PRELIMINARY STATEMENT
This is an action for infringement of Plaintiffs United States Design Patents Nos.
D478,251 (the "'251 Patent") and D487,378 (the "'378 Patent") (collectively, the '251 and '378
Patents shall be referred to as the "Patents", copies attached hereto as Exhibits 1 and 2,
respectively) under the Patent Act, 35 U.S .C. 271, et seq., based on Defendant's unauthorized
commercial manufacture, use, importation, offer for sale, and sale of cups and saucers described
as "Melange La Jolla Caffe Espresso Cup, Service for 4", "Melange La Jolla Cafe Service for 2
Mugs and Saucers" and "Melange La Jolla Caffe Mug, Set of 2" (collectively the "Infringing
Products", color copies of which are attached hereto as Exhibits 3, 4, and 5, respectively) on its

JURISDICTION

This Court has original jurisdiction over the subject matter ofVilleroy & Boch's
claims of patent infringement pursuant to 28 U.S.C. 1331 and 1338(a).

Personal jurisdiction over Am.azon.com, Inc. ("Amazon") is proper in this District
because of its presence in New York County, because it has availed itself of the rights and
benefits of the laws ofNew York State, because it has derived substantial revenue from the sales
of merchandise- including sales of the Infringing Products- in New York State, because it has
systematic and continuous business contacts with New York State and because it has sold the
Infringing Products in New York State giving rise, in part, to the injuries complained of herein.
VENUE

Venue is proper in this district under 28 U.S.C. 1391(b) and 1400(b) because
Defendant has committed acts of infringement in this district and has a regular and established
place of business in this district.
THE PARTIES

Plaintiff Villeroy & Boch is an aktiengesellschaft organized under the laws of the
Federal Republic of Germany with its principal place of business in Mettlach, Germany.
Villeroy & Boch has established a world-wide reputation for the creation, innovation, and style
of its dishware designs, and for the quality of its products. Villeroy & Boch is the duly recorded
owner of the Patents.

Defendant Amazon is a corporation organized under the laws of the State of
Delaware with its principal place of business at 410 Terry Ave., North Seattle, WA 98109. It
may be served with process through its Delaware Registered Agent: Corporation Service

Company, 2711 Centerville Rd., Suite 400, Wilmington, DE 19808. Amazon also has offices
located, in this judicial district, at 1350 Avenue of the Americas, New York, New York.
FACTS

In the fall of2002, Helmut Frank created the design of a cup depicted in the '251
Patent (the "Cup Design"), a copy of which is attached hereto as Exhibit 1.

On or about October 31, 2002, Villeroy & Boch, as assignee, applied for a design
patent for the Cup Design. On August 12, 2003, the United States Patent Office issued the '251
Patent based on the Villeroy & Boch application.

In the fall of 2002, Helmut Frank created the design of a saucer depicted in the
'378 Patent (the "Saucer Design"), a copy of which is attached hereto as Exhibit 2.

On or about June 5, 2003, Villeroy & Boch, as assignee, applied for a design
patent for the Saucer Design. On March 9, 2004, the United States Patent Office granted the
'3 78 Patent based on the Villeroy & Boch application.

Villeroy & Boch's products, including cups and saucers embodying the designs
depicted in the Patents, are sold throughout the world and throughout the United States both in
retail locations and online, including on www.amazon.com.

Villeroy & Boch first sold cups and saucers embodying the designs depicted in
the Patents (the "New Wave Cup & Saucer") in or about 2003, as an addition to its "New Wave"
collection of tableware that it launched in 2002. Attached hereto as Exhibit 6 are color
photographs of examples of the New Wave Cup & Saucer.

Villeroy & Boch sells and offers to sell the New Wave Cup & Saucer throughout
the United States and has done so continuously since 2003.

Amazon offers to sell and sells the Infringing Products, which embody the
ornamental design of the Patents, on its website www.amazon.com and, on information and
belief, ships the Infringing Products to customers in the United States.

