrr vehicle b ckto
North Carolina. I asked M Sanchez to call Mr. BarrIos and have hIm come to the NBWS with the palperwork. While
he was on the phone, I ch ~cked the Dl of Mr. Sanchez and it returned as a Suspended CDl through North C rolina.
I also had GSP check the VIN Number of the CMV and It returned as Stolen from Clayton County GA. Mr. San bhez
stated he was just going b drive the CMV back from Atlanta and did not know his CDL was Suspended and 'd not
know the CMV was stolen He was then placed under arrest for Driving a CMV while CDl was Suspended an THeft
by Receiving. I then spok with Mr. Barrios on the phone and he stated he was at the Racetrac in Ulvonia G~ an~
that his vehicle was disat ed ant could not return. I then requested that the Franklin County Sheriffs Office IIould
give him a courtesy esco over 0 the NBWS with any additional paperwork. When Mr. Barrios returned he ~ as
unaware the truck was st len. Ht was asked if he had any additional information to provide, he stated he di(i not
and that a "Title" was goi 9 to be faxed to him at a later date. He said he would call the person that sold the ~MVto
have them fax any additic nallnf~rmatfon to the NBWS. Mr. Barrios stated he went to Atlanta earlier in the w~~kand

wrote a check to the "Sel ~r" for ,6,800 but could not recall the name of the person he wrote the chock to. I asked
him for a copy of the che k he s ted it was at his residence in Charlotte NC .Mr. Barrios stated he t.ook an
additional $2,000 cash to pay fO~the CMV and take possession on 1111012012. Mr. Barrios was then placed u "del'
arrest for Theft by Recei\l ng an transported to the Franklin County Sheriffs office by Deputy Beard. Officer Dean
Wood transported Mr. Sa chez
the Franklin County Sheriffs Office where he was charged with Driving a ( MV
while CDL was Suspende ~ and theft by Receiving. I then completed the inventory of the CMV and lieleased fto
Kings Wrecker Service. I eCeiV! a fax from the "Seller" consisting of a Bill of Sale and a copy of a Title. At
Approximately 1800hrs I ontac d the complainant, Johnny Davis Jr. from the Clayton County f'olice Repo
#12065113. He stated tha he dr pped the CMV off at a Mechanic Shop operated by Joe Dean in Forest Park ~Afor
repair. He stated he paid IIIr. Dean and he did not repair the CMV. He stated severa1 times he tried to retrieve the
CMV with the assistance pf CCPD. He stated that Mr. Dean illegally obtained a title of the CMV. I asl~ed Mr. Cavis to
emall aU correspondence related to the CMV. I advised him he would be contacted at a later date If the CMV would

First, thank you for hel ing mr move forward to recover my stolen 18 Wheeler Truck.
My sister, Viola Davis, instructed me to file a stolen vehicle complaint in Franklin County. It was
in Franklin County that a Magistrate Judge ordered the Georgia State Patrol to give my stolen
18 Wheeler Truck bac to the criminals. I had no clue where to go from here.
I am forwarding the re rt my sister put together to explain how my title was illegally transferred and
my property illegally s d to a third party. I want to give you a quick overview of events to include:
1. I paid my mechanic, Joe Dlean, in full to repair my 18 Wheeler Truck. (Documentation verify this fact)
2. Dean had every exc se an1tlreason for not completing the repairs.
3. I learned that Dean i legallYr transferred my title by registering my truck abandoned when I went to pay the
taxes.

4. I tried to file a polic rep0rtj; however, they said that this was a civil matter.
5. I filed with the Depa men!.I0f Revenue for a title review due to the illegal transfer by Dean.
6. I received my title b: ck af~ergoing through the full process to prove that Dean transferred the title ill aL
7. I filed a police repo in CI~ton County and attempted to file a report in Newton County - the two coun ies
these
criminals (Dean and G briel) ived/worked in.
8. I received a call fro' Geo ia State Patrol that my stolen 18 Wheeler Truck was found at a weigh stat on in
Franklin County.

the stolen 18 Wheeler ruck. We arrived at the Clayton County Police Department approximately 1730 to speak
with you on the same

We are contacting you to verify our stolen 18 Wheeler Truck was placed back on the GCIC/I\ICIC. Si ce our last
meeting and your disc ssion with the Sheriff of Franklin County, we need to make sure that our case (Case
Number 12065113) wa placed on the state computer and national computer for stolen vehiclles/truck .
We had no idea that 0 r case was removed and have realized that these actions have denied our abi ity to have
our stolen 18 Wheeler ruck retumed. We need an investigation into the reason our stolen 1:BWheel r Truck
was removed from the GCIC/NCIC. When was the case place back on the GCIC/NCIC and was the heriff of
