OFFICE, A TWENTY PERCENT (20%) DISCOUNT ON THEIR MONTHLY BILLED
CONSUMPTION, PROVIDING RULES THEREFOR, AND FOR OTHER PURPOSES.

Be it by the Sangguniang Bayan of Guinobatan Albay, in session assembled, that:


Section 1.

Provision. All Registered Residential Senior Citizen Concessionaires of


Water in Guinobatan Waterworks System Office are hereby granted a
Twenty Percent (20%) Discount on their Monthly Billed Consumption
subject to the qualifications provided under Section 4 hereof.

Section 2.

Purpose. In view of the enactment of Republic Act No. 7432 otherwise


known as the Senior Citizens Act, and its subsequent amendment by
Republic Act No. 9994 known as the Expanded Senior Citizens Act of
2010, which granted the elderly benefits and privileges such as twenty
percent (20%) discount and exemption from the value added tax (VAT) on
the dale of goods and services such as medicines, transport fees, medical
and dental fees, it is still within the mandate of every local government to
further expand such benefits and privileges in consideration of their role in
nation building as well as in order to encourage the families and the
communities they live with to reaffirm the value of caring for them.
Through this, it is perceived that senior citizens contribution will be
maximized and their worth and value will be more assisted and
appreciated by the community in general and by their respective families
in particular.

Section 3.

Definition of Terms. When used in this Ordinance, the term:


a. Senior Citizen or elderly shall refer to any resident of the
Municipality of Guinobatan, Albay who is at least sixty (60) years old;
b. Concessionaire shall refer to a resident of Guinobatan, Albay who is
a Senior Citizen as defined in Section 3(a) hereof and whose water

consumption in the house where he/she is a resident has been


registered on his/her name in the Guinobatan Waterworks System
Office;
c. Monthly Bill shall refer to the water bill issued monthly by the
Guinobatan Waterworks System Office containing therein a statement
of charges or expenditures for the use of water in each household
which is issued to the concessionaire for its fulfilment/ payment, but
shall not, however, include installation fees.
Section 4.

Qualifications of Senior Citizens for them to avail the Privilege. This


twenty percent (20%) discount shall be granted only to all Senior Citizens
who are:
a. Registered Concessionaire of Water in Guinobatan Waterworks System
Office of Guinobatan, Albay;
b. Living and residing at the house where the discount privilege is being
applied and/ or granted ; and,
c. Registered as Senior Citizen in the Book of Registry of OSCA as
certified by the president or his/her authorized representative, or with
valid Senior Citizen Identification Card (ID) issued by the LGU.

Section 5.

Transfer of Registration/Concession from Non-Senior Citizen to


Senior Citizen. In the implementation of this ordinance, it is expected that
present concessionaire, who are non-senior citizens, may transfer their
concessions to a household member who is a senior citizen, such
transferor shall be required to pay an amount of P50.00 as transfer fee
upon application.

Section 6.

Duty of the Head of the Family to Report Death of the Senior Citizen.
In case of the death of the registered residential senior citizen
concessionaire, the person who represents or acts as head of the family or
household has the duty to report such death to the Guinobatan Waterworks
System Office (GWSO) within thirty (30) days from his/her death.

Section 7.

Penalties for Failure to Make the Report. Failure of the person who
represents or acts as the head of the family or household to make the
report as mandated by the preceding section shall empower the GWSO to
impose the following penalties upon him/her:
a. Automatic lifting of the discount privilege granted in favour of his/her
household upon discovery by the GWSO of the death of the concerned
senior citizen;
b. Payment of the full amount without discount in the monthly bill from
the time of the death of the registered senior citizen. Payments made
during the death of the registered concessionaire without knowledge
on the part of the GWSO as to his/her death shall be considered only
as partial payment and the balance which represents the discount shall
still be paid by the new concessionaire in his succeeding bills;
c. Payment of the five percent (5%) surcharge of every month of delay of
reporting reckoned from the lapse of the thirty-day (30) reportorial
period as a penalty for misrepresentation/ dishonesty.

Section 8.

Separability Clause. If, for any reason or reasons, any part or provision
of this Ordinance shall be held to be unconstitutional or invalid, other
parts or provision hereof which are not affected thereby shall continue to
be in full force and effect.

Section 9.

Repealing Clause. Any Ordinance, or part or parts thereof which are


inconsistent with any of the provisions of this Ordinance are hereby
repealed or modified accordingly.

Section 10.

Effectivity. This ordinance shall take effect immediately upon its


approval.
