This permit is issued under the provisions of Chapter 403, Florida Statutes (F.S.) and applicable rules of the
Florida Administrative Code (F.A.C.), and constitutes authorization to discharge to waters of the state under the
National Pollutant Discharge Elimination System (NPDES). The above named permittee is hereby authorized to
operate the facilities shown on the application and other documents attached hereto or on file with the
Department and made a part hereof and specifically described as follows:
WASTEWATER TREATMENT:
This permit authorizes the operation of a 23-MGD annual average wastewater treatment facility providing
primary clarification followed by secondary treatment consisting of 900 plus acres of facultative and aerobic
lagoons. Wastewater treatment solids from the primary clarifier are pumped to sludge lagoons for draining and
air drying. The on-site solid waste disposal area is authorized to receive the wastewater treatment solids.
Treated effluent is discharged to the Lower St. Johns River through a force main pipeline with high purity oxygen
to Outfall D-003. The permittee operates a fully integrated pulp and paper mill producing both bleached and
unbleached pulp and paper utilizing the Kraft process. Products include Kraft paper and finished tissue products.
In connection with the facility, Permittee operates and maintains the on-site solid waste disposal facility which
receives clean construction debris, calcium carbonate, boiler ash, and other solids generated as by-products from
the pulping and papermaking operation. Permittee also operates and maintains the surface water management
system including in-line retention basins 1, 4, 5 and wet detention basin 2 to receive and treat storm water runoff
from the solid waste disposal area.

Surface Water Discharge:


The discharge to the St. Johns River consists of a pump station force main pipeline and required
appurtenances for the conveyance of the effluent from the treatment lagoons to the St. Johns River (Class III
Fresh waters WBID 2213L) through Outfall D-003 via a 36 inch diameter pipeline and 1043 foot long
diffuser. High purity oxygen is added to the pump station to ensure the discharge meets the applicable water
quality the discharge. The point of discharge is located approximately at latitude 29 41' 13" N, longitude 81
38' 24" W.
Other Wastewater and Sludge Management Facilities:
An existing 900+-acre wastewater treatment facility (R-001) consisting of four ponds including aeration
and/or stabilization treatment (oxidation) ponds, and one 26-acre emergency settling basin (ESB). The center
of R-001 is located approximately at latitude 29 41' 81" N, longitude 81 42' 75" W.
An existing 129-acre sludge facility (R-002) consisting of two sludge ponds and one emergency spill pond
(ESP). The center of R-002 is located approximately at latitude 29 41'18" N, longitude 81 40' 27" W.
Internal Outfalls:
This permit authorizes the permittee to discharge process wastewater from an existing internal outfall I-004
to the wastewater treatment facility (R-001). The internal outfall I-004 consists of the wastewater from the
bleach plant in accordance with 40 CFR Part 430 (also known as the Cluster Rule).
IN ACCORDANCE WITH: The limitations, monitoring requirements and other conditions as set forth in Part I
through Part VIII on pages 3 through 35 of this permit.

Effluent Limitations and Monitoring Requirements

A. Surface Water Discharges


1.

During the period beginning on the issuance date and lasting through the expiration date of this permit, the permittee is authorized to discharge process wastewater,
sanitary wastewater and stormwater from Outfall D-003 subject to the following effluent limitations and monitoring requirements. Such discharge shall be limited and
monitored by the permittee as specified below and reported in accordance with condition I.E.3:

The discharge shall not contain components that settle to form putrescent deposits or float as debris, scum, oil, or other
matter. [Rule 62-302.500(1)(a), F.A.C.]

4.

If the concentration of 2,3,7,8-TCDD is determined to be less than the minimum level of 10 pg/l for method 1613B at the
point of discharge, then compliance with the limitation in this permit is demonstrated. If the concentration is less than the
detection limit, then the Discharge Monitoring Report (DMR) will reflect Below Detection Limit (BDL) for the
concentration value at SWA-1. The quarterly and annual total mass loading shall be calculated using the formula below.
Values that are below detection levels shall be incorporated in the calculation by using the standard (0.007 pg/L).

The annual mass load is computed using the rolling twelve (12) month period. The calculation shall be the sum of the
four (4) most recent quarterly mass loading of 2,3,7,8-tetrachlorodibenzo-p-dioxin starting from the second month
following permit issuance month.

Effluent samples for pH and temperature shall be monitored at the same time and location as the total ammonia grab
sample which is used to calculate the un-ionized ammonia value. Un-Ionized ammonia shall be calculated using the DEP
Standard Operating Procedure for "Calculation of Un-Ionized Ammonia in Fresh Water" dated February 12, 2001.

The annual mass load is computed using a rolling twelve (12) month period. The calculation shall be the sum of the
twelve most recent monthly mass loading of total nitrogen or total phosphorus starting from the second month following
permit issuance month. The monthly mass loading shall be calculated as follows:

The permittee shall comply with the following requirements to evaluate whole effluent toxicity of the discharge from
outfall D-003.
a.

Effluent Limitation
(1) In any routine or additional follow-up test for chronic whole effluent toxicity, the 25 percent inhibition
concentration (IC25) shall not be less than 11.7% effluent. [Rules 62-302.530(61) and 62-4.241(2)(b), F.A.C.]
(2) For acute whole effluent toxicity, the 96-hour LC50 shall not be less than 100% effluent in any test. [Rules 62302.500(1)(a)4 and 62-4.241(2)(a), F.A.C.]

b.

Monitoring Frequency
(1) Routine toxicity tests shall be conducted quarterly, the first starting within 60 days of the issuance date of this
permit and lasting for the duration of this permit.

c.

Sampling Requirements
(1) For each routine test or additional follow-up test conducted, a total of three 24-hr flow proportion composite
samples of final effluent shall be collected and used in accordance with the sampling protocol discussed in EPA821-R-02-013, Section 8.
(2) The first sample shall be used to initiate the test. The remaining two samples shall be collected according to the
protocol and used as renewal solutions on Day 3 (48 hours) and Day 5 (96 hours) of the test.
(3) Samples for routine and additional follow-up tests shall not be collected on the same day.

d.

Test Requirements
(1) Routine Tests: All routine tests shall be conducted using a control (0% effluent) and a minimum of five test
dilutions: 100%, 55.9%, 11.7%, 5.7%, and 2.8% final effluent.
(2) The permittee shall conduct a daphnid, Ceriodaphnia dubia, Survival and Reproduction Test and a fathead
minnow, Pimephales promelas, Larval Survival and Growth Test, concurrently.
(3) All test species, procedures and quality assurance criteria used shall be in accordance with Short-term Methods
for Estimating the Chronic Toxicity of Effluents and Receiving Waters to Freshwater Organisms, 4th Edition,
EPA-821-R-02-013. Any deviation of the bioassay procedures outlined herein shall be submitted in writing to
the Department for review and approval prior to use. In the event the above method is revised by DEP rules, the
permittee shall conduct chronic toxicity testing in accordance with the revised method.
(4) The control water and dilution water shall be moderately hard water as described in EPA-821-R-02-013, Section
7.2.3.

e.

Quality Assurance Requirements


(1) A Standard Reference Toxicant (SRT) Quality Assurance (QA) chronic toxicity test shall be conducted with
each species used in the required toxicity tests either concurrently or initiated no more than 30 days before the
date of each routine or additional follow-up test conducted. Additionally, the SRT test must be conducted
concurrently if the test organisms are obtained from outside the test laboratory unless the test organism supplier
provides control chart data from at least the last five monthly chronic toxicity tests using the same reference
toxicant and test conditions. If the organism supplier provides the required SRT data, the organism supplier's
SRT data and the test laboratory's monthly SRT-QA data shall be included in the reports for each companion
routine or additional follow-up test required.
(2) If the mortality in the control exceeds 20% for either species in any test, or any other test acceptability criteria
are not met, the test for that species (including the control) shall be invalidated and the test repeated. Test
acceptability criteria for each species are defined in EPA-821-R-02-013, Section 13.12 (Ceriodaphnia dubia)
and Section 11.11 (Pimephales promelas). The repeat test shall begin within 21 days after the last day of the
invalid test.