Amazon also offers for sale and sells the New Wave Cup & Saucer on its website
www.amazon.com.
16.
Amazon offers the Infringing Products for sale on its website by, inter alia,
displaying images of them alongside images of the New Wave Cup & Saucer.

By letter dated September 22, 2014, Villeroy & Boch expressly notified Amazon
of the Patents. A copy of the September 22, 2014 letter is attached hereto as Exhibit 7 (the
"Cease & Desist Letter").

The Cease & Desist Letter contained, among other things, a demand that Amazon
immediately: ( 1) cease and desist any and all importation, direct or indirect manufacture
(domestic and/or foreign), offering for sale, sale, distribution, advertising, promotion and display
anywhere in the United States of the Infringing Products; (2) remove all online images and
references to the Infringing Products; (3) cancel and refrain from making or accepting any new
order of the Infringing Products; and (4) confirm the foregoing by returning "in
Acknowledgement and Agreement" a signed copy of the Cease & Desist letter by no later than
October 7, 2014.

Amazon did not respond to the Cease & Desist Letter and continued to advertise
and sell the Infringing Products on www.amazon.com after October 7, 2014.

Further efforts by Villeroy & Boch after October 7, 2014 to obtain a response
from Amazon to the Cease & Desist Letter, including the sending of a copy of the Cease and

Desist letter to Amazon's legal department on October 24, 2014, were unsuccessful. A copy of
the letter to Amazon's legal department is attached hereto as Exhibit 8.

On or about November 14,2014, Villeroy & Boch again reported Amazon's
infringement of the Patents, by copying and pasting the text of the Cease & Desist letter on
Amazon's "Report Infringement" website.

Amazon did not respond to Villeroy & Boch' s infringement notice which it had
submitted on Amazon's "Report Infringement" website.

Amazon offered for sale and, on information and belief, sold the Infringing
Products in the City, State and County ofNew York subsequent to Amazon's receipt of the
Cease & Desist Letter, and Amazon continues to offer for sale and, on information and belief,
sell the Infringing Products within this judicial district and throughout the United States.
CAUSES OF ACTION
COUNT ONE: INFRINGEMENT OF U.S. PATENTS NO. D478,251 AND 0487,378

Villeroy & Boch hereby incorporates the above allegations of Paragraphs 1 to 23
as if stated fully herein.

Amazon has been and is infringing the '251 and '378 Patents by making, using,
selling, or offering for sale in the United States, or importing into the United States, including
within this judicial district, the Infringing Products, in violation of 35 U.S.C. 271(a).
26.
Upon information and belief, Amazon has been and is inducing infringement of
the 251 and '378 Patents by actively and knowingly inducing others to make, use, sell, offer for
sale, or import the Infringing Products which embody the designs protected by the '251 and '378
Patents, in violation of35 U.S.C. 271(b).

Amazon's infringement has been, and continues to be, knowing, intentional, and

Amazon's acts of infringement ofthe '251 and '378 Patents have caused and will

continue to cause Villeroy & Boch damages for which Villeroy & Boch is entitled to
compensation pursuant to 35 U.S.C. 284.

Amazon's acts of infringement ofthe '251 and '378 Patents have caused and will
continue to cause Villeroy & Boch immediate and irreparable harm unless such infringing
activities are enjoined by this Court pursuant to 35 U.S.C. 283. Villeroy & Boch has no
adequate remedy at law.
30.
This case is exceptional and, therefore, Villeroy & Boch is entitled to an award of
attorneys' fees pursuant to 35 U.S.C. 285.

