I, N.Srinivas s/o Sri P.Nagappa aged about 45years residing at c/o Muniyappa
building Andrahalli, Viswaneedam Post, Bangalore 58, do hereby solomenly
affirm as state and oath as follows:1. I am the 11th Defendant in the above case I know the facts of the case.
Hence i am swearing this affidavit.
2. I submit that the plaintiff above named filed suit against me and other
defendants for relief of declaration and consequential relief.
3. I submit that after filing of this suit this Honble court issued summons to
me the said summons duly served to me. From last 4months I am suffering
from ill health, I am unable to contact my counsel to file power on behalf
of me. In the last week I met with my counsel and l verified the records
before this Honble court after verifying the records my counsel instructed
me I placed ex-parte. Hence this application to set aside the ex-parte
order dated / /2010.
4. If this application is allowed no prejudice will be caused to the other side
on the other hand if this application is not allowed I will be put to
Irreparable Loss and justice will fail.
Wherefore, it is just an expedient to pass an order as prayed for in the
annexed application, in the interest of justice and equity.
