Rough Lumber sold by lumber dealers within their area of jurisdiction covering the month of
June 2014.
Please be informed that no lumber of local species was sold by the lumber dealers,
instead, imported lumbers from Malaysia, Papua New Guinea and Solomon are the available
construction wood materials with an average retailing price of Forty Five Pesos (P45.00) per
board foot.

Please be informed that the three (3) planted Narra trees are within the school compound
of San Isidro Elementary School, Camiling, Tarlac,which falls within the coordinates of
153957 N latitude and 120 2767E longitude. That the said Narra trees may cause further
damage to the concrete fence, pavement and classroom buildings of said school and pose danger
to the lives of the school children/ teachers, etc. and destruction of other school properties.
The identified and inventoried trees requested to be cut have an aggregate volume of one
and 87/100 (1.87) cubic meters; and it is being requested that the products to be derived from
these trees will be utilized for school furniture and fixtures.
Attached herewith are the documents required per your Memorandum dated April 3, 2014
regarding lists of requirements for the tree cutting clearance/permit.

filed against the two persons involved in violation of Section 68 of P.D. 705. The conveyance
and its load of forest products was placed under the custody of 1Lt. Felixberto A. Pena Jr. of the
Philippine Air Force (PAF) and deposited at their base camp in Sta. Juliana, Capas, Tarlac.

(FMB) Mechanized and Modernized Forest Nurseries (MMFN) Team.
In this connection, you are hereby instructed to start the preparatory
activities for the establishment of the MMFN on your respective area. Kindly
coordinate with the respective Local
Government Unit of Tarlac Province and forge Memorandum of Agreement (MOA) for
a long term use, management and administration of MMFN.
Attached herewith is the designed prototype site development plan from
FMB, to be established within 1.26 hectares with corresponding scope of works for
your guidance.

SUPPLEMENTAL GUIDELINES ON THE ISSUANCE OF


TREE CUTTING PERMIT WITHIN THE PROVINCE OF
TARLAC.

Please be informed that the undersigned, received numerous complaints regarding some
misuses and abuses committed by requestor/grantee of cutting permit issued within your
respective jurisdiction.
In this connection, you are hereby directed to adhere to the following supplemental
guidelines relative to the issuance of tree cutting permit to wit:
1. Any tree Cutting Permits/Certificates issued within a week, must be furnished to this
Office for our information and record;
2. Geo-tagged pictures/photos must be taken at the area/site to determine its location and
these must be reflected on a google map; and
3. That cutting of trees and loading of the timber products especially within former
DENR plantation areas must be properly supervised by a competent DENR personnel.
The above guidelines if implemented will help us in addressing any misuse/abuses to be
committed by unscrupulous individuals taking advantage of the privilege granted to them by our
Department.
Your strict compliance is hereby enjoined.

RE: APPREHENDED TWENTY NINE (29) PIECES OF ILLEGALLY CHAINSAW
YEMANE (Gmelinaarborea) WITH A VOLUME OF 0.257 CUBIC METER AT SITIO
ALON, BRGY. LUBIGAN, SAN JOSE, TARLAC
BACKGROUND INFORMATION:
On April 04, 2014 in the morning, as per valid information from a concerned citizen that
there is on-going cutting of Yemane trees in Brgy. Lubigan, San Jose, Tarlac, the Team
immediately proceeded to Brgy. Lubigan and coordinated with Brgy. Council Robert Day who
provided us support with Brgy. Tanods and went to the cited area.
That upon reaching the subject area at about 9:45, we heard a roaring sound of chainsaw
cutting Yemanetrees at the lot allegedly owned by Dizon family of SitioAlonBrgy.Lubigan , San
Jose, Tarlac. That upon verification of the validity of ownership of the Chainsaw, it turned out to
be legitimately registered at the CENRO Tarlac City to Jerry Herbonof Brgy. Lubigan who
operated it. That while taking the measurement of the dimension of chainsawnYemane lumber, a
certain man came and arrogantly introduced himself as Atty. Florante F. Dizon and asked us:
What is the problem? and claimed to own the lot and the cut Yemane trees. He further alleged,
that he asked permission from the Barangay Officials of Lubigan; from the Mayor of San Jose;
and from the CENR Office, Tarlac City, but when he was aked by Forester Mario Q. Guingab if
he hold/possessed any such documents or cutting permit that is issued to him he then replied
none. He reasoned that he requested to cut those blown down trees struck by typhoon Santi,
which he alleged to have been permittedby those mentioned officials when he allegedly talked to
them. That we verified his alleged clearance from the Barangay Official Records of Lubigan if
there is such any documents issued to him, however, it appeared nothing.
That we immediately effected the seizure of these illegally chainsawnYemane lumber by
preparing a Seizure Receipt and requested Mr. Florante F. Dizon to sign it, but he refused to sign
it, instead, he told us to just file a case against him if we perceived to have violated any law, rules
and regulations pertaining to the subject and will be willing to face it in court. He also refused to
release the seized chainsaw and withheld the same and kept it in his house (bunkhouse), the
place where the team had affected the seizure, despite the willingness of the owner, Mr. Jerry
Herbon to turn-over it to us. He further warned us that we entered his property without his
permission.
In this junction, we proceeded to verify another cutting incident where we heard a sound
of chainsaw operating in a nearby area from our place of confiscation. That upon its verification
of the incident, it was found out that there was Certificate of Verification issued from the
CENRO Tarlac to Mr. Rogel Mayor, Jr.
The team decided to just temporarily turned-over the custody of the seized illegally
chainsawnYemane lumber consisting of Twenty-Nine (29) pieces with a volume of 0.257 cubic
meter or 115 board feet to the Barangay Officials of Lubigan, San Jose at Barangay Hall for
safekeeping purposes because they dont have vehicle to transport it. The said seized forest
products were properly received by Hon. Liza Sigue, who was the Officer of the Day at the time
(April 04, 2014). Please see copy of duly signed Seizure Receipt herewith attached.
Relative herewith, the team strongly recommends the immediate filing of criminal
complaint against Mr. Florante F. Dizon for blatantly violating the provision of P.D. 705, as
amended. Attached herewith is the duly signed Seizure Receipt of Forest Products and verified
Pictures of illegally chainsawnYemane lumber and chainsaw actually used in the cutting of said
Yemane Trees seized at SitioAlon, Brgy. Lubigan, San Jose, Tarlac on April 04, 2014.

