SPECIAL POWER OF ATTORNEY

KNOW ALL MEN BY THESE PRESENTS:

WE, the undersigned, all of legal age and with postal address at # 33 Real St.,
Tacloban City, do hereby make, constitute and appoint ATTY. LEO S. GIRON and/or
TERESA H. SARINAS, both of legal age and residents of Tacloban City, to be our true
and lawful attorney, for us and in our names, places and steads to perform the following:
1. To ensure that the real properties located at Bo. Esperanza (Bobonon),
Alangalang, Leyte in the names of the undersigned respectively, covered by TCT No. T36509 (NANETTE D. HEGG & JAMES S. DERIADA), T-36510 (JAMES DERIADA),
36511 (EILEEN D. BALTAZAR & URSULA D. BARREDA) and 36512 (URSULA D.
BARREDA), presently leased to ASUCENA BAYLIN be restored in their possession;
2. To file, prosecute and/or defend any and all suits, actions and other
proceedings in the courts, tribunals, departments and offices of the government of the
Philippines, and to terminate, compromise, settle and adjust the same with respect to the
above real properties;
3. To represent us in accordance with the provisions of the Rules of Court,
during the entire proceedings (Preliminary Conference,Pre-Trial and Mediation,
hearings, etc.) of the case that may be filed in connection with the aforesaid real
properties, and more specifically to do any or all of the following acts and deeds which
we could do if personally present:
a.
To enter into an amicable settlement or submission to alternative modes
of dispute resolution;
b.
To agree to a simplification of issues;
c.
To agree to amendments to the pleadings;
d.
To enter into stipulations or admissions of facts or documents;
e.
To limit the number of witnesses;
f.
To preliminarily refer the issues to a commissioner;
g.
To agree to the propriety of rendering judgment on the pleadings, or
summary judgment, or of dismissing the action should a valid ground therefor be
found to exist;
h.
To agree to a suspension of the proceedings; and
i.
To take up and agree upon such matters as may aid the prompt
disposition of the action.
j.
To enter into a COMPROMISE AGREEMENT as may be allowed by law,
indicating the desired terms thereof and any or all such acts and deeds which we
could do if personally present, before the Philippine Mediation Center, Tacloban City
Unit.
k.
To cause the preparation, sign and file any and all necessary pleadings in
connection with the aforesaid real properties;
4.
That the authority that is granted under this Special Power of Attorney
does not include the authority to dispose, sell, encumber, or mortgage any or all of the
aforesaid real properties;
GIVING AND GRANTING unto our said attorney-in-fact full power and authority
to do and perform any and or all of the foregoing acts and things necessary or proper to
be done in and about the premises, as fully to all intents and purposes as we might or
could do if personally present, and HEREBY RATIFYING AND CONFIRMING any and
all such acts and things done under the premises by virtue hereof for all legal intents and
purposes.
