The Court has reviewed the Gaye Parties Request for an Evidentiary Relief, A Bench Instruction, and a
Supplemental Jury Instruction (Dkt. 297) (the Request). The Court states its tentative views that it is
inclined to deny the Request. Counsel address the Court. The Court DENIES the Request as it does not
find a sufficient basis for the relief requested. All of the matters raised have been addressed previously.

The Court inquires as to the relevance of the references by the Thicke Partes to the interest of Motown
Records with respect to the matters at issue. There is no claim of damages based on any losses of sales
of the Gaye Parties recordings. The Court states that it is inclined to modify the 17.0 Instruction with
respect to the words sheet music to use a different term if appropriate based on the competing positions
of the experts who have testified about the proper name for the deposit copy.
Counsel have reached an agreement as to the profits the Thicke Parties received with the exception of the
touring income and overhead as to the Interscope party. Counsel shall file the stipulation so that it is made
available on the docket. A copy will be provided to the Jury during deliberations.
The Court has reviewed the Thicke Parties' Supplemental Brief (Dkt. 296) with respect to the pending
Motion for leave to Admit Witness from CAA (Dkt. 278). The Thicke Parties stipulate to the authenticity of
the CAA document but not to the admissibility of its contents. The Court sustains this objection on the
grounds stated on the record. There is no admissible evidence to support the summary of financial
information set forth in the document.
Counsel shall finalize the jury instructions and provide a copy of the final version prior to the
commencement of trial on March 4, 2015. A Word version shall be emailed to the Clerk.
