Be it ordained by the City of Warwick:
Section I. Chapter 2 Article I of the Code of Ordinances of the City of Warwick is hereby
amended to add the following:
Sec. 74-4. Calculation of interest on overdue tax payments.

Pursuant to Rhode Island General Laws 44-5-8 (b), commencing with fiscal year 2015 in the case
of failure of a taxpayer to pay the first installment or any succeeding installment by the last date of the
respective installment period, the tax collector shall require immediate payment of only that late
installment, and impose an interest charge only on that late installment.

Section II. This Ordinance shall take effect upon passage and publication as prescribed by law.

Be it ordained by the City of Warwick:
Section I. Chapter 6 Article IV of the Code of Ordinances of the City of Warwick is hereby
amended to add the following:
Sec. 6-72. Permits: Concealed Carry Weapons.
(a) Preamble: R.I.G.L. 11-47-11 establishes the standards for local municipalities to issue
Concealed Carry Weapons (CCW) permits; and as qualified applicants are law abiding citizens
trained and certified in the use of firearms they must be treated with dignity and respect as they
engage in the legal right to seek said permit; while the Board of Public Safety has the power to
regulate the issuance of CCW permits for the City of Warwick, it is critical to ensure procedures
and standards are not imposed in an overly broad or arbitrary manner; Warwick residents and
business owners who meet the criteria set forth by the State of RI must be ensured a timely, fair
and consistent process to apply for a CCW permit through our municipal licensing authority; in
an effort to promote transparency in government, avoid any misunderstandings, and protect
applicants right to due process, applicants who are denied a CCW permit must be notified of the
reason(s) for disapproval in a timely, written manner; and some inconsistencies in the processing
of CCW permits have provided a general impression that the City of Warwick may periodically
engage in illegal gun control practices in contradiction to R.I.G.L. 11-47-11.
(b) The Warwick Board of Public Safety shall adhere to the following procedures in considering
the application and issuance of CCW permits:
1. The Warwick Board of Public Safety (a.k.a. The Board), as the licensing authority for
the City of Warwick is charged with issuing Concealed Carry Weapons (CCW) permits.
Individuals must be twenty-one (21) years of age or older to apply for a CCW permit and
meet the following criteria:
b. Have a bona fide residence or place of business within the City of Warwick
verified by either the Warwick Board of Canvassers, Warwick Department of
Taxation or the Warwick Chief of Police, or
c. Have a bona fide residence within the United States and a license or permit to
carry a pistol or revolver concealed upon his or her person issued by the
authorities of any other state or subdivision of the United States.
2. Per R.I.G.L. 11-47-11, The Board shall issue a permit to an applicant to carry a pistol or
revolver concealed upon his/her person everywhere within this state for four (4) years
from date of issue. This permit shall not contain any restrictions, however State and

Federal law shall still apply. The permit shall be issued to the applicant if
a. It appears that the applicant has good reason to fear an injury to his or her person
or property, or
b. The applicant has any other proper reason for carrying a pistol or revolver, and
c. He or she is a suitable person to be so licensed.
3. An applicant is not required to present a purpose or need beyond what is called for in
R.I.G.L. 11-47-11. For the purpose of applications to The Board under R.I.G.L. 1147-11 Self defense shall constitute a proper reason as required by statute. No line of
questioning by The Board during the interview process will call for speculation as to how
the applicant may alter his or her actions to negate the request/use of a CCW permit.
4. The Board will review the completed application along with three letters of reference and
a Background Criminal Investigation (BCI) within 60 calendar days of receipt. Letters of
reference shall only be required for new, not renewal, permit applications. Applicants are
required to appear before The Board for a personal interview. The specific reason(s) for
denying a CCW permit must be provided in writing by registered mail within 10 business
days of conducting the interview or the permit shall be automatically issued.
5. Legitimate reasons for an applicant to be deemed unsuitable to be licensed are as follows:
a. Be ineligible to possess a firearm by virtue of having been convicted of a felony.
b. Have been committed, either voluntarily or involuntarily, for the abuse of a
controlled dangerous substance, or been found guilty of, or entered a plea of
guilty or nolo contendere to a misdemeanor under RI General laws or similar laws
of any other state relating to a controlled dangerous substance within a five-year
period immediately preceding the date on which the application is submitted, or
be presently charged under indictment or a bill of information for such an offense.
c. Found guilty of, or entered a plea of guilty or nolo contendere to operating a
vehicle while intoxicated, or has been admitted, either voluntarily or involuntarily,
for treatment as an alcoholic, within the five-year period immediately preceding
the date on which the application is submitted, or at any time after the application
has been submitted.
d. Entered a plea of guilty or nolo contendere to or been found guilty of a crime of
violence, including domestic abuse, at the misdemeanor level, unless five years
have elapsed since completion of sentence or any other conditions set by the court
have been fulfilled, or unless the conviction was set aside and the prosecution
dismissed, prior to the date on which the application is submitted.
e. Been convicted of, have entered a plea of guilty or nolo contendere to, or be
charged under indictment or a bill of information for any crime of violence or any
crime punishable by imprisonment for a term of one year or greater.
f. Is a fugitive from justice.
g. Released from active or reserve duty from the Armed Forces of the United States
with a discharge characterized as Bad Conduct Discharge, or a Dishonorable
Discharge. In the case of Commissioned Officers and Warrant Officers of the
United States Armed Forces, the punishment of Dismissal rendered subject to a
verdict of guilty at a trial by military court-martial is deemed to be
disqualifying under this paragraph. For the purposes of this Paragraph, the United

