BEITENACTEDBYTHELEGISLATIVEASSEMBLYOFNORTHDAKOTA:
SECTION1.Anewsectiontochapter1510oftheNorthDakotaCenturyCodeiscreated
andenactedasfollows:
DisciplinaryproceedingsRighttocounselforstudentsandorganizationsAppeals.
1.Anystudentenrolledataninstitutionunderthecontrolofthestateboardofhigher
educationhastherighttoberepresented,atthestudent'sexpense,byanattorneyor
anonattorneyadvocate,whomayfullyparticipateduringanydisciplinaryhearingproceeding
orduringanyotherprocedureadoptedandusedconductedbythatinstitutiontoaddressan
allegedviolationoftheinstitutionsdisciplinarypolicies.Astudentdoesnothavetherighttobe
representedbyanattorneyor
nonattorneyadvocateiftheallegationpertainstoacademicdishonesty,asdefinedby
theinstitution. Thisrightonlyappliesifthedisciplinaryhearinginvolvesaviolationwhichcouldresult
inasuspensionorexpulsionfromtheinstitution.Thisrightdoesnotapplytomattersinvolving
academicmisconduct.
2.Nostatementofastudentenrolledataninstitutionunderthecontrolofthestateboardof
highereducationgivenduringaninstitutionsinvestigationofanallegedviolationofitsdisciplinary
policiesoratadisciplinaryhearingrelatingtoaviolationofitsdisciplinarypolicies,maybesubsequently
usedinanycriminalproceeding.Anystudentorganizationofficiallyrecognizedbyaninstitutionunder
thecontrolofthe
stateboardofhighereducationhastherighttoberepresented,atthestudent
organization'sexpense,byanattorneyornonattorneyadvocatewhomayfully
participateduringanydisciplinaryprocedureorduringanyotherprocedureadopted
andusedbytheinstitutiontoaddressanallegedviolation.

a.Anystudentwhoissuspendedformorethantendaysorexpelledfroman
institutionunderthecontrolofthestateboardofhighereducationforaviolation
ofthedisciplinaryorconductrulesofthatinstitutionandanystudentorganization
thatisfoundtobeinviolationofthedisciplinaryorconductrulesofthatinstitution
mayseekareviewoftheinstitution'sdecisioninthedistrictcourtforthe
jurisdictioninwhichtheinstitutionislocated.
b.Thestudentorastudentorganizationmustfileapetitionforreviewwiththe
appropriatedistrictcourtnolaterthanoneyearafterthedaythatthecauseof
actionaccrues.Forpurposesofcalculatingtheoneyearlimitation,thecauseof
actionisdeemedaccruedonthedatethatthestudentorthestudentorganization
receivesfinalnoticeofdisciplinefromtheinstitution.
c.Inanycauseofactionunderthissubsection,theinstitutionshallforwardthe
recordtothecourtwhosefunctionitistodeterminewhetherthefinaldecision
reachedbytheinstitution,onthebasisoftherecord,couldreasonablybesaid
nottobearbitrary,capricious,orotherwisecontrarytolaw.
4.Inanysuccessfulappealbroughtundersubsection3,thecourtshallawardthe
aggrievedstudentorstudentorganizationcompensatorydamages,reasonablecourt
costs,attorney'sfees,includingexpertfees,andanyotherreliefinequityorlawthat
thecourtdeemsappropriate,including:
a.Adenovorehearingbytheinstitutioninaccordancewiththissection;and
b.Monetarydamagesinanamountnotlessthanthecostoftuitionandfeespaidby
thestudentoronthestudent'sbehalf,totheinstitution,forthesemesterduring
whichtheallegedviolationoccurredorduringwhichasuspensionorexpulsion
wasimposed,plusmonetarydamagesinanamountnotlessthantheamountof
anyscholarshipfundinglostasaresultofthediscipline.
