Your honor, we are ready to present our first witness, Red Riding Hood, the granddaughter of
the victim, who saw the accused at the scene of the crime.
Court:
Swear the witness.
Interpreter:
Do you swear to tell the truth and nothing but the truth ______________?
Witness:
Yes, Maam.
Interpreter:
Please state your name and other personal circumstances.
Witness:
I am RED RIDING HOOD, 26 years old, single, an elementary school teacher, and a resident
of 50 Malingap St. UP teachers Village, Quezon City.
Prosecution:
We are offering the testimony of this witness to prove the allegations in the information, to
confirm the identity of the accused, the presence of the accused at the scene of the crime and
such other matters with respect to the circumstances of this case.
Court:
Proceed.
Prosecution:
Do you know Nenita Hood?
Witness:
Yes, Maam.
Prosecution:
Why do you know her?
Witness:
She is my paternal grandmother, Maam.
Prosecution:
Where is she now?
Witness:
She is already dead maam, she died on October 5, 201

Prosecution: How old was she when she died?


Witness: 85.
Prosecution:
How did she die?
Witness:
She was killed by stabbing, Maam.
Prosecution:
I have here a Complaint-Affidavit, containing statements as to the incident that happened on
October 5, 2014, do you recognize it?
Witness:
Yes, Mam.
Prosecution:
Why so?
Witness:
Because, I executed it.
Prosecution:
It also bears a signature here, affixed above the name Red Riding Hood as affiant. Do you
recognize it?
Prosecution:
Why do you recognize it?
Witness:
Because it is my signature.
Prosecution:
Your honor, we would like to submit as evidence to the court this Complaint-Affidavit and the
signature therein, both of which have been pre-marked as Exhibits B and B-1 respectively.
Prosecution:
Miss Witness, in the said affidavit, you named the person who allegedly stabbed your
grandmother to death. Could you please tell the court who he is?
Witness:
Bad Lobo, Maam.
Prosecution:
If Bad Lobo is in this court, could you identify him?
Witness:
Yes.(points at the accused)

Do you know Bad Lobo prior to the stabbing incident on October 5, 2014?
Witness:
Yes,Maam.
Prosecution:
Why do you know him?
Witness:
I know him because he is my grandmothers neighbor. His house is six houses away from
hers.
Prosecution:
And you used to see him every now and then as your grandmothers neighbor?
Witness:
Only on some weekends when I visited my grandmother, when I would pass by his house.
Prosecution:
Do you know whether or not your grandmother and the accused knew each other?
Witness:
Yes, Maam. They were neighbors.
Prosecution:
Ms. Hood, will you tell us where you were on October 5, 2014 at around 8:20 in the morning?
Witness:
I had just arrived at my grandmothers house, Maam.
Prosecution:
Where, particularly?
Witness:
At 41 Maligaya St. Quezon City.
Prosecution:
Why were you at your grandmothers house?
Witness:
I usually go there during weekends to bring her food and medicine for her diabetes and
glaucoma because her housemaid only works there on weekdays.
Prosecution:
When you arrived at your grandmothers house, what did you see?
Witness:
I noticed that the front main door was slightly opened.
Prosecution:
After you noticed this, what happened next, if there is any?

Witness:
I opened the door and went inside the house.
Prosecution:
What did you see, if any?
Witness:
I saw that the windows and curtains of the living room were not yet drawn.
Prosecution:
After observing this, what happened next, if any?
Witness:
I thought that this was unusual because it meant that she did not lock the door and had not yet
woken up. I called for my grandmother but there was no response. I then looked for her.
Prosecution:
Did you find your grandmother?
Witness:
Yes
Prosecution:
Where did you find her?
Witness:
I found my grandmother in her bedroom.
Prosecution:
Could you please describe your grandmothers room for us?
Witness:
The bedroom is about 4 meters wide and 5 meters from the door to the wall. The bed is beside
the wall. There was also a tiny cabinet. I remember that there are two windows there with thin lace
curtains which covered them.
Prosecution:
Could you please describe what you saw inside the room when you found your grandmother
there?
Witness:
I saw my grandmother lying on the bed with blood on her back. I also saw Bad Lobo who was
standing beside her bed.
Prosecution:
Ms. Witness, will you describe the position of your grandmother and the accused, Bad Lobo
when you saw them in the bedroom?
Witness:
My grandmother was lying down on her left side, her back of the head facing towards me. Bad
Lobo was standing at my grandmothers bedside, with his back to me.

Prosecution:
How far were you standing from where Bad Lobo is standing?
Witness:
About 3 meters.
Prosecution:
When you saw Bad Lobo standing beside your grandmother, what was he doing?
Witness:
I saw that he was holding a knife in his hand which was covered in blood.
Prosecution:
Which hand was holding the knife?
Witness:
The right hand.
Prosecution:
Please describe this knife for us.
Witness:
It had a black blade, around six inches long and a wooden handle.
Prosecution:
Will you be able to identify the knife if shown to you?
Witness:
Yes.
Prosecution:
(Showing the knife) I am showing you a knife mark as Exh. F. Do you recognize it?
Witness:
Yes.
Prosecution:
Why?
Witness:
This is the knife he was holding maam.
Prosecution:
Your honor, we would like to submit this knife as part of the evidence for prosecution, to be
marked as Exhibit F.
When you saw all of what you just said, what happened next, if any?
Witness:
I screamed loudly in fright.
Prosecution:
What happened next if there is any?

Witness:
He turned around and moved forward towards me.
Prosecution:
When he turned around, how did you react?
Witness:
I shouted more since I saw that the front of his T shirt was covered with blood. I then ran
outside the bedroom to the main front door.
Prosecution:
Were you able to get away from the house?
Witness:
No.
Prosecution:
Why?
Witness:
My boyfriend, Hunts Man, who lives next door arrived at the front door.
Prosecution:
When Mr. Huntsman arrived, what happened next, if there is any?
Witness:
Bad Lobo who was following me dropped the knife and tried to escape by climbing out of the
window.
Prosecution:
Did he escape?
Witness:
No
Prosecution:
Why not?
Witness:
He was not able to escape because Hunts Man pulled Lobo away from the window and boxed him
several times. He then held him down until other neighbors and the barangay captain arrived to help
us.
Prosecution:
After that, what happened, if there is any?
Witness:
The neighbors called the police to arrest Lobo while we called the ambulance but before the
ambulance arrived, my grandmother already expired.
