SB RESOLUTION NO. 013-2015


GRANTING A ONE-MONTH PROVISIONARY MUNICIPAL TRICYCLE OPERATORS PERMIT
(MTOP) TO HEREUNDER 25 QUALIFIED TRICYCLE FRANCHISE APPLICANTS AS
SCREENED AND RECOMMENDED BY THE TASK FORCE KAAYUSAN, TAKEN FROM 25
DROPPED FRANCHISES THAT WERE DECLARED VACANT AND AVAILABLE FOR
AWARDING.

WHEREAS,

pursuant to the provisions of Amendatory Ordinance No. 001-2009 passed and


approved on February 2, 2009, otherwise known as the Guinobatan Tricycle Code
of 1999, the application for Tricycle Operation in Guinobatan, Albay was made
open by virtue of Section 9 of the Guinobatan Tricycle Code of 1999, which
provides that, All applicants who shall completely satisfy all the
qualifications and none of the disqualifications provided for by the
Ordinance shall be granted franchise by the Sangguniang Bayan without
prejudice however for its revocation for cause/s or grounds authorized or
provided for by the same ordinance.

WHEREAS,

in consonance with such provision, a number of applicants filed their applications


for tricycle franchise with the Task Force Kaayusan and after due evaluation, the
following have been initially found to be compliant with the said provision, to wit:

WHEREAS,

although the above-enumerated applicants/grantees for new franchises have been


initially found to have satisfactorily satisfied the qualifications and none of the
disqualifications provided for by the code but they have not totally complied the
payment and the painting of the parada colors on their tricycles being applied for;

WHEREFORE, in view of the foregoing premises, be it now:

RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in session


assembled, to grant as it hereby grants a one-month provisionary Municipal
Tricycle Operations Permit (MTOP) to above-named 25 qualified tricycle franchise
applicants as screened and recommended by the Task Force Kaayusan taken
from 25 dropped tricycle franchise numbers that were declared vacant and
available for awarding.
RESOLVED FURTHER, that the above-named tricycle franchise grantees on provisionary status
must comply with their respective deficiencies, such as but not limited to, full
payment in the Treasury Office of the required fees and tricycle whole-body
painting according to the parada where they have applied for, within the (1) onemonth provisionary period which shall commence on the day that this resolution
was approved by the Sangguniang Bayan.
RESOLVED FURTHERMORE, that any of the above-named grantee who shall remain deficient of
the above-mentioned requirements after the one-month provisionary period shall
mean an automatic exclusion from the list of the tricycle franchise holders and
those who shall completely comply the remaining requirements shall be
permanently included in the official list of tricycle franchise holders in LGU
Guinobatan who are eligible to renew every year but without prejudice however,
from its revocation for cause/s authorized by the code. All payments made by the
grantees who shall remain deficient after the provisionary period shall be forfeited
in favor of the LGU.
RESOLVED FINALLY, that this resolution be furnished to the Office of the Mayor, Task Force
Kaayusan Members/Officers, GUIFTODA, Parada Presidents and all other
concerned persons for their information and guidance.
APPROVED UNANIMOUSLY, on motion of Councilor Rolando P. Palabrica and duly seconded by
the members present this 26th of January, 2015 during their 4th Regular Session.
