PiOLO PASCUA
This Judicial Affidavit of PIOLO PASCUA, a witness, is executed to serve as his direct
testimony in the instant case.

This Judicial Affidavit is being offered to prove:

A)
The identity of the parties and annexes appended thereto and which
were already marked as exhibits during the Pre-Trial of this case;
B)
All other related matters, facts and circumstances relevant and
material to this case.
This Judicial Affidavit was taken at the office of Atty. Fez Buok, Zamaboanga City.

Questions were propounded by Atty. Fez Buok and these questions are
numbered consecutively and each question is followed by the answer of
the witness.
1. Do you swear to tell the truth and nothing but the truth?
I do.

2. Are you aware that you may face criminal liability for false testimony or perjury if
you will not tell the truth?
I am.

3. Please state your name, age address and occupation.

I am Piolo Pascua, 24 years old, married, and residing at Bulua, Cagayan de Oro City.

4. Are you the same Piolo Pascua, a witness in this case?

Yes.

5. Do you know the Defendant in this case, Mr. Gal Axy?

Yes.

6. How did you come to know the Defendant? And how long have you known him?
I am the adjacent neighbour of the defendant, and I have known him for about
ten(10) years.

7. Do you know the Plaintiff in this case, Mr. Sam Sung?

Yes.

8. How did you come to know the Plaintiff? And how long have you known him?
I am his elementary classmate, and I have known him for about fifteen(15) years.

9. Can you attest to the fact that both Plaintiff and Defendant personally know each
other?
Yes. I was the one who introduced them to each other.

10. Showing you a document, marked as Exhibit____, can you identify what this
document is?
Yes. That is the contract of sale.

11. What is your involvement in this contract?

I was a witness then and there when it was executed.

12. How did you come to be as a witness to Exhibit____?

On December 03, 2014 I was called by Sam Sung and was asked to be one.

13. How was Exhibit____ executed?

As agreed, I met Atty. Fez Buok, Gal Axy and Sam Maybe in Lim Kit Kai inside Bos
coffee shop where it was executed and signed by Gal Axy at around 9 oclock in the
morning. Then I subsequently left for Zamboanga City to attend to my personal
business and to also witness Sam Sung sign the said contract in Atty. Fez Buoks
office.
