Following the Rectifying Note of Protest, bearing the signature of Ms. Sibylle Thard Mevs, published
in the Le Nouvelliste newspaper in its Friday, January thirty (30), 2015 edition, Mr. Reynold Georges,
by way of justice, filed an injunction against us on February twelve (12), 2015 to publish a decision of
the Disciplinary Board of the Bar Association of Port-au-Prince dated December ten (10), 2014.
Against this decision, Ms. Sibylle Thard Mevs filed an appeal on December twenty-two (22), 2014.
On February twelve (12), 2015, Le Nouvelliste calls on the President of the Bar Association of Portau-Prince to follow-up on the request made by the attorney for Jean Nanmins heirs.
On February sixteen (16), 2015, Predisent Carlos Hercule responds to Le Nouvelliste stating that:
Taking into account the nature of the given case, your letter will be forwarded to the Disciplinary
Board which will be convened for the purpose in the first fortnight of March of this year.
In the meantime, Le Nouvelliste thinks it is appropriate to publish all the documents in its possession.
1 A copy of the decision of the Disciplinary Board of the Bar Association of Port-au-Prince dated
December ten (10), 2014;
2 - A copy of the appeal dated December twenty-two (22), 2014 filed by Ms. Sibylle Thard Mevs
against the decision of the Disciplinary Board of the Bar Association of Port-au-Prince;
3 A copy of the insertion requested throughthe clerk of the court by the Reynold Georges Law Firm
dated February twelve (12), 2015;
4 A copy of the letter from Le Nouvelliste newspaper dated February twelve (12), 2015 addressed to
the President of the Bar Association, Mr. Carlos Hercule;
5 - A copy of the letter from the President of the Bar Association, Mr. Carlos Hercule, dated February
sixteen (16), 2015 addressed to Le Nouvelliste newspaper.
Considering that this behavior contravenes the provisions of the Decree of March 29, 1979 regulating
the profession of attorney, in particular Articles 52, 54 and 55 and the principles of loyalty, honor,
integrity, confraternity and sensitivity;
Considering that Mevs contravened the rules governing the essential principles of the profession of
attorney, the relations between colleagues and the contradictory nature of the discussions;
Considering that, based on this behavior, Ms. Sibylle Thard Mevs is subject to disciplinary sanctions
under Article 62 of the Decree of March 29, 1979 regulating the profession of attorney;

Considering that the Disciplinary Board was surprised by the attitude of Mr. Reynold Georges who
consulted the record of his opponent filed in the Registry of the Court of Appeal of Port-au-Prince;
Considering that the mandate of the Disciplinary Board is confined to the documents used as reference;
and, in addition, the investigation that was performed was not completed on this fact;
Considering that Mr. Reynold Georges, whose behavior is denounced by one of the lawyers of Ms.
Sibylle Thard Mevs, will have to appear before the Disciplinary Board;
Considering that present decision will not, under any circumstances, be the basis for any criminal
prosecution,
Decision
Consequently, after deliberating in accordance with the principles of the legal profession, the
Disciplinary Board:
1 - Assumes jurisdiction to rule on the complaint of June 28, 2012, and at the same time, declares it
admissible;
2 - Decides, as primary disciplinary sanction, to suspend Ms. Sibylle Thard Mevs for a period of five
(5) consecutive months starting from the notification hereof;
3 - Orders, as additional disciplinary sanction, the posting of the present decision in the offices of the
Bar Association and at the Courts;
4 - Orders the notification of the present decision to Ms. Sibylle Thard Mevs, to the complainants and
to the Commissioner of the Government of this jurisdiction;
5 - Recommends the automatic referral to the Disciplinary Board in regards to the verification by Mr.
Reynold Georges of the record of his opponent in the Registry of the Court of Appeal of Port-auPrince;
6 - Returns the false documents and the usage of false documents to the prosecution of this
jurisdiction;
7 - Says that the present decision shall not be the basis for any criminal action.

of Appeal which marked March 12, 2009 as the beginning of the delay period, thus making the
opposition of April 1, 2009 late. Also, while asking the court in its conclusions to enforce the theory
equant, Mr. Reynold Georges acknowledging that his act did not include identification numbers for his
clients, consequently, making it inadmissible.
Thus, it is established that the appellant has not committed any offense to the professional rules, no
breach of integrity, honor, and ethics. The Disciplinary Board can not interfere in judicial matters. It
should allow the courts to do justice.
As a result, not only is there nothing in the behavior of the appellant that falls within the scope of
Articles 52, 54 and 55 of the Decree of March 29, 1979, but the appellant always makes a point of
using a polished vocabulary. Can the same be said of her colleague?
For these causes and reasons, see the Honorable Judges of the Court of Appeal of the Republic:
Receive this appeal to be exercised within the prescribed manner and period; maintain the aforesaid
means against the decision of the Disciplinary Board which 1) has committed a huge abuse of power
by eliminating the essential parts of the file, therefore violating the rights of the defense by basing its
decision on erroneous grounds, 2) prematurely executed its decision by violating Articles 62, 70 and
73 of the Decree of March 29, 1979 regulating the profession of attorney; 3) distorted the facts in this
case, the words of bailiff Jean Ernst Latortue; 4) falsely interpreted and applied Articles 52, 54 and 55
of the Decree of March 29, 1979 and violated the rights of the defense; 5) exceeded its powers beyond
the mandate it was given; 6) as a result, from all of the above, simply reverse the faulty disciplinary
decision of December 10, 2014, whith conviction of the Bar Association to pay for costs and expenses;
And justice will be served.

SIBYLLE THARD MEVS was suspended from the Bar of Port-au-Prince for 5 months, following a
complaint filed by the heirs of Jean Nanmin and Marie Louise Orphise represented by Mr. Dufresne
Hilarion. This suspension, which extends from December 17, 2014 to May 17, 2015 was imposed by
considering ...that her behavior violated the provisions of the Decree of March 29, 1979 regulating the
profession of attorney, in particular Articles 52, 54 and 55 and the principles of loyalty, honor,
integrity, confraternity and sensitivity....

This file against Ms. SIBYLLE THARD MEVS and her clients, the heirs of Jean Audain has been
sent to the Investigating Chamber for FORGERY and USE OF FORGERY, for legal action, according
to indictment to inform of the Commissioner of the Government at the Court of 1st Instance of Port-auPrince.
