Definition of innkeepers

Innkeepers such as hotels, motels ,resort ,bed and breakfast and certain
homestay, run bad , and establishments that offer accommodation for money. Of
course , landlords also let out properties in exchange for money , in the form of
rent. How is an innkeeper different from a landlord let`s just say that a tenant
acquires many right over the property for the duration of the tenancy. He can
even exclude the landlord from the property in some situations. By contrast, a
guest`s occupies a room with the permission of the innkeeper. The innkeepers
retains control of the premises including the room , and he can easily bring the
guest`s stay on an end. In terms of customer expectation, this is not really a
problem a guest`s stay is usually very short and he hardly plans to acquire
competing right against the innkeepers.
There are different facets to an innkeeper`s duties. With his suppliers, for
instance, the innkeeper`s obligations are contractual. The relationship is defined
by the contract they enter intro. An innkeeper`s activities can certainly give rise
to tortuous liability. His employees` carelessness might cause loss or injury to
guests, and he could therefore be vicariously liable in tort of negligence. An
innkeeper is also an `occupier of premises. In this capacity, an innkeeper is
under a duty to ensure that his visitors are able to take care of their own safety.
An occupier can even be liable in respect of the injuries suffered by trespasser.
An innkeeper`s business might also affect his neighbours. For example, a country
side resort has very lively club, and it hosts live performances each night. The
sound system is so loud that neighbouring properties are affected. The
neighbours might well sue the resort in tort if nuisance. As an employer, an
innkeeper owes his employees various duties. Amongst other things, he has to
provide competent staff, safe work place and safe equipment, and a safe system
of work. In short , an innkeeper has to take reasonable care in order not to cause
any foreseeable damage to his employers.
In short, an innkeepers legal obligations could areas. The focus of this chapter is
very specific. Here, we examine the innkeeper`s duties in relation to the people
who consumer his products and services. Guests immediately come to mind they
pay for accommodation in the innkeepers establishment, and during their stay,
may opt for additional servicer (room service, spa, etc). But not all people who
consume an innkeepers products and services are guest. A `guest is someone
who purchase room at the inn. An innkeeper may well serve `travellers, and
these are defined more broadly as people whom, en route from one place to
another, calls at an inn to make use of its services. Of course, a traveller can
later become a guest. But this not necessarily the case. A traveller many the inn
upon seeking refreshment there.