(3) If 100% mortality occurs in all effluent concentrations for either species prior to the end of any test and the
control mortality is less than 20% at that time, the test (including the control) for that species shall be terminated
with the conclusion that the test fails and constitutes non-compliance.
(4) Routine and additional follow-up tests shall be evaluated for acceptability based on the observed dose-response
relationship as required by EPA-821-R-02-013, Section 10.2.6., and the evaluation shall be included with the
bioassay laboratory reports.
f.

Reporting Requirements
(1) Results from all required tests shall be reported on the Discharge Monitoring Report (DMR) as the calculated
IC25 for each test species.
(2) A bioassay laboratory report for each routine test shall be prepared according to EPA-821-R-02-013, Section
10, Report Preparation and Test Review, and mailed or e-mailed to the Department at the address below within
30 days after the last day of the test.
(3) For additional follow-up tests, a single bioassay laboratory report shall be prepared according to EPA-821-R-02013, Section 10, and mailed or e-mailed within 30 days after the last day of the second valid additional followup test.
(4) Data for invalid tests shall be included in the bioassay laboratory report for the repeat test.
(5) The same bioassay data shall not be reported as the results of more than one test.
(6) All bioassay laboratory reports shall be mailed or e-mailed within 30 days to Jacksonville:

g.

Test Failures
(1) A test fails when the test results do not meet the limits in 7.a..
(2) Additional Follow-up Tests:
(a) If a routine test does not meet the chronic toxicity limitation in 7.a.(1) above, the permittee shall notify the
Department at the address above within 21 days after the last day of the failed routine test and conduct two
additional follow-up tests on each species that failed the test in accordance with 7.d.
(b) The first test shall be initiated within 28 days after the last day of the failed routine test. The remaining
additional follow-up tests shall be conducted weekly thereafter until a total of two valid additional followup tests are completed.
(c) The additional follow-up tests shall be conducted using a control (0% effluent) and a minimum of five
dilutions: 100%, 55.9%, 11.7%, 5.7%, and 2.8% effluent. The permittee may modify the dilution series
in the additional follow-up tests to more accurately bracket the toxicity such that at least two dilutions above
and two dilutions below the target concentration and a control (0% effluent) are run. All test results shall be
analyzed according to the procedures in EPA-821-R-02-013.
(3) In the event of three valid test failures (whether routine or additional follow-up tests) within a 12-month period,
the permittee shall notify the Department within 21 days after the last day of the third test failure.
(a) The permittee shall submit a plan for correction of the effluent toxicity within 60 days after the last day of
the third test failure.
(b) The Department shall review and approve the plan before initiation.
(c) The plan shall be initiated within 30 days following the Department's written approval of the plan.
(d) Progress reports shall be submitted quarterly to the Department at the address above.
(e) During the implementation of the plan, the permittee shall conduct quarterly routine whole effluent toxicity
tests in accordance with 7.d. Additional follow-up tests are not required while the plan is in progress.
Following completion or termination of the plan, the frequency of monitoring for routine and additional
follow-up tests shall return to the schedule established in 7.b.(1). If a routine test is invalid according to the
acceptance criteria in EPA-821-R-02-013, a repeat test shall be initiated within 21 days after the last day of
the invalid routine test.
(f) Upon completion of four consecutive quarterly valid routine tests that demonstrate compliance with the
effluent limitation in 7.a. above, the permittee may submit a written request to the Department to terminate
the plan. The plan shall be terminated upon written verification by the Department that the facility has
passed at least four consecutive quarterly valid routine whole effluent toxicity tests.

(g) If a test within the sequence of the four is deemed invalid, but is replaced by a repeat valid test initiated
within 21 days after the last day of the invalid test, the invalid test will not be counted against the
requirement for four consecutive quarterly valid routine tests for the purpose of terminating the plan.
(4) If chronic toxicity test results indicate greater than 50% mortality within 96 hours in an effluent concentration
equal to or less than the effluent concentration specified as the acute toxicity limit in 7.(a)(2), The Permittee
shall begin acute definitive whole effluent toxicity testing within 21 days and shall notify the Department within
24 hours of the Permittee becoming aware of the test results. The Department may revise this permit to require
acute definitive whole effluent toxicity testing as well as initiating a study to determine the cause of mortality.
(5) The additional follow-up testing and the plan do not preclude the Department taking enforcement action for
acute or chronic whole effluent toxicity failures.

The effluent limitations specified in I.A.1. above, for the parameters listed below ensure compliance with the applicable
water quality criteria at the boundary of the mixing zone. For the parameters below, the Permittees discharge shall not
cause or contribute to an exceedance of the Chapter 62-302.530, F.A.C., Class III fresh water quality criteria outside the
described mixing zones. The length of the mixing zones is centered along either side and ends of the 1,043 foot diffuser
structure. The aerial extent of the mixing zones is also specified based on rise of plume with the exception of color:

**In accordance with Rule 62-4.244(1)(f), F.A.C. ,the mixing zone for color is 367 meters upstream and
downstream of the center of the 1,043-ft diffuser for a total of 734 meters.

If the BOD or TSS for any single sample is within 10% of the monthly average limit, the frequency of sampling shall
return to 3 days per week starting the week following the laboratory analysis report is made available to the mill and
lasting until the single sample BOD or TSS for 3 consecutive samples is below 50% of the monthly average limit.

10. If the Dissolved Oxygen (DO) level falls below 5.0 ppm, the permittee shall elevate the DO to 5 ppm or higher within 8
hours. The permittee shall also maintain this standard a minimum of 95% of the time and shall at no time allow the DO
to be below 2.7 ppm. The permittee may also submit to the Department, for review and approval, an alternate location
for monitoring DO provided the data shows that 5.0 mg/L will be maintained at the end of the pipeline.

A combination of sample taken just after the discharge from the chlorine dioxide
filtrate tank and a sample taken just after the extraction filtrate tank. These two
samples are combined in flow proportionate sets.

The permittee may use a chloroform process certification as allowed by 40 CFR 430.02(f) in lieu of chloroform
monitoring, once the necessary data is submitted and approved by the Department.

For 2,3,7,8,-TCDD, 2,3,7,8-TCDF, and the chlorinated phenolic compounds, at the bleach line, the mill should
collect grab composite samples from both the acid sewer and alkaline sewers. Each composite should be
collected every one to three hours during the operation of the bleach plant, for 24 hours, from the monitoring
location (at the identified tap, valve, or sump) specified in the permit. The mill may use a continuous automated
sampling device, if it can be operated reliably at the appropriate monitoring location. The mill may prepare one
flow proportioned composite of the acid and alkaline sewer samples (i.e., one bleach plant effluent sample).
Sampling procedure dated March 20,2003 was approved by DEP on August 30, 2004.
For chloroform, the mill should collect separate samples of acid and alkaline bleach plant filtrates. This is to
prevent the loss of chloroform through air stripping as the samples are collected, measured, and composited, or
through reaction when the acid and alkaline samples at the point closest to the bleach plant that is, or can be
made, physically accessible. Also, samples to be analyzed for chloroform should be collected every one to four
hours during the operation of the bleach plant, for 24 hours. The mill should not collect samples using a
continuous automated sampling device because chloroform is volatile. Sampling procedure dated March
20,2003 was approved by DEP on August 30, 2004. In addition, the following special sampling procedures
should be included in the permit:

C. Other Wastewater Management Facility


1.

