Moot Problem
State of Bongia is the largest state in terms of size and population in the union of Tikula, a
democratic republic, Chi- Chi is the official language of Tikula. In the state of Bongia Chi-Chi is
widely spoken and is the mother tongue of the state. In Bongia there are some minority
community, Domil and Kurdu being one of them. There are very few or no primary schools where
Domili or Krudu is used as a medium of instruction therefore they are forced to study either in
public school or in private school. Government run primary schools in Bongia for children in the
age group of 5-14 which taught in mother tongue.
Other states in Tikula adopt bilingual system in primary education and teach primary student
English which is widely recognised as the language of international communication and other
language being Chi-Chi the official language of the state. But in Bongia, it is only at college level
that the medium of instruction is bilingual and students have option to opt for either Chi-Chi or
English as the medium of instruction.
Due to its size and population in the age group of 19-30, lots of private university were coming up
in the state of Bongia. These universities have been established under different act of the state
legislature of Bongia .Due to the mushrooming of such university and also with the opening up of
various study centers of other private university established in the other state of Tikula, the higher
education sector was in complete mess.
To bring Uniformstandard in imparting education and managing affair of private university passed
in the state of Bongia the State legislature passed Private University Regulation Act. This act made
many provisions for educational institutions in Bongia. These provisions were subject to all
university in Bongia and would also extend to all minority institution. Provisions were, it granted
the permission to charge fee as per their requirement and made Chi-Chi mandatory in every
institution in Bongia, and also kept out the students of state of Domil form admission in the Private
University and allowed only those Domili who are domiciles of Bongia.
A big business house from state of Domili and has established a private university, named
DomiliProfesstional University a Private University seek to give admission to all students of state
of Domil and reserves 50% of the seats for them and it offer modern courses in both Domili and
English.
After coming in to the force act the state of Bongia object to the functioning of the DPU and
refuses a no objection certificate for starting its new academic session from July 2009 as DPU has
admitted domili student from the state of Domil in the violation of the provision of the act.
Furthermore, the DPU has refused to offer courses in Chi-Chi medium.
Two students Milaki and Kirkitiya were very eager to take admission in DPU but due the norm of
state legislature they would not be able to pursue the desire course therefore they files 2 writs in
High court of Bongia alleging violation of their legal and fundamental right.
DPU also file a separate writ alleging that his fundamental right to establish and manage and
administer an educational institution is violated.
