1. I am the complaining witness for Serious Physical Injuries against Joseph

Mar in the case entitled "People of the Philippines versus Joseph Mar Criminal
Case No. 27239, Metropolitan Trial Court, Branch No. 6, City of Iloilo;

2. After my sober and soul searching assessment and analysis of the incident,
I have realized that because I was not wearing my eyeglasses and it was dark, I
cannot point out, without a doubt the accused or any other person/s who inflicted
harm against me;

3. Since I could not state with certainty and without doubt the liability of
Joseph Mar, in fairness to him, I am permanently withdrawing my complaint
against him. I clear him of whatever responsibility or liability to me;

4. I hereby inform the City Prosecutor of Iloilo that I am withdrawing my

complaint for Serious Physical Injuries in Criminal Case No. 27239 entitled
"People of the Philippines versus Joseph Mar", Metropolitan Trial Court, Branch
No. 6, City of Iloilo. And hereby execute the instant Affidavit of Desistance to
effect the same;

5. I likewise request the Metropolitan Trial Court, Branch No. 11, City of
Iloilo to dismiss with prejudice the said criminal case.

2. That Ms.Mary Joy S. Dejada the person named as executor in said will, and said person
consents to act as such executor or renounces his right to the letters testamentary;
3. That the names, ages and residences of the heirs, legatees, and devisees of the
aforementioned decedent are the following:

EXTRAJUDICIAL SETTLEMENT AMONG HEIRS

KNOW ALL MEN BY THESE PRESENTS:
This Extrajudicial Settlement of Estate made and executed in La Paz, Iloilo City
this 11th day of December 2013 by and among:
EMMANUEL S. DEJADA, Filipino, 21 years old, single and residing at Lopez
Jaena St., Jaro, Iloilo City;
KIRTIE MARIE S. DEJADA, Filipino, 35 years old and residing at Mansaya,
La Paz, Iloilo City;
W I T N E S S E T H:

(1) That they are the compulsory heirs of deceased Roberto B. Dejada, being the latters
legitimate children;
(2) Roberto B. Dejada, died in Lopez, Jaena St., Iloilo City, which was his residence at the
time of his death on August 20, 2013;
(3) That the said decedent died without leaving any will and with the aforementioned
legitimate children as his only heirs;

(4) That the deceased Roberto B. Dejadaleft no debt which would be charge to his estate;
(5) That at the time of his death, the said deceased left a one half (1/2) share, pro indiviso, of
a parcel of land covered by Transfer Certificate of Title No. 123 of the Registry of Deeds
of Iloilo City, and which property is particularly described as follows:
Lot 2948-B with an area of fifteen (15) hectares located at Luna St., La Paz, Iloilo City.
Together with all the improvements existing thereon consisting of a semi-concrete house,
situated at Luna St., La Paz, Iloilo City.
(6) That the parties herein have agreed, as they do hereby agree, to divide and settle the
aforementioned estate between them in the following manner, to wit: five (5) hectares to
Iris B. Siano, five (5) hectares to Emmanuel S. Dejada, ten(10) hectares to Mary Joy S.
Dejada and the semi concrete house will remain as their ancestral house to be
administered by Mary Joy S. Dejada. That a true copy of this extrajudicial settlement
had been published once a week for three consecutive weeks in Panay News, a
newspaper of general circulation in Panay. As certified by the said newspaper hereto
attached as Annex A.

OPPOSITOR, through counsel, respectfully avers:

Will

That, at the time of the execution of the said will testator was insane, or
otherwise mentally incapable to make a will in accordance with Section 9 (b),
Rule 76 of the Rules of Court. On September 25, 2003 to October 10, 2005,
the alleged period of the execution of the will by the deceased Roberto B.
Dejada, deceased Roberto B. Dejadawas admitted to Iloilo Mental Hospital in
Barangay Rumbang , Municipality of Pototan, Province of Iloilo as per
recommendation of Dr. AilamelSiloterio, a psychiatrist at St. Pauls Hospital,
after the deceased Roberto B. Dejadawas diagnosed to be suffering from
schizophrenia and was subjected to a pre-frontal lobotomy on October 04,
2007.

That testator Proby N. Siano acted by mistake and he did not intend that the
instrument he signed should be his will at the time of fixing his signature
thereto in accordance with Section 9 (e), Rule 76 of the Rules of Court. In
fact, during the confinement of the deceased Roberto B. Dejadaat the Iloilo
Mental Hospital during the aforementioned period, petitioner Roberto B.
Dejada, made the testator Roberto B. Dejadasign a piece of paper supposedly
containing his testamentary will when testator Roberto B. Dejada, in the state
of utter insanity, did not intend that the instrument he signed be his will at the
time he affixed his signature on the said instrument. .

WHEREFORE, OppositorEugene V. Java prays that the application for the

probate of the will of deceased Roberto B. Dejadabe denied and that said will be
disallowed.

That petitioner, likewise, paid his Professional tax Receipt (PTR) for the year 2013 under
Official Receipt No. 123567 dated February 20, 2013 issued by the City of Iloilo. A copy
of the subject receipt is hereto attached as ANNEX D ;

hereto attached as ANNEX E;

7.

That petitioner did not apply for a similar commission in any other jurisdiction;

compliance report, proof of compliance is hereto attached as ANNEX F;