In accordance with the DENR Administrative Order No. 97-32, A Notice of


Seizure/Administrative Adjudication Hearing was scheduled on May 05, 2014, at 2:00 pm
(Monday) at the Conference Room at PENRO Tarlac City

On Monday morning of 26 May 2014, the undersigned gathered information that the
SPOW(PAF) BASE at Brgy. Sta. Juliana, Capas, Tarlac apprehended/seized one (1) elf truck bearing plate
number UAV 156 loaded with undetermined number of pieces Guijo flitches. The FPLEU Team (PENRO
and CENRO Tarlac City) joint together spearheaded by FII Avelino M. Bacallo, Chief, PENRO FPLEU
proceeded to the SPOW BASE Camp to verify such information. Upon reaching the SPOW Camp, we
ascertained the presence of impounded conveyance loaded with undetermined number of pieces of
dipterocarp Guijo species with some other flitches stocked-piled near the impounded truck, and two(2)
carabao cart also loaded with chainsawn Guijo flitches.
FII Avelino M. Bacallo and FI Alfredo S. Nepacena coordinated with BASE Commander LTC
Rommel Allan P. Genete, regarding the apprehended/seized forest products and conveyance. After which,
we took pictures of the said forest products and conveyance, conduct actual scaling of the apprehended
Guijo flitches to determine the number of pieces and the volume. The geographical location of the
impounding place is 1519 20N, 1202524E. The total number of pieces is 195 with an aggregate
volume of 12,035 bd. ft. or 4.80 cubic meters. The appraised value is 203,500 Php computed at 100 Php
per board foot.
Our group issued apprehension receipt and put under the custody of Ist Lieutenant Felixberto A.
Pena of 790th ABG based thereat. Detailed report will be submitted by CENR Office Tarlac City.

Please be informed that their planted trees was registered as a private land tree plantation
under Certificate of Tree Plantation Ownership No. CCTY 14-32 and it falls within the
coordinates 15 32.084 N latitude and 120 19.585 E longtitude.
A total of One Thousand Six Hundred Three (1,603) planted Gmelina trees with a total
volume of Three Hundred Seventy One and 33/100 (371.33) cubic meters were inventoried and
marked for cutting/harvesting and these will be sawn into lumber/flitches for personal
consumption and for commercial purposes.
Attached herewith are the documents required per Memorandum dated April 3, 2014 and
Fax Message dated April 10, 2014 regarding lists of requirements and additional documents for
the tree cutting clearance/permit.

Please be informed that Ms. Demetria G. Quintos is the rightful owner of the parcel of
land covered with TCT No. 42063 located at Poblacion B. Camiling, Tarlac and it falls within the
geographic coordinate of 154132.6 N latitude and 1202439.2 E longitude.
These three (3) planted Narra trees with a total volume of 91/100(0.91) cubic meters
were inventoried and marked to be cut since these pose danger and threats both to human lives
and properties. These are located in between the residential houses in the area, hence, the cutting
is favorably endorsed by the concerned Barangay LGU.

SUBJECT: IN THE MATTER OF ADMINISTRATIVE ADJUDICATION


HEARING

RE: APPREHENDED ONE (1) CHAINSAW AT SITIO KAWILI-WILI, BRGY.


