LetsTalkTitles:HowtoApplyforaRegisteredTitle

IfyouownlandanddonothaveaRegisteredTitleyoucanmakeanapplicationtotheRegistrarofTitles
tohavethelandregistered.

Toapplytoregisteryourlandthefollowingdocumentsmustbesubmitted:

1. AnapplicationformprescribedbytheRegistrationofTitlesActandsignedbytheapplicant.
2. AStatutoryDeclarationbytheapplicanttoprovepossession(astatutorydeclarationisawritten
statementconfirmedbyoath).
3. Supportingstatutorydeclarationstoproveownershipfromtwopersonswhohaveknowntheland
foratleast30yearsandincaseswheretheapplicanthasnodocumentaryproofofownership,
showingtitleforhimselfandpredecessorsintitlefor40years.
4. AuptodatecertificateofpaymentofPropertyTax.
5. Surveyprecheckeddiagram(ifthelandisbeingregisteredbyplan).
6. Anyotherdocumentyoumayhavethatprovesownershipe.g.Receipt,Conveyance,Probate,
CertificateofComplianceundertheFacilitiesforTitlesAct.
7. ApplicationsotherwisethanbyPlanmustdescribethelandsoastoenableidentificationofthe
locationoftheparcelonthegroundbyreferencetoalandmarkandmuststatethenamesby
whichthepropertyisknown.Thedescriptionmuststatethedistancesalongeachboundaryand
thecompassdirectionofeachboundaryline,thenamesoftheabuttingproperties,thenamesof
adjoiningowners,andwheretheabuttinglandisregisteredland,thetitlereferenceforthe
property.
Theremaybeotherdocumentsrequireddependingonthefactsofeachcase.Personswhowishtoregister
landshouldthereforeseektheassistanceofalawyer.
RegistrationfeesarepaidwhenyousubmityourdocumentstotheassessorattheTitlesOffice.Youwill
beissuedadatedofficialreceiptwithanumberstampedonit,andthenameofthepersonwholodged
theapplication.Thenumberprintedonthereceiptisyourapplicationnumberandmustbequotedwhen
makingenquiriesaboutyourapplication.Youmustkeepyourreceiptuntilyourapplicationissuccessfully
completed.

StampDutyandTransferTaxarepayabletotheTaxpayerAuditandAssessmentDepartmentunless
fallingintoanycategoryofexemption.

Yourapplicationwillgothroughaseriesofprocessesasprescribedbylaw:

Thedocumentswillbechecked.
ThesurveydiagramwillbesenttotheSurveydepartmenttobecheckedtoensurethatthelandis
notyetregisteredandtheplanisacceptable.
ThereafterallthedocumentswillbesubmittedtotheRefereeofTitlesforconsideration.
WhenyourapplicationisapprovedbytheRefereeyouwillbesentaNotice,whichyouwillbedirectedto
havepublishedinaparticularnewspaperforaperioddecidedbytheRefereeofTitles.
YourCertificateofTitlewillbeissuedsevenweeksafterthefirstappearanceoftheadvertisementinthe
newspaper,ifnoCaveatislodgedagainsttheapplicationandnoCourtactioncommenced.

PreparationofyourCertificateofTitlewillbeginafteryoutakeinproofofadvertisement,i.e.the
newspaperpageswiththeadvertisementspertainingtoyourapplicationandpaymentofthefinalfees.

CAVEATSAGAINSTREGISTERINGLAND

Landsbeingregisteredareadvertisedinthedailynewspapersweekly.Ifsomeonehasappliedtoregister
landthatyouhaveanestateorinterestin,withoutyourconsent,youmaylodgeaCaveatagainstbringing
thelandundertheRegistrationofTitlesAct.TheCaveatmustbelodgedwithinthetimeprescribedbythe
RefereeofTitlesintheadvertisement.

FormsofCaveatsareavailableattheOfficeofTitles.YoumustconsultanAttorneyatlawtocommence

anactioninCourtinrespectoftheinterestclaimedintheCaveat.CopiesofthedocumentsfiledinCourt
mustbesubmittedtotheRegistrarofTitleswithinonemonthofthelodgingoftheCaveat.

FailuretonotifytheRegistrarofTitlesoftheCourtproceedingswillresultintheCaveatlapsingaftera
monthandtheregistrationbeingproceededwith.