States Coast Guard is considered an Armed Force.
i. Be ineligible to possess or receive a firearm under 18 U.S.C. 922(g).
j. Had a permit revoked by The Board within four years prior to the most recent
application.
6. Notwithstanding any other chapter or section of the general laws of the state of Rhode
Island, The Board shall not provide or release to any individual, firm, association or

holds a license or permit to carry a concealed pistol or revolver. This section shall not be
construed to prohibit the release of any statistical data of a general nature relative to age,
gender and racial or ethnic background nor shall it be construed to prevent the release of
information to parties involved in any prosecution of 11-47-8 or in response to a lawful
subpoena in any criminal or civil action which the person is a party to that action.
7. Warwick ordinance 40-1(19) Disorderly Conduct is the prevailing law for those
individuals issued a CCW permit unless circumstances necessitates the gun owner to no
longer keep his or her weapon concealed.

RESOLVED THAT:
WHEREAS, Pontiac Reclamation, LP is the Owner of the a parcel of land commonly
referred to as Cranston Sanitary Landfill, and
WHEREAS, in connection with necessary work being performed on the landfill in
coordination with the Rhode Island Department of Environmental Management (RI DEM), a
stormwater collection system must be constructed, and
WHEREAS, it is necessary to cross Knight Street, a public right-of-way located within
the City of Warwick, with a stormwater drain to discharge runoff to the Pawtuxet River, and
WHEREAS, it is necessary to obtain a Physical Alteration Permit from the City of
Warwick Department of Public Works prior to performing any work within the City right-ofway, and
WHEREAS, Pontiac Reclamation, LP has requested a drainage easement from the City
of Warwick to install and maintain a stormwater system in accordance with the attached Deed
of Easement.
NOW, THEREFORE, BE IT RESOLVED, that the Warwick City Council hereby
authorizes Pontiac Reclamation, LP to install the proposed improvements across Knight Street
and further that Mayor Avedisian is hereby authorized to execute the attached Deed of Easement
and any other necessary documents on behalf of the City of Warwick to grant the easement.

WHEREAS, traffic study requests are made by members of the City Council at various
times during the year; and
WHEREAS, the Council Rule 13(a) provides that:
Resolutions relative to traffic studies and the Omnibus Resolution of
Congratulations and Condolences shall only appear for action by the City
Council on the Consent Calendar docket at the first regular business meeting
of each year. The number designations given to those Resolutions at said

A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A LEASE FOR THE


CHRISTOPHER RHODES ELEMENTARY SCHOOL BY GATEWAY TO CHANGE,
INC., d/b/a ARTISTS EXCHANGE
RESOLVED THAT:
WHEREAS, the City of Warwick (City) is the owner of the Christopher Rhodes
Elementary School, so-called, located in the Pilgrim neighborhood off Post Road (the Rhodes
School); and
WHEREAS, the Mayor executed Executive Order 2012-03 to establish a Study
Committee to consider re-use options for the Rhodes School since its return to the City by the
School Department; and
WHEREAS, the re-use study committee considered several re-use options for the Rhodes
School that best benefit the neighborhood and the City; and
WHEREAS, the study committee issued an RFP to solicit proposals for the re-use of the
Rhodes School and after careful consideration and extensive investigation of several options
unanimously recommends a lease between the City and Gateway to Change, Inc., d/b/a Artists
Exchange; and
WHEREAS, Artists Exchange envisions re-use of the Rhodes School for visual and
performing arts activities, theatrical productions, instructional classes and summer art camps, to
mention a few intended activities; and
WHEREAS, the City and Gateway to Change, Inc. wishes to execute a lease for the use
of the Rhodes School to allow for the use of the building as set forth in Artists Exchange
detailed response to RFP 2014-299; and
WHEREAS, the parties have drafted a lease which outlines the obligations and rights of
the parties; and
WHEREAS, execution of the lease is in the best interest of the taxpayers, the
neighborhood and the general public.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Warwick,
Rhode Island that:
SECTION 1. The Warwick City Council assents to the Mayor executing the lease
between the City and the Gateway for Change, Inc., d/b/a Artists Exchange for