CUT CUT 2, CAPAS, TARLAC
BACKGROUND INFORMATION:
On March 27, 2014 at around 2:30 pm at Sitio Kawili-wili, Brgy. Cut Cut 2, Capas,
Tarlac, the PENRO and CENRO FPLEU Team seized one (1) chainsaw without a Certificate of
Registration used in cutting of Yemane species without a permit to cut issued by CENRO Tarlac
City.
The said owner of the chainsaw is Mr. Rowel Dela Cruz-Cunanan. After the initial
verification and interrogation, the chainsaw were brought to PENRO Compound, Brgy. Paraiso,
Tarlac City for safekeeping purposes and future disposition.
On April 08, 2014, A Notice of Seizure and Adjudication Hearing was scheduled and held
on April 15, 2014 at 2:00 pm at PENRO Tarlac City.
RESULTS/FINDINGS:
The Administrative Adjudication Hearing pushed through on April 15, 2014 as scheduled
and it was attended by the above-named respondent : Rowel Dela Cruz Cunanan, the members
of the Adjudication Panel- Forester Mariano P. Lagartera, Jr., Chief, FMS, Hearing Officer,
Avelino M. Bacallo, Chief, FPLEU PENRO and Jimmy A. Baldonade, Jr., Chief, of FRCS of
CENRO, Tarlac City.
The hearing was formally called to order by Forester Mariano P. Lagartera, Jr., as Hearing
Officer. He first explained the purpose and nature of the hearing and also told him about the
pertinent forestry laws, rules and regulations being enforced by the DENR including the
appropriate penalties and punishments. After which, the respondent was interrogated and given
his chance to explain his side on the matter pursuant to his constitutional rights. Hereunder,the
results / findings of Adjudication Panel.
1. That, Rowel Dela Cruz-Cunanan explained that the lot where he cut trees is for sale
and he had just been hired by the land-owner. He also said that in every board foot that he cuts,
he had a profit of Php. 7.00.00 pesos.
2. That, based on the foregoing explanation of the respondent, as further evaluated
according to his credibility and by observing due process, it is the opinion of the Adjudication
Panel that he may be given another chance. As such, in order not to jeopardize the right and
means of the respondent for a decent source of livelihood using his equipment, the chainsaw will
be released to the respondent after complying with the necessary requisite documents that the
Adjudication panel advised him to submit.

3. That, the respondent submitted his corresponding Notarized Promissory Note/


SinumpaangSalaysay that he will not commit any similar offense in violation of DENR laws,
rules, and regulations together with the Certification from the Barangay Captain of SitioKawili-

wiliBrgy. Cut-Cut 2, Capas, Tarlac, manifesting that the justification submitted by the respondent
is amenable to the local leaders therein.That as part of his commitment to support forest
conservation, he promised to collect seeds of forest tree species and submit these to the PENRO
to be used in its nursery/ seedling production activities. He will also strongly be reprimanded
that he will be facing appropriate administrative and criminal charges if he commit similar
offense in the future.

AFFIDAVIT
We, LTC ROMMEL ALLAN P. GANETE PAF and ILT FELIXBERTO A.PENA,
JR, PAF, both of Legal age, married and Officers of Philippine Air Force, as Commanding
Officer 790th Air Base Group (ABG) and Personnel Director respectively. both assigned at
790th ABG base at Santa Juliana, Capas, Tarlac, having been duly sworn in accordance
with the Law do hereby depose and state:
1. That as Officers of the Philippine Air Force of the above-stated command post.
We are responsible for the supervision and fielding of men necessarily to carry out function
and duties mandated unto our unit, to include the patrolling the periphery of the Crow
Valley Gunnery and Target Range;
2. That on or about 250330H May 2014 we received information that a truck
bearing plate No. UAV 156 was clandestinely in the process of loading undetermined
pieces and volume of wood products at Sitio Santa Teresa O Donnell, Capas, Tarlac; per
reliable information those timber products emanates from public forest in Sta. Juliana,
Capas, Tarlac.
3. That then and there we conducted apprehension of the truck and possible arrest
of the offender. However, only the driver was left behind at the loading site because the
other suspects have scampered away upon sensing our presence in the area;
4. That the driver and possessor of the lumber at the time of apprehension was
identified in the name of Albert Tiglao a resident of So.Calanat, O Donnel, Capas, Tarlac;
5. That upon apprehension he showed us several papers covering transport of
Forest Products but we found out those were papers intended for Gmelina Timbers and not
what was presently loaded unto their truck which composed of Guijo flitch lumber a
naturally grown species to our knowledge it is covered by prohibition for cutting under
E.O. 23 and to our assessment the timbers bears 1000 bd. ft. more or less;
6. That the owner of the vehicle is Mrs. Iluminada Olimpo who personally appeared
to the command post/headquarter after the truck was brought latter for safekeeping and
further disposition;
7. That afterward we made a representation and coordination with DENR-CENRO
Tarlac City thru a letter address to CENRO Laurino D. Macadangdang dated 26 May 2014
for their appropriate administrative and legal action. The said letter is hereto attached and
marked as Annex 1 and made integral part of this affidavit.
8. That we execute this affidavit in support to Anti-Illegal Logging Campaign as
provided for under P.D. 1559 Section 89 and for the filing of the formal charge against
Albert Tiglao and Iluminada Olimpo, for violation of Section 68 of P.D. 705 as amended
and further amended by E.O. 277.