During the period beginning on the issuance date and lasting through the expiration date of this permit, the permittee
is authorized to transfer process wastewater to the Emergency Settling Basin (ESB). The ESB is located after the
primary clarifier and supernatant from this area will enter pond 1. The use of this basin is not intended for regular use
but only during upset/emergency conditions.

2.

During the period beginning on the issuance date and lasting through the expiration date of this permit, the permittee
is authorized to transfer wastewater sludge to the Emergency Settling Pond (ESP) or sludge ponds. The ESP accepts
wastewater that is diverted from the primary clarifier and discharges back into the primary clarifier at a controlled
rate. The Sludge Ponds typically accept solids from the primary clarifier. Any supernatant from this operation
discharges back to the primary clarifier.

D. Other Methods of Disposal or Recycling


1.

There shall be no discharge of industrial wastewater from this facility to groundwaters or surface waters, except as
authorized by this permit.

E. Other Limitations and Monitoring and Reporting Requirements


1.

The sample collection, analytical test methods and method detection limits (MDLs) applicable to this permit shall be in
accordance with Rule 62-4.246, Chapters 62-160 and 62-601, F.A.C., and 40 CFR 136, as appropriate. The list of
Department established analytical methods, and corresponding MDLs (method detection limits) and PQLs (practical
quantification limits), which is titled Florida Department of Environmental Protection Table as Required By Rule 624.246(4)

stated in Chapter 62-302, F.A.C.; and

c.

If the MDLs for all methods available in the approved list are above the stated permit limit or applicable water
quality criteria for that parameter, then the method with the lowest stated MDL shall be used.
The permittee shall always report the laboratory MDL and/or PQL values for the analyses that were performed.
Where necessary, the permittee may request approval of alternate methods or for alternative MDLs or PQLs for
any approved analytical method. Approval of alternate laboratory MDLs and PQLs are not necessary if the
laboratory reported MDLs and PQLs are less than or equal to the permit limit or the applicable water quality
criteria, if any, stated in Chapter 62-302, F.A.C. Approval of an analytical method not included in the abovereferenced list is not necessary if the analytical method is in accordance with 40 CFR 136.

2.

Parameters which must be monitored as a result of a surface water discharge shall be analyzed using a sufficiently
sensitive method to assure compliance with applicable water quality standards and effluent limitations in accordance
with 40 CFR Part 136. All monitoring shall be representative of the monitored activity.

10. Wastewater Treatment Plant Modification/Legacy Solids Isolation:


On September 1, 2009, the Permittee submitted a Legacy Solids Report that did indicate TCDD was
present in the pond system. The majority of the TCDD in the settled solids was present in Pond 1.
Therefore, the Permittee has chosen to segregate legacy solids from Pond 1 by modifying the wastewater
treatment ponds such that the majority of the legacy solids will be isolated from the primary treatment
facilities. The modification would isolate approximately 75 percent of existing Pond 1 from active flowthrough service. The Permittee may decide in the future to remove deposited solids from the isolated
areas of Pond 1 in order to allow that portion of the pond to be put back into flow-through service. The
following conditions have been added in order to accurately review
a. Within xx days of permit issuance, the permittee shall submit for the Departments review and
approval the design for the new overflow structure to route wastewater from Pond 1 to Pond 2 and the
design for the berm structure that will isolate the northern portion of Pond 1 from flow-through service as
indicated in Figure 1 below. Along with the design, the permittee shall also submit a structural
assessment of the existing berm that will attach to the new berm structure. The assessment shall include
an analysis of the current berm structure and any changes necessary to provide proper structural support
once the water on the isolated area is decreased. All design plans shall be done by a professional engineer
registered in the State of Florida and shall include Best Management Practices to minimize the migration
of solids from Pond 1 to Pond 2 to the maximum extent practicable.

b. Upon Department approval, the permittee shall commence construction of the overflow structure and
any other approved appurtenances. The construction shall be completed no later than xx days from
Department approval.
c. Within xx days from permit issuance, the permittee shall submit the engineer design for the berm
structure that will isolate the northern portion of Pond 1 as indicated in Figure 1 below. Along with the
engineering design, the permittee shall also submit a structural assessment of the existing berm that will
attach to the new berm structure. The assessment shall include an analysis of the current berm structure
and any changes necessary to provide proper structural support once the water on the isolated area is
decreased.
d. Once constructions of the berm has been complete, the permittee shall submit an engineering report
prepared by a registered engineer in the State of Florida who is present during construction certifying the
berm structure was built in accordance with the approved plans.

e.c. Within 24 months of permit issuance, all required construction for the wastewater treatment plant
modification shall be completed.
f.d. During the wastewater pond modifications, the permittee shall implement Best Management Practices
to minimize the migration of solids from Pond 1 to Pond 2 to the maximum extent practicableas
recommended in the design specifications.
g.e. Once the wastewater treatment pond modification has been complete and if the permittee should
decide to re-open the isolated section of pond 1 to put it back into use for wastewater treatment, the
permittee shall adhere to the following requirements:
(1) Notify the Department of its intent and submit a schedule for implementation of the structural
changes that may be needed prior to operation. The permittee shall obtain written approval from
the Department prior to initiating any changes to the system.
(2) Submit solids segregation plan for Department review and approval or remove solids present in
the isolated area. If solids are removed from the site, the Department reserves the right to require
additional sampling of the material. The Department will inspect the isolated area prior to placing
any section back into flow-through service.
(3) Notify the Department within 14 days of completion of wastewater pond changes as mentioned in
part g(1).
h.f. Within 30 days of receipt of any of the above reference Engineer Design or Reports or subsequent
submittals of additional information, the Department shall request submittal of any additional information
needed to review the report. If the Department requests additional information concerning the report, the
permittee shall submit the requested information within 30 days of receipt of written notice. If the
Department disapproves of any Engineer Design or Report, it shall specify the reasons for such
disapproval and actions required to receive approval, and the permittee shall resubmit a revised Engineer
Design or Report within 30 days of receipt of written notice of disapproval.
11. Dissolved Oxygen Maintenance Plan of Study (POS)
a. The Permittee shall implement the Dissolved Oxygen Maintenance POS. The applicable POS was
submitted on March 22, 2011, with additional information submitted on July 7, 2011 and January 20,
2012. In accordance with the POS, the oxygen shall be injected using water from Rice Creek and added in
Rice Creek at 2.4 miles upstream from the mouth of the St. Johns River. The minimum oxygen injection

b. Following approval by the Department, the oxygen injection system operating protocol shall be
incorporated into and become an enforceable condition of this permit.
12. St. Johns River Water Quality Monitoring Plan of Study (POS)
The Permittee shall implement the St. Johns River Water Quality Monitoring POS. submitted to the
Department on August 24, 2006. A final report is due within 6 months from the completion of the last
monthly monitoring event.
13. St. Johns River Biological Community Monitoring Plan of Study (POS)
The Permittee shall implement the St. Johns River Biological Community Monitoring POS submitted on
September 19, 2006, revised on September 11, 2007, and updated on August 25, 2010.
14. Toxicity Identification Evaluation Plan of Study (POS)
a. The permittee shall submit to the Department within 30 days permit issuance a Plan of Study (POS) to
identify potential chemical(s) that may be responsible for chronic toxicity effects seen by the
Ceriodaphnia dubia. The TIE POS shall include, but is not limited to, a toxicity characterization
procedure to help narrow the focus of the search for the causative agents and how this information will be
used to target further testing. The following referrences should be used in developing the POS:
i. Toxicity Identification Evaluation: Characterization of Chronically Toxic Effluents, Phase
I: Methods to characterize the chemical/physical nature of the constituents in effluents which
cause their chronic toxicity (EPA 600-6-91-005F) Published: 05/01/1992

these analyses and next step(s) the permittee plans to take to reduce or eliminate potential sources of
toxicity.
d. Within 60 days of receipt of any of the above referenced POS or subsequent submittals of additional
information, the Department shall request submittal of any additional information needed to review the
POS or report. If the Department requests additional information concerning the POS or Progress Report,
the permittee shall submit the requested information within 45 days of receipt of written notice. If the
Department disapproves of any POS or Progress Report, it shall specify the reasons for such disapproval

the permit, this condition will be considered satisfied.
II.
A.