31.
Villeroy & Boch hereby demands a trial by jury.
WHEREFORE, Villeroy & Boch requests judgment against Amazon as follows:
A.
Adjudging that Amazon has infringed the '251 Patent, in violation of35
U.S.C. 271(a) & (b);
B.
Adjudging that Amazon has infringed the '378 Patent, in violation of 35

U.S.C. 271(a) & (b);
C.
Granting an injunction preliminarily and permanently enjoining Amazon,

its employees, agents, officers, directors, attorneys, successors, affiliates,
subsidiaries and assigns, and all of those in active concert and
participation with any of the foregoing persons or entities from infringing,

contributing to the infringement of, or inducing infringement of the '251
and the '378 Patents pursuant to 35 U.S.C. 283;
D.
Ordering Amazon to account and pay damages adequate to compensate

Villeroy & Boch for Amazon's infringement of the '251 and the '378
Patents, with pre-judgment and post-judgment interest and costs, pursuant
to 35 U.S.C. 284;
E.
Ordering that the damages award be increased up to three times the actual
amount assessed, pursuant to 35 U.S.C. 284;
F.
Declaring this case exceptional and awarding Villeroy & Boch its
reasonable attorneys' fees, pursuant to 35 U.S.C. 285; and
G.
Awarding such other and further relief as this Court deems just and
proper.

Villeroy & Boch has established a world-wide reputation for the creation, innovation,
and style of its dishware designs, and for the quality of its products.
Our client has become aware that Amazon.com, Inc., ("Amazon" or "you," or
"your company"), is offering for sale and selling cups and saucers (without marking as to
their country of origin) on its website www.amazon.com at:
http://www.amazon.com/s/ref=nb sb noss 1?url=search-alias%3Dkitchen&fteldkeywords=melange+la+jolla&rh=i%3Akitchen%2Ck%3Amelange+la+joll~
("the Infringing Products") (see enclosed color copies), which are clear and direct
infringements ofVilleroy & Boch's design patent No. 0478,251 (copy enclosed) for
Villeroy & Boch's New Wave/Hot Wave cup and design patent No. 0487,378 (copy
enclosed) for Villeroy & Boch's New Wave/Hot Wave saucer. (See enclosed side by side
image of Infringing Products and Villeroy & Boch's New Wave.)
Villeroy & Boch hereby demands that you (I) immediately cease and desist any
and all importation, direct or indirect manufacture (domestic and/or foreign), offering for
sale, sale, distribution, advertising, promotion and display anywhere in the United States,
of the Infringing Products; (2) immediately take down all images of and references to the
Infringing Products online; (3) immediately cancel and refrain from making or accepting
any new order of the Infringing Products; and (4) confirm the above by returning "in

manufacturer(s), importer and distributor of the Infringing Products;
B.
An accounting of your inventory of the Infringing Products, broken down

by style, size, and location where sold and/or maintained; and,
C.
Your agreement to destroy all Infringing Products in your possession,

custody or controL
Further action will not be taken against you if you comply in full with the
foregoing demands.
Villeroy & Boch has been issued design patents for other dinnerware products in
the New Wave/Hot Wave Collection. This letter shall also serve as actual and additional
notice to Amazon of Villeroy & Boch's U.S. patent Nos. 0472,429, 0472,430 and
0475,245 (copies enclosed); we are investigating whether any other products sold by
your company infringe these patents.
Please be further advised that this letter is not intended to provide a complete list
of Villeroy & Boch's rights or remedies, or a complete list of your infringements.
Moreover, this letter is explicitly provided without prejudice or waiver of any of
Villeroy & Boch's rights and remedies against you, including
right to seek a
preliminary injunction, damages and attorney's fees.

"your company"), is offering for sale and selling cups and saucers (without marking as to
their country of origin) on its website www.amazon.com at:

image of Infringing Products and Villeroy & Boch's New Wave.)
Vi1leroy & Boch hereby demands that you (1) immediately cease and desist any
and all importation, direct or indirect manufacture (domestic and/or foreign), offering for
sale, sale, distribution, advertising, promotion and display anywhere in the United States,
of the Infringing Products; (2) immediately take down al1 images of and references to the
Infringing Products online; (3) immediately cancel and refrain from making or accepting
any new order of the Infringing Products; and (4) confirm the above by returning ''in

your company infringe these patents.

Defendant Amazon is a corporation organized under the laws of the State of

Patent (the "Cup Design"), a copy of which is attached hereto as Exhibit 1.