JOINT AFFIDAVIT

We FORESTER I ALFREDO J. NEPACENA, FR ROLANDO R. BAUTISTA, FR


FLORANTE T. CATACUTAN, AND FORESTER II AVELINO M.BACALLO of legal age,
married and all employee of Department of Environment and Natural Resources (DENR)
connected with Community Environment and Natural Resources Office (CENRO) and
Provincial Environment and Natural Resources Office (PENRO) respectively both based at
Tarlac City. After, having been duly sworn to in accordance with the law do hereby depose
and state.
1. That our agency DENR is the lead agency in implementing laws, rules and
regulations within the jurisdiction of Tarlac province and as personnel we are mandated
and tasked to establish networking and coordination to other government agencies also
tasked in taking care in the protection and conservation of our natural resources,
especially forest resources;
2. That on May 25, 2014, CENR Officer Forester Laurino D. Macadangdang
received reports from LTC Rommel Allan P. Genete (PAF) Group Commander of 790th Air
Base Group (ABG) Crow Valley Gunnery Range Brgy. Sta. Juliana, Capas, Tarlac, that
they have apprehended various timber within their territorial jurisdiction; specifically a
carter truck with plate No. UAV 156 loaded with Guijo timber;
3. That upon hearing such report he instructed us to coordinate immediately to the
said unit for appropriate activities, and act on matters mandated upon our agency;
4. That on May 26, 2014 (Monday) our Team immediately proceeded to the said
Armed Forces Unit and found out that a truck was indeed impounded at the compound of
the 790th ABG Headquarters.
5. That we conducted the necessary scaling, taking of pictures and prepared the
apprehension receipt to effect the formal seizure of the said reported contraband;
6. That the impounded truck with plate number UAV 156 have a load of 120 pieces
Guijo flitches (chainsawn ) and with a volume of 1,240.00 bd.ft., the assessed value is
amounting 124,000.00 Php. Prices of 100 Php per board foot. The said apprehended/seized
items were put under the custody of ILT Felixberto A. Pena Jr. PAF for safekeeping and
future disposition. Attached are the apprehension receipt marked as Annex 1 and Annex
2 respectively;
7. That we took pictures of the said items showing the relative location or GPS
coordinates of the place where the said truck and forest products were presently
impounded to serve as one of the documentary evidences , marked as Annex 3.
8. That we are certain that the said shipment is not sanctioned by the DENR for the
Guijo timber species was a naturally growing Forest Trees and are prohibited to be cut as
provided for under the provision of Executive Order (E.O.) No. 23, dated February 01,
2011 declares a moratorium on the cutting and harvesting of timber in the natural and
residual Forests of the entire country. Thus, our office surely, is not issuing any request
for cutting or transport documents to anybody when it is for dipterocarp species ; and

9. That a formal charge against Albert Tiglao and his cohorts for violation of Section
68PD 705 as amended and further amended by E.O. 277 and remembered as Section 77 of
R.A. 7161.

HEARING: APPREHENDED ONE (1) CHAINSAW AT SITIO
KAWILI-WILI, BRGY. CUT CUT 2, CAPAS, TARLAC

Respectfully forwarded is the report relative to the result of the Administrative


Adjudication Hearing done in PENR Office, Tarlac City on April 15, 2014.
Based on the information gathered, Mr. Rowel Dela Cruz-Cunanan of Sitio Kawiliwili, Brgy. Cut Cut 2, Capas, Tarlac, the respondent explained that he owned the said

chainsaw and that the lot where he cut trees is for sale and he had just been hired by the land
owner.
Peruse evaluation of the Adjudication Panel, on the case at hand. They acted to the
request of the chainsaw owner. However, it depends on the authorities if he will be given a
chance or consideration the social side of the case and in order not to jeopardize his right and
means for a decent source of livelihood using the said equipment hence, Thus, they
recommend that the chainsaw will be released to him after complying with the necessary
requisite documents that they advises him to submit . Finally, as to the part of the chainsaw
owner to support forest conservation, he promised to collect seeds of forest tree species and
these to PENRO to be used in its nursery /seedling production activities. He is also strongly
be reprimanded then, that if he commits similar offense in the future he will be facing
corresponding outright appropriate criminal charges.
Based on the above premises, this office, assent to the request of the owner, that his
chainsaw be released.

I. OVERVIEW OF FOREST MANAGEMENT IN THE PHILIPPINES

A. LEGAL FRAMEWORK
State ownership of natural resources
This is contained in Article XII, Sec. 2 of the 1987 Philippine Constitution, thus all lands of
the public domain , waters, minerals, coal, petroleum and other mineral oils, all forces of
potential energy, fisheries, forests or timber, wildlife, flora and fauna, and other natural
resources are owned by the State. With the exception of Agricultural lands, all other natural
resources shall not be alienated.
Accordingly, the exploration, development, and utilization of natural resources shall be
under the full control and supervision of the State. The State may directly undertake such
activities, or it may enter into co- production, joint venture, or production sharing agreements
with Filipino citizens or corporations or associations at least sixty per centum of whose
capitals are owned by such citizens.
Two major classifications of forest lands.
The first are the protection forests. These are the protected areas and the proclaimed
watersheds. They are called set-asides or protection forests because they have been
legislated or proclaimed for the public good. Their primary purpose is for preservation and
biodiversity conservation. They fall under the general category of national parks under
Articles XII, Sec. 3 of the 1987 Philippine Constitution.
The second are the production forests. These forests are to be sustainably managed primarily
for the utilization of the resources therein such as timber and non- timber forest products. In
the 1987 Constitution, they fall under the category of forest or timber lands.
B. AGENCIES TASKED WITH FOREST MANAGEMENT
DENR as primary agency
DENR is the primary government agency responsible for the conservation, management,
development and proper use of the countrys environment and natural resources (EO 192,
1987).
LGUs as partners/ co- managers
Under RA 7160(Local Government Code of 191), local government units (LGUs) shall share
with national government the responsibility in the management and maintenance of
ecological balance within their territorial jurisdiction.
Section 17 of the LGC went on to devolved certain forest management functions to LGUs,
such as enforcement of forestry laws in community based forestry laws in community based