Industrial Sludge Management Requirements


Basic Management Requirements

1. Wastewater treatment solids from the primary clarifier are pumped to sludge lagoons for draining and air
drying. The on-site solid waste disposal area is authorized to receive the wastewater treatment solids.
Ground water monitoring of the sludge lagoons shall be performed in accordance with Part III of this
permit.
2. The Permittee shall give prior notice to the Department of any change in the Permittee's sludge disposal
practice. If the Permittee land disposes of primary clarifier sludges off the mill site, the Permittee shall
keep records of the amount of sludge disposed, transported, or incinerated in dry tons/day. If a person
other than the Permittee is responsible for sludge transporting, disposal, or incineration, the Permittee shall
also keep the following records:
(a) name, address, and telephone number of any transporter, and any manifests or bill of lading used.
(b) name and location of the site of disposal, treatment, or incineration.
(c) name, address, and telephone number of the entity responsible for the disposal, treatment, or
incineration site.
III.

Industrial Wastewater Ground Water Monitoring Requirements

1. The permittee shall give at least 72-hours notice to the Department's Northeast District Office, prior to the
installation of any monitoring wells detailed in this permit.
2. Prior to construction of new ground water monitoring wells, a soil boring shall be made at each new
monitoring well location in order to establish the well depth and screen interval.
3. Within 30 days after installation of a new monitoring well, the permittee shall submit to the Department's
Northeast District Office detailed information on the wells location and construction on DEP Form(s) 62 520.900(3), Monitor Well Completion Report. A surveyed drawing shall also be submitted, showing the
location of all new monitoring wells which will be horizontally located by metes and bounds or equivalent
surveying techniques. The surveyed drawing shall include the monitor well identification number as well
as location and elevation of all permanent benchmark(s) and/or corner monument marker(s) at the site.
The survey shall be conducted by a Florida Registered Surveyor.
4. All ground water monitoring wells shall have a nominal casing diameter of 2-inches or greater, and shall
conform to the DEP Monitoring Well Design and Construction Guidance Manual, unless otherwise
approved or modified by ground water staff of the departments northeast district. All well construction
shall be done by a licensed water well contractor.
5. During the period of operation authorized by this permit, the permittee shall sample ground water at the
existing monitoring wells identified in items III.6 and 8 below, in accordance with this permit and the
approved ground water monitoring plan prepared in accordance with Rule 62-520.600, F.A.C.

Following a minimum of one (1) year of semiannual sampling, data may be reviewed by the Permittee to
evaluate changes in parameters and sampling frequencies that may be appropriate. Any changes to the
monitoring program shall be proposed in a request for a permit modification.
10. Between 6 to 12 months preceding permit expiration, the Permittee shall conduct an expanded sampling of
monitoring wells MWI-4 and MWI-11, for the primary and secondary drinking water parameters included
in Rule 62-550, Tables 1, 4, 5 and 6, (excluding asbestos). All analytical results from this expanded
sampling shall be submitted as an attachment with the permit renewal application. [62-520.600(5)(b),
F.A.C.]
11. For R-001 and R-002, the permittee shall comply with all ground water quality criteria specified in Rule
62-520, F.A.C., at the edge of the zone of discharge. The zone of discharge shall extend horizontally
along the ground surface to the property line, and vertically to the base of the surficial aquifer, pursuant to
Rule 62-520.465, F.A.C.
12. The minimum ground water quality criteria specified in Rule 62-520.400 F.A.C., shall be met within the
zone of discharge.
13. If the concentration for any constituent listed in Permit Condition III.7 and 9 in the natural background
quality of the ground water is greater than the stated maximum, or in the case of pH is also less than the
minimum, the representative natural background quality shall be the prevailing standard.
14. Water levels shall be recorded prior to evacuating the well for sample collection. Elevation references
shall include the top of the well casing and land surface at each well site (NAVD allowable) at a precision
of plus or minus 0.01 foot. Groundwater levels for new wells shall be recorded no less than forty eight
(48) hours after well installation and prior to evacuating the well for sample collection. This information
shall be submitted to the Department with the groundwater analytical results.
15. Ground water monitoring wells shall be purged prior to sampling to obtain representative samples.

16. All sample collection and laboratory analysis shall be performed in accordance with Rule 62-160, F.A.C.,
and Rule 62-520.600, F.A.C. Minimum detection limits shall be at or below the ground water standards
and/or criteria.
17. Analyses shall be conducted on unfiltered samples, unless filtered samples have been approved by the
Department's Northeast District Office as being more representative of ground water conditions.
18. Ground water monitoring test results for monitoring wells listed in Permit Condition III.6 and 8 shall be
submitted on Part D of DEP Form 62-620.910(10) (attached), and shall be submitted to the address(s)
specified in I.E.3.

19. If any monitoring well becomes damaged or cannot be sampled for some reason, the permittee shall notify
the Departments Northeast District Office immediately and a written report shall follow within seven
days detailing the circumstances and remedial measures taken or proposed. Repair or replacement of
monitoring wells shall be approved in advance by the Departments Northeast District Office.
IV.

Solid Waste Disposal Area and Storm Water Management System

In connection with the facility, the Permittee operates and maintains an on-site solid waste disposal facility
which receives clean construction debris, calcium carbonate, boiler ash, and other solids generated as byproducts from the papermaking operation. This does not include solids from the wastewater treatment ponds
(ponds 1 through 4 and the ESB). The permittee shall first contact the Department to determine any testing
requirements prior to inclusion of these solids. Ground water monitoring of the solid waste disposal area shall
be performed in accordance with Part IV.A of this permit. The Permittee also operates and maintains the
surface water management system including in-line retention basins 1, 4, 5 and wet detention basin 2 to
receive and treat storm water runoff from the solid waste disposal area.
A.

Solid Waste Ground Water Monitoring Requirements

1. The permittee shall give at least 72-hours notice to the Department's Northeast District Office, prior to the
installation or replacement of any monitoring wells detailed in this permit.
2. Prior to construction of new ground water monitoring wells, a soil boring shall be made at each new
monitoring well location in order to establish the well depth and screen interval.
3. Within 30 days after installation of a new monitoring well, the permittee shall submit to the Department's
Northeast District Office detailed information on the wells location and construction on DEP Form(s) 62 520.900(3), Monitor Well Completion Report. A surveyed drawing shall also be submitted showing the
location of all new monitoring wells which will be horizontally located by metes and bounds or equivalent
surveying techniques. The surveyed drawing shall include the monitor well identification number as well
as location and elevation of all permanent benchmark(s) and/or corner monument marker(s) at the site.
The survey shall be conducted by a Florida Registered Surveyor.

