MUNICIPAL RESOLUTION NO. 082-2014

GRANTING AUTHORITY TO HONORABLE MAYOR ANN Y. ONGJOCO OF GUINOBATAN,
ALBAY TO PURCHASE 10,000 SQUARE METERS, PORTION OF LOT NO. 6084-F, FROM ITS
OWNER, MR. GERARDO FELIX C. SAMSON, LOCATED AT MAURARO, GUINOBATAN,
ALBAY TO BE UTILIZED AS SITE FOR THE PROPOSED GUINOBATAN COMMUNITY
COLLEGE.

WHEREAS,
this august body, pursuant to the Local Government Code of 1991, has for
its functions and duties, among others, to approve legislative acts which shall ensure the delivery
of basic services and facilities as specified in Section 17 thereof, more particularly the provision of
infrastructure facilities intended primarily to service the needs of the residents of the municipality,
such as that of the establishment of a community college;

WHEREAS,
the proposed Guinobatan Community College is deemed by this august
body as a project in accordance with Section 17 of the Code considering that it shall serve as an
educational institution to cater the need for tertiary college education of the residents of the
municipality;
WHEREAS,
this august body shall further exercise acts which are not only necessary,
but as well as those implied and incidental therefrom for the effective and efficient delivery thereof,
such as that of acts necessary for the acquisition of a lot where the proposed community college
shall be established/constructed;
WHEREAS,
Mr. Gerardo Felix S. Samson, is the owner of a lot covered by TCT No. C26204 (pursuant to CLOA No. 00537940 issued by the DAR), situated in Barangay Mauraro, this
municipality, and particularly described as follows:

A PARCEL OF LAND (Lot No. 6084-F of Psd-05-026637, Cad 201,

Guinobatan Cadastre), situated in Barangay Mauraro, Guinobatan, Albay,
Philippines. Bounded on the NE., by Lots 6084-D, 6084-E, & 6461; on the SE., by
Lot 6461; on the SW., by Road; on the W., by Lots 6084-A & 6084-C; and on the
NW., by Road, Cad 201, Guinobatan Cadastre x x x x x containing an area of
TWENTY-TWO THOUSAND THREE HUNDRED SEVENTY-FOUR (22,374)
square meters.
WHEREAS,
negotiations for the acquisition of a portion of the above-described lot had
been conducted pursuant to Municipal Resolution No. 052-2014 and the same was aptly found to
be a location most suitable for the intended purpose. Hence, the acquisition/purchase of a portion
of the same, or an area of TEN THOUSAND (10,000) SQUARE METERS or ONE (1) HECTARE,
in accordance with existing laws, rules and regulations, by this Local Government through the
Honorable Mayor, is aptly supported by this august body and is thus hereby authorized;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay
in session assembled, to grant as it hereby grants authority to Honorable Mayor Ann Y. Ongjoco of
Guinobatan, Albay to purchase 10,000 square meters, portion of Lot No. 6084-F, from its owner,
Mr. Gerardo Felix C. Samson, located at Mauraro, Guinobatan, Albay to be utilized as site for the
proposed Guinobatan Community College.
RESOLVED FURTHER, that this authority granted to the Honorable Mayor shall be further
governed by the Contract to Sell (Annex A) entered into by and between the owner and the
Municipal Government of Guinobatan dated June 2, 2014, duly notarized by Atty. Mart R. Rabelas
under Doc. No. 248, Page No. 51, Book No. XXVIII, S. 2014.
APPROVED UNANIMOUSLY on motion of Honorable Councilor Frances John M. Oxales,
and duly seconded by the members present this 30 th day of June, 2014 during their 23 rd Regular
Session.
