EXCERPTS FROM THE MINUTES OF THE 26 th REGULAR SESSION OF THE
SANGGUNIANG BAYAN HELD ON JULY 4, 2011 AT 9:19 IN THE MORNING AT THE
SANGGUNIANG BAYAN SESSION HALL, GUINOBATAN, ALBAY.

Provision. All fruit stands around the Guinobatan Sports Center are hereby
transferred to the vacated Tricycle Terminal of Parada 1 at the Eastern portion of
the Public Market, without exception.
Section 2.
New Site. The area located at the eastern portion of the Public Market is hereby
declared as the new site for the fruit vendors considering that the space therein is
no longer in use as a tricycle terminal of Parada 1 and is just within the public
market. This site shall be the official site for fruit vendors and no other vending
place shall be authorized for the same except on this designated site. Any vendor
who will vend or sell fruits in the undersigned site/ place shall be considered
illegal and their goods will confiscated by the authorities concerned. Hence,
Section 4 of Ordinance No. 01-2001 is hereby amended by deleting the term
Fruits as one of the primary goods which shall be offered for sale in the
commercial spaces around the Sports Center and is hereby substituted by the
terms general merchandise, cellphone and cellphone accessories to confirm
with the present usage of the site.
Section 3.
Operation. Such fund shall be coordinated with the Mayor, the Municipal
Planning and Development Coordinator (MPDC) and the Budget Officer for its
subsequent incorporation in the Supplemental Budget.

Date of Transfer. The date of transfer to the new site shall not be later than
October 15, 2011 (Christmas Season), they will be operating normally and
smoothly at the site.
Section 7.
Rental Fee. The rental per month shall also be Four Hundred Pesos (Php400.00)
per space/ stall with a grace period of one (1) month from the date of official
transfer (October 15 to November 15, 2011 only) as fixed in Section 6 hereof.

Separability Clause. If, for any reasons or reasons, any part of provision of this
Ordinance shall be held to be unconstitutional or invalid, other parts of provisions
hereof which are not affected thereby shall continue to be in full force and effect.

Effectivity. This Ordinance shall take effect immediately upon its approval.