4. All ground water monitoring wells shall have a nominal casing diameter of 2-inches or greater, and shall
conform to the DEP Monitoring Well Design and Construction Guidance Manual, unless otherwise
approved or modified by ground water staff of the departments northeast district. All well construction
shall be done by a licensed water well contractor.
5. Within 90 days after installation of any new monitoring well around the Solid Waste sites, the permittee
shall have a baseline analysis for the following parameters, and the analytical results shall be submitted in

9. For the solid waste disposal area, the permittee shall comply with all ground water quality criteria
specified in Rule 62-520, F.A.C., at the edge of the one of discharge. The zone of discharge shall extend
horizontally along the ground surface to the property line, and vertically to the base of the surficial
aquifer, pursuant to Rule 62-520.465, F.A.C.
10. The detection wells for the solid waste management unit shall be used to evaluate groundwater impacts
from the solid waste management unit. If any detection well shows a confirmed exceedance of a ground
water standard or criterion, the Permittee shall, upon Department approval, either replace the existing
detection well with a new detection well downgradient of the existing detection well or shall comply with
Rule 62-701.510(7), F.A.C.
11. Water levels shall be recorded prior to evacuating the well for sample collection. Elevation references
shall include the top of the well casing and land surface at each well site (NAVD allowable) at a precision
of plus or minus 0.01 foot. Groundwater levels for new wells shall be recorded no less than forty eight
(48) hours after well installation and prior to evacuating the well for sample collection. This information
shall be submitted to the Department with the groundwater analytical results.
12. A map shall be constructed depicting locations of wells and piezometers, surface water staff gage
locations and the corresponding water level measurements. In the event that the data indicates a variation
in the horizontal or vertical flow directions such that existing wells are not adequate to intercept potential
contaminants generated from the facility or that alternative monitor wells are appropriate, the Permittee
shall propose additional or alternative wells or the Department shall require wells to be installed.

13. The Permittee shall monitor the data obtained from the ground and surface water monitoring system and
the site specific conditions. A biennial report shall be submitted to the Department by the Permittee
analyzing the appropriateness of the groundwater monitoring well and surface water sampling locations to
intercept any potential contaminant plume that may generate from the solid waste management area;
including the groundwater surface maps, an analysis of seasonal variation in groundwater levels, flow
directions and quality, and a graphic plot of analytical laboratory data over time for the quarterly sampling
parameters. The Permittee shall prepare and submit this information by 24 months from the effective date
of this permit and 48 months from the effective date of this permit.
14. All sample collection and laboratory analysis shall be performed in accordance with FAC Chapter 62-160
and Rule 62-520.600, F.A.C. Minimum detection limits shall be at or below the groundwater or surface
water standards and/or criteria.
15. Analyses shall be conducted on un-filtered samples, unless filtered samples have been approved by the
Department's Northeast District Office as being more representative of ground water conditions.
16. If any monitoring well becomes damaged or cannot be sampled for some reason, the permittee shall notify
the Departments Northeast District Office immediately and a written report shall follow within seven
days detailing the circumstances and remedial measures taken or proposed. Repair or replacement of
monitoring wells shall be approved in advance by the Departments Northeast District Office.
17. The minimum ground water quality criteria specified in Rule 62-520.400 F.A.C., shall be met within the
zone of discharge.
18. Groundwater sampling results, required water quality monitoring reports and all ground water and surface
water analytical results shall be submitted electronically, with one hard copy submitted to the
Department's Northeast District Office, unless the Department indicates otherwise in writing. Water
quality monitoring reports shall be submitted in Adobe pdf format. The water quality data Electronic
Data Deliverable (EDD) shall be provided to the Department in an electronic format consistent with
requirements for importing the data into DEP's databases. This format is presently in accordance with the
Guidance for Submitting Electronic Water Quality Data to the Solid Waste Program document, but
which may be changed by the Department in the future. Water quality monitoring reports shall be signed
and sealed by a Florida registered professional geologist or professional engineer with experience in
hydrogeological investigations and shall include the following:
1. Cover letter;
2. Summary of exceedances and recommendations;
3. Ground water contour maps;
4. Chain of custody forms;
5. Water levels, water elevation table;
6. Ground Water Monitoring Report Certification, using the appropriate DEP form;
7. Appropriate sampling information on Form FD 9000-24 (DEP-SOP-001/01); and
8. Laboratory and Field EDDs and error logs, as applicable.
With the exception of the above-mentioned hard copy, all submittals in response to this specific
condition shall be sent both to:

19. A summary report shall be prepared and submitted between 60 and 180 days preceding the permit
expiration date. The report shall include water table contour maps for the eight most recent sample
events, along with a complete tabulated record and graphical plot for each parameter. It shall also
incorporate an evaluation of the analytical data with respect to the water quality standards, ground water
elevations and temporal variability. The report shall be signed and sealed by a ground water professional.
20. Based on any information or data obtained after the effective date of this permit, the Department reserves
the right to modify the conditions set forth herein pursuant to the latest state Rules and regulations (before
or after the effective date of this permit); and may modify the permit conditions to address additional
groundwater assessment, additional monitoring wells and/or analytical parameters and compliance
monitoring.
B.

Solid Waste Disposal Area

1. The Permittee shall maintain the disposal areas side slopes at a maximum slope of three to one
(horizontal to vertical).
2. The Permittee shall place temporary cover within seven days after placement of waste in an area that will
not receive additional waste for six months. The temporary cover shall have a minimum thickness of six
inches and shall consist of low permeability (10 -5 cm/s) soil.
3. Within 60 days of permit issuance, the Permittee shall eliminate depressions and promote runoff from the
solid waste disposal areas by recontouring the top area to a minimum 3% slope.
4. Within one year of permit issuance, the Permittee shall submit and receive Department approval of a full
engineering assessment of the site to determine the design of an intermediate cover system.
5. Within 18 months of permit issuance, the Permittee shall install the intermediate cover system and shall
continue to install and maintain such a cover system throughout the remaining life of the disposal area.
6. A copy of the Department approved engineering drawings, plans, reports, groundwater monitoring plan,
and supporting information shall be kept at the facility at all times for reference and inspections.
7. Deficiencies discovered at the solid waste disposal site that may compromise groundwater, surface water,
or other environmental standards shall be repaired immediately. Other deficiencies shall be corrected
within one month of the time of discovery. If operational maintenance measures are insufficient to enable
the system to meet the design standards, the Permittee must either replace the system or construct an

alternative design. The Permittee must submit a permit modification application within ninety (90) days
of the date the system was determined to be design deficient.
8. The solid waste disposal site shall be supervised and inspected by qualified individuals(s) a minimum of
twice per week. These inspections shall consist of checks to determine that the waste is being discharged
at the correct location and that the solid waste disposal site is being operated properly and in a manner
that will not compromise environmental standards as a minimum. If problems or evidence of less than
satisfactory operations are observed, then the frequency of inspections shall be increased to daily until
otherwise authorized by the Department.
9. The Permittee shall provide the Department with a waste quantity report for the solid waste disposal site.
This report shall include the amount of waste in cubic yards that is received as well as removed from the
site. This information shall be compiled monthly and be submitted as part of the quarterly groundwater
monitoring report.
10. The Permittee is responsible for the operation of all erosion and sediment controls for the solid waste
disposal site. The Permittee is encouraged to use the appropriate Best Management Practices described in
the Florida Land Development Manual: A Guide to Sound Land and Water Management (DEP, 1988).

C.

Stormwater Management System

1. A copy of the Department approved surface water management system engineering drawings, plans,
reports, groundwater monitoring plan, and supporting information shall be kept at the facility at all times
for reference and inspections.
2. Deficiencies discovered at the storm water management system that may compromise groundwater,
surface water, or other environmental standards shall be repaired immediately. Other deficiencies shall be
corrected within one month of the time of discovery. If operational maintenance measures are insufficient
to enable the system to meet the design standards, the Permittee must either replace the system or
construct an alternative design. The Permittee must submit a permit modification application within
ninety (90) days of the date the system was determined to be design deficient.
3. The storm water management system shall be inspected monthly. Any breech of storm water system
integrity shall be immediately repaired. Inlets and outlets shall be inspected for signs of erosion.
Whenever erosion is detected, measures shall be taken to stabilize and protect the affected area. Clean
broken concrete or other material approved by the Department may also be used for erosion control.
Debris, trash, etc., shall be removed from basins and control structures. Sediment removal will be
undertaken when storage volume or conveyance capacity falls below design capacity. Mowing and
management of grass clippings shall be conducted on a regular basis. Aeration; tilling or replacement of
topsoil will be conducted as needed to restore percolation capability of the system. All disturbed areas,
swales, and retention basin side slopes must be sodded or seeded and mulched within 30 days following
maintenance or repair, and a substantial vegetation cover must be established within 60 days of seeding.
4. All construction, operation, and maintenance of the storm water system shall be as set forth in the plans,
specification, and performance criteria contained in the Department file and approved by this permit.