forestry projects, integrated social forestry programs and communal forests, subject to
supervision, control and review of the DENR.
In 1998, DENR and DILG issued Joint Memorandum Circular No. 98-01 entitled Manual
of Procedures for DENR DILG issued Joint Memorandum Circular No. 2003- 01 entitled
Strengthening the DENR DILG-LGU Partnership on Devolved and Other Forest
Management Functions.

Other agencies having jurisdiction over forest lands


By virtue of other laws and Presidential Proclamations, other agencies have also been given
jurisdiction and management over certain forest areas such as UP with respect to Mt.
Makiling (RA 6967, 1989) and PNOC over Tiwi Geothermal, Tongonan and Palimpinon
watershed areas (PD 1515).
In the Autonomous Region in Muslim Mindanao, management of the forest lands is entrusted
to the ARMM government.

C.

MAJOR FORESTRY LAWS

The principal law governing forest management in the country is PD 705 (1975) otherwise
known as the Revised Forestry Code of the Philippines. The Code contains basic forestry
standards and practices such as areas needed for forestry, multiple use, forest utilization and
management, and criminal offenses and penalties. PD. 705 has been amended by PD 865, PD
1559, PD 1775, BP 83, RA 7161 and EO 277.
Another important law in forestry is RA7586 (1992) or the National Integrated Protected
Area System (NIPAS). This is the principal law governing set asides or protected areas.
NIPAS encompasses outstanding remarkable areas and biologically important public lands
that are habitats of rare and endangered species of plants and animals, biogeographic zones
and related ecosystems, all of which are designated as protected areas. The protected areas
include strict and nature reserve, natural monument, wildlife sanctuary, protected landscapes
and seascapes, resource reserve and natural biotic areas.
RA 8371 (1997) or the Indigenous Peoples Rights Act (IPRA) will also have great impact
on forest management. Other laws include RA 9072 (2001) or the National Cave and
Resources Management and Protection Act, RA 9147 (2001) Wildlife Resources
Conservation and Protection Act, and RA 9175 The Chainsaw Act.

II. ISSUES IN FOREST MANAGEMENT


A.

NON DEMARCATION OF FOREST BOUNDARIES

Earlier, we have discussed the two major classifications of forest lands that of set-asides or
production forests. Knowing the classification and boundaries on the ground is very
important as management and activities will depend on what kind of forest is being managed.
Unfortunately, the metes and bounds of the forest lines have not been delimited. This despite
Article XII, Sec. 4 of the 1987 Philippines Constitution which states. The Congress shall as
soon as possible, determine by law the specific limits of forest lands and national parks ,
marking clearly their boundaries on the ground. Thereafter, such forest lands and national
parks shall be conserved and may not be increased nor diminished, except by law. The

Congress shall provide, for such period as it may determine measures to prohibit logging in
endangered forests and watershed areas.
For the past several years, DENR has launched several reforestation activities supported by
Overseas Development Assistance. DENR had encouraged the use of fast growing species and
had promised the communities who planted them would like to harvest . The DENR would not
allow because the area is a critical watershed, a fact they have belatedly learn.

B.

NEED FOR MORE ACCURATE WORKABLE DEFINITION ON THE MODES


OF DEVELOPMENT AND UTILIZATION OF FOREST RESOURCES

Prior to the 1987 Constitution, the modes of access to natural resources management was
either through a lease, license agreement or permit. In other words, the government issues the
permit, and in return, the logging company pays only fees and other charges, keeping for itself
the enormous profits from the utilization of the natural resources.
For example, for so many years, the forest charge for Almaciga, Lauan, Tanguile, or premium
hardwood harvested was only P30.00 per cubic meter, while the company was able to sell the
same for about P2,000.00 P3,000.00 per cubic meter. No wonder, timber concessionaires
became so rich. Their goal was to cut more and export more. At the expense of our natural
resources ! It was only with the passage of RA 7161(Forest Charges Law, 1991) that forest
charges were increased.
Be that as it may, the 1987 Constitution has so wisely moved away from the lease, license or
permit system. Now, development and utilization of natural resources can only be done
directly by the State, or through co- production, joint venture or production sharing
agreements. The shift is obviously to ensure that the State is able to get a fair return on the
utilization of natural resources. Unfortunately, there is as yet no working definition on what is
the share of the government in joint venture, co- production sharing agreements in forest
products utilization.
For example, under DENR DAO 96-29, CBFM is a production sharing agreement which is
designed to ensure that participating community shall enjoy the benefits of sustainable
utilization, management and conservation of forest lands and natural resources therein. The
government share in these benefits in the form of increased natural resource protection and
rehabilitation, forest charges, fees and/ or taxes as determined and agreed upon.
In the case of IFMA, according to regulations the sharing of the profit between the
holder thereof and the government shall be negotiated between the said holder and the
DENR immediately following the approval of the CDMP and the grant of ECC, Taking
into consideration, among others, the following cost factors:

plantation establishment, management, infrastructure and harvesting costs as


well as mitigation measures;

fixed assets, equipment and machines directly related to plantation development


and harvests;

kind and volume or products that shall be harvested and prevailing fair market
price thereof;

variation in the rates of interests and foreign exchange for financial


investments;

expenses incurred in indirect activities such as community development, etc.;

forest charges and taxes paid; and

reasonable margin for profit and risks.


From the enumeration, the government may end up owing the IFMA holder. In any case,
capturing the true value of the forests has been elusive as yet.
C. NON-IMPLEMENTATION OF THE LGC PROVISION LGU SHARE IN NATIONAL
WEALTH
Aside from mandating LGUs to share with the national government the responsibility in the
maintenance of ecological balance within their territorial jurisdiction, the LGC also gives to
LGUs the right to share in the national wealth. The provision under RA 160 thus states:
Sec. 289. Share in the Proceeds from the Development and Utilization of national wealth.Local government units shall have an equitable share in the proceeds derived from the
utilization and development of the national wealth within their respective areas, including
sharing the same with the inhabitants by way of direct benefits .
Sec. 290. Amount of Share of Local Government Units.- Local government units shall, in
addition to the internal revenue allotment, have a share of forty percent (40%) of the gross
collection derived by the national government from the preceding fiscal year from mining
taxes, royalties, forestry and fishery charges, and other taxes, fees or charges , including
related surcharges, interests or fines, and from its share in any co-production, joint venture or
production sharing agreement in the utilization and development of the national wealth within
their territorial jurisdiction.
In forestry, LGUs share in the national wealth is limited to the forest charges collected in
timber harvesting of natural forests.
Although, there are many LGUs who are committed to good environmental governance, many
LGUs feel that natural resources management and protection are cost centers. Many are
therefore, reluctant to participate actively.
D. NON-IMPLEMENTATION OF THE REWARDS TO INFORMERS UNDER PD 705
The provision reads:
Sec. 78-B- Rewards to informants.- Any person who shall provide any information leading to
the apprehension and conviction of any offender for any violation of this Code or other forest
laws, rules and regulations, or confiscation of forest products, shall be given a reward in the
amount of twenty per centum (20%) of the proceeds of the confiscated forest products.
The law is quite clear. Unfortunately this has not been implemented by DENR for quite some
time now.
E. ISSUANCE OF TAX DECLARATIONS INSIDE FOREST LANDS
As stated by the Constitution, with the exception of alienable and disposable lands, all natural
resources cannot be alienated. Thus, in a long line cases, the Supreme Court has ruled that
titles issued inside forest lands are void from the beginning, as even long, adverse and
continuous possessions of these forest lands do not ripen into ownership.
While this principle is quite clear, the reversion process is very slow. It is common knowledge
that there are many forest lands where titles have been issued.
Aside from anomalous titles obtaining in forest lands, another issue which affects forest
management and leads to conversion of forest lands into other uses is the practice of LGUs in
issuing tax declarations inside forest lands. Accordingly, not for the forest lands but for the
growing crops therein. Although tax declarations are not evidence of ownership, possessions
of tax declarations especially in the rural areas are treated almost as evidence of ownership. If

tax declarations involving growing trees/ crops in forest lands are issued, transfers of the
same are often made, and after a little while, the use of the land becomes agricultural or
residential.
This, despite Sec. 85 of PD 705 as amended which reads:
Sec. 85- Tax Declarations on Real Property.
Imprisonment for a period of not less than two (2) nor more than four (4) years and
perpetual disqualification from holding an elective or appointive office, shall be imposed upon
any public officer or employee who shall issue a tax declaration on real property , without a
certification from the Director of the Forest Development and Director of Lands or their duty
designated representatives that area declared for taxation purposes is alienable and disposable
lands, unless the land is titled or has been occupied and possessed by members of the national
cultural minorities prior to July 4, 1955.

