TO AMEND THE ODISHA CO-OPERATIVE SOCIETIES
(AMENDMENT) ACT, 2012.

BE it enacted by the Legislature of the State of Odisha in the


Sixty-fourth Year of the Republic of India as follows:
Short title.

1. This Act may be called the Odisha Co-operative Societies


(Amendment) Amending Act, 2013.

2. In the Odisha Co-operative Societies (Amendment) Act, 2012


in section 17 for the word six months, the words eighteen months
shall be substituted.

STATEMENT OF OBJECTS AND REASONS
The Odisha Co-operative Societies Act, 1962 was amended by the Odisha Co-operative
Societies (Amendment) Act, 2012 to bring it in conformity with the Constitution (Ninety-Seventh
Amendment) Act, 2011. The Amendment Act contains a transitory provision under section 17
providing for a time period of six months within which the election to all Co-operative Societies
shall be held from the date of commencement of the Amendment Act.
The Odisha Co-operative Societies (Amendment) Act, 2012 came into force the 30th
January, 2013 and as such, the said period of six months for holding election to the Cooperative Societies expired on the 31st July, 2013.
The Amendment Act provides for conduct of election to the office of the members and
President and Vice-President of all Co-operative Societies in accordance with the rules
made in constitution with the State Co-operative Election Commission. Holding of election to
the Co-operative Societies depends on making of the rules under the provisions of the Odisha
Co-operative Societies Act, 1962 as amended by the Amendment Act. Accordingly, the Odisha
State Co-operative Election Commissioner (Appointment, Conditions of Service and
Miscellaneous Provisions) Rules, 2013 have been made and the State Co-operative Election
Commissioner has been appointed.
For election to all Co-operative Societies, the Odisha Co-operative Societies Rules,
1965 and the Odisha Co-operative Societies (Election to the Committees) Rules, 1992 are
required to be amended in constitution with the State Co-operative Election Commission in
addition to holding discussion with the field officials of Government, which is in process. After
the rules are notified, the Co-operative Societies are required to amend their by-laws in
accordance with the provisions contained in the Amendment Act and the Rules made thereunder.
It is felt necessary to extend the stipulated period of six months provided in section 17
of the Odisha Co-operative Societies (Amendment) Act, 2012 for holding elections to the Cooperative Societies to a further period of one year making the total statutory period eighteen
months in place of six months by suitably amending the said section, so that the election to
all the Co-operative Societies can be held with the above said period.
The Bill seeks to achieve the above objectives.