5. If any other regulatory agency should require revisions or modification to the permitted project, the
Department is to be notified of the revisions so that a determination can be made whenever a permit
modification is required.
6. The Permittee is responsible for the operation of all erosion and sediment controls for the surface water
management system.

A.

Operation and Maintenance Requirements


Treatment and Disposal Facilities

1. The permittee shall ensure that the operation of this facility is as described in the application and
supporting documents.
2. The operation of the pollution control facilities described in this permit shall be under the supervision of a
person who is qualified by formal training and/or practical experience in the field of water pollution
control.
B.

Record keeping Requirements:

1. The permittee shall maintain the following records on the site of the permitted facility and make them
available for inspection:
a. Records of all compliance monitoring information, including all calibration and maintenance records
and all original strip chart recordings for continuous monitoring instrumentation, including, if
applicable, a copy of the laboratory certification showing the certification number of the laboratory, for
at least three years from the date the sample or measurement was taken;
b. Copies of all reports, other than those required in items a. and f. of this section, required by the permit
for at least three years from the date the report was prepared, unless otherwise specified by Department
rule;
c. Records of all data, including reports and documents used to complete the application for the permit
for at least three years from the date the application was filed, unless otherwise specified by
Department rule;
d. A copy of the current permit;
e. A copy of any required record drawings;
f.

VI.

Copies of the logs and schedules showing plant operations and equipment maintenance for three years
from the date on the logs or schedule.

3. This permit satisfies Industrial Wastewater program permitting requirements only and does not authorize
operation of this facility prior to obtaining any other permits required by local, state or federal agencies.
4. The permittee shall provide verbal notice to the Department as soon as practical after discovery of a
sinkhole within an area for the management or application of wastewater or sludge. The permittee shall
immediately implement measures appropriate to control the entry of contaminants, and shall detail these
measures to the Department in a written report within 7 days of the sinkhole discovery.
B.

Specific Conditions Related to Construction

1. Prior to placing the modified portions of the existing facilities into operation or any individual unit
processes into operation, for any purpose other than testing for leaks and equipment operation, the
permittee shall complete and submit to the Department DEP Form 62-620.910(12), Notification of
Completion of Construction for Wastewater Facilities. [62-620.630(2)]
2. Within six months after a facility is placed in operation, the permittee shall provide written certification to
the Department on Form 62-620.910(13) that record drawings pursuant to Chapter 62-600, F.A.C., and
that an operation and maintenance manual pursuant to Chapters 62-600 and 62-610, F.A.C., as applicable,
are available at the location specified on the form. [62-620.630(7)]
3. No later than 14 calendar days following a date identified in the above schedule, the permittee shall
submit either a report of progress or, in the case of specific actions being required by an identified date, a
written notice of compliance or noncompliance. In the latter case, the notice shall include the cause of
noncompliance, any remedial actions taken, and the probability of meeting the next scheduled
requirement. [62-620.610(19)]
C.

Duty to Reapply
The permittee shall apply for renewal of this permit at least 180 days before the expiration date of the
permit using the appropriate forms listed in Rule 62-620.910, FAC, including submittal of the appropriate
processing fee set forth in Rule 62-4.050, FAC. The existing permit shall not expire until the Department
has taken final action on the application renewal in accordance with the provisions of Rules 62-620.335(3)
and (4), FAC.

D. Specific Conditions Related to Best Management Practices


1. BMP Plan:
For purposes of this part, the terms "pollutant" or "pollutants" refer to any substance listed as toxic under
Section 307(a)(1) of the Clean Water Act (the "Act"), oil, as defined in Section 311(a)(1) of the Act, and
any substance listed as hazardous under Section 311 of the Act. The permittee shall develop and
implement a Best Management Practices (BMP) plan which prevents, or minimizes, the potential for the
release of pollutants from ancillary activities, including material storage areas; plant site runoff; in-plant
transfer, process and material handling areas; loading and unloading operations; and sludge and waste
disposal areas, to the waters of the State through plant site runoff; spillage or leaks; sludge or waste
disposal; or drainage from raw material storage.
2. Implementation:
The BMP plan shall be implemented in accordance with the schedule contained in Part VI of this permit.

3. General Requirements:
The BMP plan shall:
a. Be documented in narrative form, and shall include any necessary plot plans, drawings or maps.
b. Establish specific objectives for the control of pollutants.
(1) Each facility component or system shall be examined for its potential for causing a release of
significant amounts of pollutants to waters of the State due to equipment failure, improper
operation, natural phenomena such as rain or snowfall, etc.
(2) Where experience indicates a reasonable potential for equipment failure (e.g., a tank overflow or
leakage), natural conditions (e.g., precipitation), or other circumstances to result in significant
amounts of pollutants reaching surface waters, the plan should include a prediction of the
direction, rate of flow, and total quantity of pollutants which could be discharged from the facility
as a result of each condition or circumstance.
c. Establish specific best management practices to meet the objectives identified under paragraph b. of
this subsection, addressing each component or system capable of causing a release of significant
amounts of pollutants to the waters of the State, and identifying specific preventative or remedial
measures to be implemented.
d. Be reviewed by plant engineering staff and plant manager.
4. Documentation:
The permittee shall maintain the BMP plan at the facility and shall make the plan available to the
Department upon request.
5. BMP Plan Modification:
The permittee shall amend the BMP plan whenever there is a change in the facility or change in the
operation of the facility which materially increases the potential for the ancillary activities to result in a
discharge of significant amounts of pollutants.
6. Modification for Ineffectiveness:
If the BMP plan proves to be ineffective in achieving the general objective of preventing the release of
significant amounts of pollutants to surface waters and the specific objectives and requirements under
paragraphs b. and c. of item 3, the permit shall be subject to modification pursuant to rule 62-620.325,
FAC, to incorporate revised BMP requirements.
7. Best Management Practices (BMPs) Plan for spent pulping liquor, soap, and turpentine
management, spill prevention, and control pursuant to 40 CFR 430.03.
The Permittee, in addition to the requirements stated in VI.D.1.a-e, shall implement a BMP Plan in
accordance with 40 CFR 430.03 and comply with the requirements of 40 CFR 430.03 as it applies to
direct discharging pulp, paper, and paperboard mills with pulp production in Subpart C of 40 CFR 430
(promulgated April 15, 1998).

Specific Conditions Related to Existing Manufacturing, Commercial, Mining, and Silviculture


Wastewater Facilities or Activities

1.

Existing manufacturing, commercial, mining, and silvicultural wastewater facilities or activities that
discharge into surface waters shall notify the Department as soon as they know or have reason to believe:
a. That any activity has occurred or will occur which would result in the discharge, on a routine or
frequent basis, of any toxic pollutant which is not limited in the permit, if that discharge will exceed
the highest of the following levels
(1) One hundred micrograms per liter,
(2) Two hundred micrograms per liter for acrolein and acrylonitrile; five hundred micrograms per liter
for 2,4-dinitrophenol and for 2-methyl-4,6-dinitrophenol; and one milligram per liter for antimony,
or
(3) Five times the maximum concentration value reported for that pollutant in the permit application.
b. That any activity has occurred or will occur which would result in any discharge, on a non-routine or
infrequent basis, of a toxic pollutant which is not limited in the permit, if that discharge will exceed the
highest of the following levels
(1) Five hundred micrograms per liter,
(2) One milligram per liter for antimony, or
(3) Ten times the maximum concentration value reported for that pollutant in the permit application.