RESOLUTION AUTHORIZING THE ISSUANCE


OF GENERAL OBLIGATION REFUNDING BONDS

WHEREAS, the City of Warwick (the "City") has previously issued its $13,500,000 General
Obligation Bonds dated June 15, 2003, its $12,500,000 General Obligation Bonds dated August 15, 2004
and its $17,500,000 General Obligation Bonds dated January 15, 2006 (collectively, the "Prior Bonds");
and
WHEREAS, the City desires to issue general obligation refunding bonds (the "Refunding
Bonds") to refund all or any part of the Prior Bonds in order to take advantage of the lower interest rates
which currently are prevailing;
WHEREAS, the City intends to issue the refunding bonds provided the present value savings is at
least equal to 3%.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Warwick, Rhode
Island that:
SECTION 1. Pursuant to Rhode Island General Laws Section 45-12-5.2 and subject to
the conditions listed herein, the City is authorized to issue Refunding Bonds of the City in an amount
necessary to refund all or a portion of the Prior Bonds and to provide for any principal of, redemption
premium, and interest on the Prior Bonds coming due on or prior to the date on which the Prior Bonds are
to be redeemed, and costs of issuance of the Refunding Bonds. Such authorization is contingent upon
satisfaction of all the conditions listed herein prior to the issuance of the Refunding Bonds confirming in
writing to the City Council:
a) The Administrations consultation with Bond Council and Financial Advisors and
recommendations from them that demonstrate conditions for issuance of these Refunding
Bonds are favorable to the Citys financial interest such as appeared in the Piper Jaffray
Analysis provided on September 29, 2014;
b) That the present value savings is at least equal to 3%;
c) That the issuance costs that will be incurred and the interest rate at which the Refunding Bonds
will be issued have been evaluated to achieve the projected cost savings;
d) That reasonable steps have been taken to reduce the possibility that further savings would not
be achieved by deferring the sale of the Refunding Bonds to a later date;
e) The procedures for issuance the Refunding Bonds;
f) The manner of evaluating the cost savings, including issuance costs and interest rates, as well
as the maturity dates, call dates and call premium on the Refunding Bonds;
g) The current value of each of the bonds to be refunded;

g) The current value of each of the bonds to be refunded;

h) That the savings will be distributed as evenly as possible over the life of the Refunding
Bonds;
i) A comparison of the prior and proposed payment schedules of each bond to be
refunded, as well as in the aggregate, showing both interest and debt service and
including dates when individual debt service payments will become due;
j) Assurances that the structure and escrow efficiency of the Refunding Bonds, including
the proposed repayment schedules will not adversely impact the Citys debt
management, and/or place undue strain on the projected annual debt service, including
current debt obligations and authorized debt not yet issued.
SECTION 2. The issuance of the Refunding Bonds will result in a financial benefit to the
City.
SECTION 3. The manner of sale, amount, denominations, maturities, conversion or
registration privileges, interest rates, medium of payment, and other terms, conditions and details of the
Refunding Bonds authorized herein may be fixed by the officers authorized to sign the Refunding Bonds.
SECTION 4. The City Council hereby authorizes the City Treasurer and the Mayor
acting on behalf of the City, to issue the Refunding Bonds for the purposes set forth in this Resolution and
to take all actions as they deem necessary to affect the issuance of the Refunding Bonds. The Refunding
Bonds shall be issued by the City under its corporate name and seal or facsimile of such seal. The
Refunding Bonds shall be signed by the manual or facsimile signature of the City Treasurer and the
Mayor.
SECTION 5. The City Treasurer and the Mayor are hereby authorized to issue the
Refunding Bonds and deliver them to the purchaser and said officers are hereby authorized and instructed
to take all actions, on behalf of the City, necessary to ensure that interest on the Refunding Bonds will be
excludable from gross income from federal income tax purposes and to refrain from all actions which
would cause interest on the Refunding Bonds to become subject to federal income taxes.
SECTION 6. The City Treasurer and the Mayor are authorized to take all actions
necessary to comply with federal tax and securities laws including Rule 15c2-12 of the Securities and
Exchange Commission (the "Rule") and to execute and deliver a Continuing Disclosure Certificate in
connection with the Refunding Bonds in the form as shall be deemed advisable by the City Treasurer and
the Mayor in order to comply with the Rule. The City hereby covenants and agrees that it will comply
with and carry out all of the provisions of the Continuing Disclosure Certificate, as it may be amended
from time to time. Notwithstanding any other provision of this Resolution or the Refunding Bonds,
failure of the City to comply with the Continuing Disclosure Certificate shall not be considered an event
of default; however, any bondholder may take such actions as may be necessary and appropriate,
including seeking mandate or specific performance by court order, to cause the City to comply with its
obligations under this Section and under the Continuing Disclosure Certificate.
SECTION 9. This Resolution shall take effect upon its passage.