III. FOREST MLAW ENFORCEMENT IN THE PHILIPPINES


A. THE LAW ON ILLEGAL LOGGING
Section 68 of PD 705 as amended by Executive Order No. 277 (1987) is the law governing
illegal logging. It provides:
Sec.68. Cutting, Gathering and/ or Collecting Timber , Other Forest Products Without
License. Any person who shall cut, gather, collect, or remove timber or other forest products
from any forest land, or timber from any forest land, or timber from alienable and disposable
public land or from private land, without any authority, or possess timber or other
forest products without the legal documents as required under existing forest
laws and regulations, shall be punished with the penalties imposed under Article 309 and 310
of the Revised Penal Code: Provided, that in case of partnerships, associations, or
corporations the officers who ordered the cutting, gathering, collection or possession shall be
liable, and if such officers are aliens, they shall, in addition to the penalty, be deported without
further proceedings on the part of the Commission on Immigration and Deportation.
The court shall further order the confiscation in favour of the government of the timber or
any forest products cut, gathered, collected, removed, or possessed, as well as the machinery,
equipment, implements and tools illegally used in the area where the timber or forest products
are found.
Sec. 68- A. Administrative Authority of the Department Head or His
Duly Authorized Representative to Order Confiscation. In all cases of
violations of this Code or other forest laws, rules and regulations, the Department Head or his
duly authorized representative, may order the confiscation of any forest products illegally cut,
gathered, removed, or possessed or abandoned, and all conveyances used either by land, water
or air in the commission of the offense and to dispose of the same in accordance with
pertinent laws, regulations or policies on the matter.
Prior to EO 277, prosecution of illegal logging cases was difficult. The State has to prove
beyond reasonable doubt the various elements of the crime such as the cutting, gathering,
collecting, or removing timber from forest lands or from alienable and disposable land. In EO
277, mere possession of timber or forest product, without the legal documents consummates
the crime of illegal logging.
Likewise, EO 277 has authorized the DENR to conduct administrative confiscation
proceedings in illegal logging cases. In the case of Paat vs. Court of Appeals (1997), the
Supreme court has occasioned to rule that when an administrative confiscation has been
initiated by DENR, the court can no longer issue replevins, until such time that the
administrative proceedings are terminated. This has somehow cured the exasperating

experience before DENR forest officers who, risking lives and limb proceed with the detection,
apprehension and seizure of forest products or timber, only for these timber and forest
products to be released through the remedy of replevin.

B. LAW ON KAINGIN
Sec. 78 of PD 705, as amended, is the law on unlawful occupation or destruction of forest
lands and grazing lands. The law penalizes any person who enters and occupies or possesses,
or makes kaingin for his own private use or for others, any forest land or grazing land
without authority.
C. ROLE OF GOVERNMENT AGENCIES AND TENURE HOLDERS IN FOREST LAW
ENFORCEMENT
DENR

Under Section 5(k) of EO 192, DENR shall assume responsibility for the assessment,
development, protection, conservation, licensing, and regulation as provided for by the
law, where applicable, of all natural resources; the regulation and monitoring of
service contractors, licensees, lessees, and permittees for the extraction, exploration,
development and utilization of natural resources products.

LGUs
Under RA 7160 the following are the powers of LGUs:
General:
To share with national government the responsibility in the management and maintenance of
ecological balance within their territorial jurisdiction.
Specific:

For Cities and Municipalities

Pursuant to national policies and subject to supervision, control and review of the
DENR, implementation of community based forestry projects which include integrated
social forestry programs and similar projects which include integrated social forestry
programs and similar projects; management and control of communal forests with an
area not exceeding fifty (50) square kilometers; establishment of tree parks, greenbelts,
and similar forest development projects.

For Provinces
Pursuant to national policies and subject to supervision, control and review of the
DENR, enforcement of forestry laws limited to community-based projects, pollution
control law, small scale mining law, and other laws on the protection of the
environment; and mini- hydroelectric projects for local purposes.
From the above reading, one will note that many forestry projects should have been
devolved to cities and municipalities while forest law enforcement in community based
projects should have been the responsibility of provinces. Unfortunately, fifteen years
after RA 7160 was passed , devolution of forestry projects, even under supervision,
review and control of the DENR has not materialized, and no province as yet has been
chiefly in charge of forest law enforcement in community based projects.

DENR-DILG Joint Memorandum Circular 98-01and 2003-01 were issued to


implement the devolution and to form and strengthen the partnership between DENR
and the LGUs. Unfortunately, the devolution and partnerships have not been fully
implemented on the ground.

Other agencies having jurisdiction over forest lands


As jurisdictions have been conferred by law to these agencies (UPLB, ARMM,
National Power Corporation and others), management and control of these forest
lands are within their responsibilities. Unfortunately, there are reports on various
occasions to the effect that illegal logging and other forest destruction occur in such
areas.

Tenure Holders
Tenure holders are given long term access rights to forest lands usually for 25 years,
renewable for another 25 years.
One of the major responsibilities of tenure holders in forest lands such as (TLAs,
IFMA, CBFM, SIFMA) is to manage and protect their respective areas. In the case of
TLAs and IFMA holders, they are even required to employ professional foresters.
In the case of CBFM, Peoples Organizations (POs) are given the privilege to occupy,
possess, utilize an develop forest lands and its resources and to be entitled and to the
sustainable utilization of forest resources within their areas, but with corresponding
obligation to protect their areas.