F.

Reopener Clause

1.

The permit shall be revised, or alternatively, revoked and reissued in accordance with the provisions
contained in Rules 62-620.325 and 62-620.345, FAC, if applicable, or to comply with any applicable
effluent standard or limitation issued or approved under Sections 301(b)(2)(C) and (D), 304(b)(2) and
307(a)(2) of the Clean Water Act (the Act), as amended, if the effluent standards, limitations, or water
quality standards so issued or approved:
a. Contains different conditions or is otherwise more stringent than any condition in the permit/or;
b. Controls any pollutant not addressed in the permit.
The permit as revised or reissued under this paragraph shall also contain any other requirements of the
Act then applicable.

2.

The permit may be reopened to adjust effluent limitations or monitoring requirements should future Water
Quality Based Effluent Limitation determinations, water quality studies, DEP approved changes in water
quality standards, or other information show a need for a different limitation or monitoring requirement.

3.

The Department may develop a revised or additional Total Maximum Daily Loads (TMDL) during the
life of the permit. Once a new or revised TMDL has been established and adopted by rule, the
Department shall revise this permit to incorporate the final findings of the TMDL.

EXPIRATION DATE:

With regard to any determination by the Department of any POS, report, and in reopening the permit, the
Permittee, may file a petition for formal or informal administrative proceeding, pursuant to sections
120.569 and 120.57, Florida Statutes, and Chapter 62-103, Florida Administrative Code, if it disagrees
with or otherwise disputes the Departments determination. The petition must conform with the
requirement of rule 62-103.155, Florida Administrative Code, and must be received by the Departments
Office of General Counsel, 3900 Commonwealth Boulevard, Tallahassee, Florida 32399-3000, within
twenty-one (21) days after receipt of written notice of the Departments determination. Failure to file a
petition within this time period shall constitute a waiver by Georgia-Pacific of its right to request an
administrative proceeding under section 120.57, Florida Statutes. The Departments determination shall be
incorporated by reference into this permit and made a part thereof. Notwithstanding other terms of the
permit, Georgia-Pacific shall have the right to judicial review of the Departments final order entered after
any administrative hearing held pursuant to this paragraph, as provided by section 120.68, Florida Statutes.
VIII. General Conditions
1. The terms, conditions, requirements, limitations and restrictions set forth in this permit are bind ing and
enforceable pursuant to Chapter 403, FS. Any permit noncompliance constitutes a violation of Chapter
403, F.S., and is grounds for enforcement action, permit termination, permit revocation and reissuance, or
permit revision. [62-620.610(1), FAC]
2. This permit is valid only for the specific processes and operations applied for and indicated in the
approved drawings or exhibits. Any unauthorized deviation from the approved drawings, exhibits,
specifications or conditions of this permit constitutes grounds for revocation and enforcement action by
the Department. [62-620.610(2), FAC]
3. As provided in subsection 403.087(7), FS, the issuance of this permit does not convey any vested rights or
any exclusive privileges. Neither does it authorize any injury to public or private property or any invasion
of personal rights, nor authorize any infringements of federal, state, or local laws or regulations. This
permit is not a waiver of or approval of any other Department permit or authorization that may be required
for other aspects of the total project which are not addressed in this permit. [62-620.610(3), FAC]
4. This permit conveys no title to land or water, does not constitute state recognition or acknowledgment of
title, and does not constitute authority for the use of submerged lands unless herein provided and the
necessary title or leasehold interests have been obtained from the State. Only the Trustees of the Internal
Improvement Trust Fund may express State opinion as to title. [62-620.610(4), FAC]
5. This permit does not relieve the permittee from liability and penalties for harm or injury to human health
or welfare, animal or plant life, or property caused by the construction or operation of this permitted
source; nor does it allow the permittee to cause pollution in contravention of Florida Statutes and
Department rules, unless specifically authorized by an order from the Department. The permittee shall
take all reasonable steps to minimize or prevent any discharge, reuse of reclaimed water, or residuals use
or disposal in violation of this permit which has a reasonable likelihood of adversely affecting human
health or the environment. It shall not be a defense for a permittee in an enforcement action that it would
have been necessary to halt or reduce the permitted activity in order to maintain compliance with the
conditions of this permit. [62-620.610(5), FAC]
6. If the permittee wishes to continue an activity regulated by this permit after its expiration date, the
permittee shall apply for and obtain a new permit. [62-620.610(6), FAC]

7. The permittee shall at all times properly operate and maintain the facility and systems of treatment and
control, and related appurtenances, that are installed and used by the permittee to achieve compliance with
the conditions of this permit. This provision includes the operation of backup or auxiliary facilities or
similar systems when necessary to maintain or achieve compliance with the conditions of the permit. [62620.610(7), FAC]
8. This permit may be modified, revoked and reissued, or terminated for cause. The filing of a request by
the permittee for a permit revision, revocation and reissuance, or termination, or a notification of planned
changes or anticipated noncompliance does not stay any permit condition. [62-620.610(8), FAC]
9. The permittee, by accepting this permit, specifically agrees to allow authorized Department personnel,
including an authorized representative of the Department and authorized EPA personnel, when applicable,
upon presentation of credentials or other documents as may be required by law, and at reasonable times,
depending upon the nature of the concern being investigated, to
a. Enter upon the permittees premises where a regulated facility, system, or activity is located or
conducted, or where records shall be kept under the conditions of this permit;
b. Have access to and copy any records that shall be kept under the conditions of this permit;
c. Inspect the facilities, equipment, practices, or operations regulated or required under this permit; and
d. Sample or monitor any substances or parameters at any location necessary to assure compliance with
this permit or Department rules.
[62-620.610(9), FAC]
10. In accepting this permit, the permittee understands and agrees that all records, notes, monitoring data, and
other information relating to the construction or operation of this permitted source which are submitted to
the Department may be used by the Department as evidence in any enforcement case involving the
permitted source arising under the Florida Statutes or Department rules, except as such use is proscribed
by Section 403.111, Florida Statutes, or Rule 62-620.302, FAC. Such evidence shall only be used to the
extent that it is consistent with the Florida Rules of Civil Procedure and applicable evidentiary rules. [62620.610(10), FAC]
11. When requested by the Department, the permittee shall within a reasonable time provide any information
required by law which is needed to determine whether there is cause for revising, revoking and reissuing,
or terminating this permit, or to determine compliance with the permit. The permittee shall also provide to
the Department upon request copies of records required by this permit to be kept. If the permittee
becomes aware of relevant facts that were not submitted or were incorrect in the permit application or in
any report to the Department, such facts or information shall be promptly submitted or corrections
promptly reported to the Department. [62-620.610(11), FAC]
12. Unless specifically stated otherwise in Department rules, the permittee, in accepting this permit, agrees to
comply with changes in Department rules and Florida Statutes after a reasonable time for compliance;
provided however, the permittee does not waive any other rights granted by Florida Statutes or
Department rules. A reasonable time for compliance with a new or amended surface water quality
standard, other than those standards addressed in Rule 62-302.500, FAC., shall include a reasonable time
to obtain or be denied a mixing zone for the new or amended standard. [62-620.610(12), FAC]
13. The permittee, in accepting this permit, agrees to pay the applicable regulatory program and surveillance
fee in accordance with Rule 62-4.052, F.A.C. [62-620.610(13), FAC]

14. This permit is transferable only upon Department approval in accordance with Rule 62-620.340, FAC.
The permittee shall be liable for any noncompliance of the permitted activity until the Department
approves the transfer. [62-620.610(14), FAC]
15. The permittee shall give the Department written notice at least 60 days before inactivation or
abandonment of a wastewater facility and shall specify what steps will be taken to safeguard public health
and safety during and following inactivation or abandonment. [62-620.610(15), FAC]
16. The permittee shall apply for a revision to the Department permit in accordance with Rule 62-620.300,
FAC, and the Department of Environmental Protection Guide to Wastewater Permitting at least 90 days
before construction of any planned substantial modifications to the permitted facility is to commence or
with Rule 62-620.325(2), F.A.C., for minor modifications to the permitted facility. A revised permit shall
be obtained before construction begins except as provided in Rule 62-620.300, FAC. [62-620.610(16),
FAC]
17. The permittee shall give advance notice to the Department of any planned changes in the permitted
facility or activity which may result in noncompliance with permit requirements. The permittee shall be
responsible for any and all damages which may result from the changes and may be subject to
enforcement action by the Department for penalties or revocation of this permit. The notice shall include
the following information:
a. A description of the anticipated noncompliance;
b. The period of the anticipated noncompliance, including dates and times; and
c. Steps being taken to prevent future occurrence of the noncompliance.