D. COMMUNITY PARNERSHIP IN FOREST LAW ENFORCEMENT


The Multisectoral Forest Protection Committee (MFPC), is a product of the World
Bank assisted ENR- SECAL Program. As the term implies, MFPCs are composed of
membership from various sectors of society such as the church, youth, academe, police,
media, women, military, DENR, LGU, NGOs and other groups and has for its primary
objective the assistance to DENR in the fight against illegal logging.
From an initial target of 15 MFPCs in 1992, the program expanded to cover all regions,
provinces and municipalities. In 1995 and 199, DENR issued DAOs 95-17 and 96-39
institutionalizing the MFPC within the DENR system.
PEDO
Recently, the DILG through Secretary Angelo Reyes established a Police Environmental Desk
Officer in every police station.
IBP
The Integrated Bar of the Philippines, through its National Environmental Action Team
(NEAT) has likewise committed itself in the assisting the government in environmental law
enforcement.
Designating Special Prosecutors and Courts to Handle Illegal Logging Cases
The DOJ and the Supreme Court has designated special prosecutors and counts to handle
cases of illegal logging.
E. PRESENT INITIATIVES IN FOREST PROTECTION
General Program of Action (GPOA) of the DENR

In its 10 point program as stated in the GPOA, the DENR has identified Enforcement of
environment of environmental rules and natural resources regulation s as its number one
priority . This include programs and projects on anti-illegal logging operations, protection
from fire, pest and diseases, encroachment and illegal resource extraction, resolution of land
cases, conflicts and fake titles and wildlife enforcement.
Forest Law Enforcement Group (FPLEG) Program
The FPLEG is a World Bank assisted program designated to curb illegal timber trade East
Asia. It had its Customs and Law Enforcement Workshop last November 28-30, 2006 in Cebu
City.
Criteria and Indicators under the International Timber Organization
The C and 1 Project of the ITTO is designed to measure sustainable forest management in the
field. Changes in forest cover and other forestry activities are measured on a regular basis.
EcoGov 2, through its forestry component, it also involved in forest law enforcement.
IV. ISSUES AND RECOMMENDATIONS TO IMPROVE FOREST LAW ENFORCEMENT
A. STRENGTHEN DENR FOREST LAW ENFORCEMENT CAPABILITY
From interviews, the following have been identified as factors affecting DENRs effectiveness
in forest law enforcement:

Absence of unified environmental law enforcement mechanism.


Accordingly, while DENR has major concerns such as forestry, mining, environment
and clean air, environmental law enforcement is fragmented.

Lack of resources

DENRs budget has actually declined during the last five years. Presently, each forest
guard is still guarding 4,000 ha with a measly P50.00-P100.00 traveling allowance per
month.

Lack of DENRs surveillance equipment


Since forest areas are far flung, DENR needs effective surveillance equipment such as
helicopters and small planes.

Weak DENR Legal Support


To strengthen the DENR Legal Service will include training, computerization of the
legal department and incentive schemes for lawyers to enter and stay in the DENR.

Lack of the Forest Management Bureaus involvement forest law enforcement.

While FMB has become a staff Bureau, its personnel to include its lawyers may be used
For forest law enforcement operations.
B. STRENGTHEN MPFCs AND PARNERTSHIP WITH OTHER SECTORS
The MFPCs have proved to be cost effective partner of the DENR in forest protection. To
a large extent, MFPCs have been credited to be responsible in the dismantling of big

time illegal logging in Regions 2, 4, 8, 9, 10 and 11 in the early 90s. This is because if
the selection process for MPFC members is followed, the MFPCs bring to the fore of
forest protection the stature and commitment of its members. DENR must remember
however, that MFPC members are just volunteers and it is incumbent for the DENR to
provide the necessary logistics, leadership and most especially.
C. STRENGTHEN AND INSTITUTIONALIZE LGU INVOLVEMENT IN FOREST
LAW ENFORCEMENT
The laws (RA 7160) and regulations (DENR-DILG JMCs 98-01 and 2003-01) on
devolution of forest management functions to LGUs and partnership with DENR are
already in place. Unfortunately, LGU involvement in forest management and forest law
enforcement is still isolated. These are usually in places where there are foreign assisted
projects or where the LGUs themselves are environmental champions.
It is important to note however that the LGUs are among the real stakeholders of the
forests since they are exactly in said areas. Given the existing laws and regulations, the
corporate powers of LGUs, involving them in forest management and forest law
enforcement will definitely be a big boost to forest law enforcement.
D. GIVE TENURE HOLDERS DUE PROCESS PRIOR TO SUSPENSION OR
REVOCATION
Another major issue in forest law enforcement is the practice of DENR to suspend
validly issued tenure instruments or rights arising there from without due process.
In various forums, the wood industry has complained about their difficulty in investing
in forestry as they fear that DENR without due process would suspend or cancel their
operations. Of late, the CBFM program has been much affected because the DENR has
suspended the issuance of resource use permits of the entire program on the findings
that some POs have violated their tenure instruments. The suspensions however came
about without affording due process to the tenure holders.
Aside from its negative impacts on the program itself (IFMA, SIFMA, CBFM), this
situation is inimical to forest law enforcement as when the areas become open access,
then the forest area will be subject to timber poaching and other illegal forestry
activities.