18. Sampling and monitoring data shall be collected and analyzed in accordance with Rule 62-4.246, Chapters
62-160 and 62-601, F.A.C., and 40 CFR 136, as appropriate.
a. Monitoring results shall be reported at the intervals specified elsewhere in this permit and shall be
reported on a Discharge Monitoring Report (DMR), DEP Form 62-620.910(10), or as specified
elsewhere in the permit.
b. If the permittee monitors any contaminate more frequently than required by the permit, using
Department approved test procedures, the results of this monitoring shall be included in the calculation
and reporting of the data submitted in the DMR.
c. Calculations for all limitations which require averaging of measurements shall use an arithmetic mean
unless otherwise specified in this permit.
d. Except as specifically provided in Rule 62-160.300, FAC., any laboratory test required by this permit
shall be performed by a laboratory that has been certified by the Department of Health Environmental
Laboratory Certification Program (DOH ELCP). Such certification shall be for the matrix, test method
and analyte(s) being measured to comply with this permit. For domestic wastewater facilities, testing
for parameters listed in Rule 62-160.300(4), F.A.C., shall be conducted under the direction of a
certified operator.
e. Field activities including on-site tests and sample collection shall follow the applicable standard
operating procedures described in DEP-SOP-001/01 adopted by reference in Chapter 62-160, FAC.
f. Alternate field procedures and laboratory methods may be used where they have been approved in
accordance with Rules 62-160.220 and 62-160.330, FAC.

19. Reports of compliance or noncompliance with, or any progress reports on, interim and final requirements
contained in any compliance schedule detailed elsewhere in this permit shall be submitted no later than 14
days following each schedule date. [62-620.610(19), FAC]
20. The permittee shall report to the Departments Northeast District Office any noncompliance which may
endanger health or the environment. Any information shall be provided orally within 24 hours from the
time the permittee becomes aware of the circumstances. A written submission shall also be provided
within five days of the time the permittee becomes aware of the circumstances. The written submission
shall contain: a description of the noncompliance and its cause; the period of noncompliance including
exact dates and time, and if the noncompliance has not been corrected, the anticipated time it is expected
to continue; and steps taken or planned to reduce, eliminate, and prevent recurrence of the noncompliance.
a. The following shall be included as information which must be reported within 24 hours under this
condition:
(1) Any unanticipated bypass which causes any reclaimed water or effluent to exceed any permit
limitation or results in an unpermitted discharge,
(2) Any upset which causes any reclaimed water or the effluent to exceed any limitation in the
permit,
(3) Violation of a maximum daily discharge limitation for any of the pollutants specifically listed in
the permit for such notice, and
(4) Any unauthorized discharge to surface or ground waters.
b. Oral reports as required by this subsection shall be provided as follows:
(1) For unauthorized releases or spills of untreated or treated wastewater reported pursuant to
subparagraph a.(4) that are in excess of 1,000 gallons per incident, or where information indicates
that public health or the environment will be endangered, oral reports shall be provided to the
Department by calling the STATE WARNING POINT TOLL FREE NUMBER (800) 320-0519,
as soon as practical, but no later than 24 hours from the time the permittee becomes aware of the
discharge. The permittee, to the extent known, shall provide the following information to the State
Warning Point:
(a) Name, address, and telephone number of person reporting;
(b) Name, address, and telephone number of permittee or responsible person for the discharge;
(c) Date and time of the discharge and status of discharge (ongoing or ceased);
(d) Characteristics of the wastewater spilled or released (untreated or treated, industrial or
domestic wastewater);
(e) Estimated amount of the discharge;
(f) Location or address of the discharge;
(g) Source and cause of the discharge;
(h) Whether the discharge was contained on-site, and cleanup actions taken to date;
(i) Description of area affected by the discharge, including name of water body affected, if any;
and
(j) Other persons or agencies contacted.
(2) Oral reports, not otherwise required to be provided pursuant to subparagraph b.(1) above, shall be
provided to Departments Northeast District Office within 24 hours from the time the permittee
becomes aware of the circumstances.
c. If the oral report has been received within 24 hours, the noncompliance has been corrected, and the
noncompliance did not endanger health or the environment, the Departments Northeast District Office
shall waive the written report.

21. The permittee shall report all instances of noncompliance not reported under Conditions VIII.17., 18. and
19. of this permit at the time monitoring reports are submitted. This report shall contain the same
information required by Condition VIII.20. of this permit. [62-620.610(21), FAC]
22. Bypass Provisions.
a. Bypass is prohibited, and the Department may take enforcement action against a permittee for bypass,
unless the permittee affirmatively demonstrates that:
(1) Bypass was unavoidable to prevent loss of life, personal injury, or severe property damage; and
(2) There were no feasible alternatives to the bypass, such as the use of auxiliary treatment facilities,
retention of untreated wastes, or maintenance during normal periods of equipment downtime. This
condition is not satisfied if adequate back-up equipment should have been installed in the exercise
of reasonable engineering judgment to prevent a bypass which occurred during normal periods of
equipment downtime or preventative maintenance; and
(3) The permittee submitted notices as required under Condition VIII.22.b. of this permit.
b. If the permittee knows in advance of the need for a bypass, it shall submit prior notice to the
Department, if possible at least 10 days before the date of the bypass. The permittee shall submit notice
of an unanticipated bypass within 24 hours of learning about the bypass as required in Condition
VIII.20. of this permit. A notice shall include a description of the bypass and its cause; the period of
the bypass, including exact dates and times; if the bypass has not been corrected, the anticipated time it
is expected to continue; and the steps taken or planned to reduce, eliminate, and prevent recurrence of
the bypass.
c. The Department shall approve an anticipated bypass, after considering its adverse effect, if the
permittee demonstrates that it will meet the three conditions listed in Condition VIII.22 a.(1) through
(3) of this permit.
d. A permittee may allow any bypass to occur which does not cause reclaimed water or effluent
limitations to be exceeded if it is for essential maintenance to assure efficient operation. These
bypasses are not subject to the provision of Condition VIII.22.a. through c. of this permit.

23. Upset Provisions
a. A permittee who wishes to establish the affirmative defense of upset shall demonstrate, through
properly signed contemporaneous operating logs, or other relevant evidence that:
(1) An upset occurred and that the permittee can identify the cause(s) of the upset;
(2) The permitted facility was at the time being properly operated;
(3) The permittee submitted notice of the upset as required in Condition VIII.20. of this permit; and
(4) The permittee complied with any remedial measures required under Condition VIII.5. of this
permit.
b. In any enforcement proceeding, the burden of proof for establishing the occurrence of an upset rests
with the permittee.
c. Before an enforcement proceeding is instituted, no representation made during the Department review
of a claim that noncompliance was caused by an upset is final agency action subject to judicial review.
