laws of the state of Texas and may be served with process through the City Manager, Sheryl
Sculley, City Hall, 100 Military Plaza, San Antonio, Texas 78205.

Venue in Bexar County is proper in this cause under Section 15.002(a)(1) of the
Texas Civil Practice and Remedies Code because it is the county where a substantial part of the
events giving rise to claim occurred.
7.
Pursuant to Tex. R. Civ. P. 47, this is a cause of action that exceeds $1,000,000.00
governmental unit named as a Defendant have been complied with or have occurred.
Specifically, the defendant CITY OF SAN ANTONIO had actual notice of this claim and
injuries to the Plaintiffs,' as the vehicle involved in the collision was owned by said Defendant.
FACTS
9.
BALDWIN, were passengers in a silver Chrysler Sebring, traveling east bound on E. Houston
Street, in Bexar County, Texas. Defendant, JOHN DOE, was operating a 2013 Black Lincoln
Navigator, LP# CPY-8002, VIN# 5LMJJ2H58DEL08368, owned by Defendant, CITY OF
SAN ANTONIO, and was traveling north bound on North Hackberry Road. Defendant, JOHN
DOE, suddenly and without warning disregarded a red light for his lane of travel and collided
into the vehicle containing the Plaintiffs. As a result of this collision, Plaintiffs sustained severe

injuries and damages to their bodies, as more fully set forth below.

The occurrence made the basis of this suit, reflected above, and the resulting
injuries and damages were proximately caused by the negligent conduct of the Defendants.
NEGLIGENCE
DEFENDANTS, CITY OF SAN ANTONIO AND JOHN DOE
11.
The occurrence made the basis of this suit, and the resulting injuries and damages
to Plaintiffs, were proximately caused by the negligent conduct of Defendants. Defendant JOHN
DOE operated the SUV he was driving in a negligent manner because he violated the duty which
he owed the Plaintiffs to exercise ordinary care in the operation of his motor vehicle in one or
more of the following respects:
a.
in failing to keep a proper lookout or such lookout which a person of ordinary prudence
would have maintained under same or similar circumstances;
b.
in failing to timely apply the brakes of the vehicle in order to avoid the collision in
question;
c.
d.
e.
in operating his vehicle at a rate of speed which was greater than that which an ordinary
person would have driven under the same or similar circumstances;
f.
in disregarding an official traffic control device in violation of Tex. Transp. Code
Sec. 544.004 and 544.007(d).

Negligence per se tort claims are established when a plaintiff shows that a
defendant violates a statute or ordinance setting an applicable standard of care if the statute is
designed to prevent an injury to that class of persons to which the injured party belongs. In that
regard, Defendant JOHN DOE's conduct constitutes negligence per se because he failed to
exercise the mandatory standard of care set forth in Tex. Transp. Code 545.351, which

mandates that:
(a)
An operator may not drive at a speed greater than is reasonable and prudent under the
circumstances then existing.
(b)
An operator:
(1)
may not drive a vehicle at a speed greater than is reasonable and prudent under the
conditions and having regard for actual and potential hazards then existing; and
(2)
shall control the speed of the vehicle as necessary to avoid colliding with another person
or vehicle that is on or entering the highway in compliance with the law and the duty of each
person to use due care.
(c)
An operator shall, consistent with Subsections (a) and (b), drive at an appropriate reduced
speed if:
(1)
the operator is approaching and crossing an intersection or railroad grade crossing;
(2)
the operator is approaching and going around a curve;
(3)
the operator is approaching a hill crest;
(4)
the operator is traveling on a narrow or winding roadway; and
(5)
a special hazard exists with regard to traffic, including pedestrians, or weather or
highway conditions.

to exercise the mandatory standard of care set forth in Tex. Transp. Code Sec. 544.004 and
544.007(d), which mandates that:
(a) The operator of a vehicle or streetcar shall comply with an applicable official traffic-control
device placed as provided by this subtitle unless the person is:
(1) otherwise directed by a traffic or police officer; or
(2) operating an authorized emergency vehicle and is subject to exceptions under this subtitle.
(b) A provision of this subtitle requiring an official traffic-control device may not be enforced
against an alleged violator if at the time and place of the alleged violation the device is not in
proper position and sufficiently legible to an ordinarily observant person. A provision of this
subtitle that does not require an official traffic-control device is effective regardless of whether a
device is in place;
(d) An operator of a vehicle facing only a steady red signal shall stop at a clearly marked stop
line. In the absence of a stop line, the operator shall stop before entering the crosswalk on the
near side of the intersection. A vehicle that is not turning shall remain standing until an
indication to proceed is shown. After stopping, standing until the intersection may be entered
safely, and yielding right-of-way to pedestrians lawfully in an adjacent crosswalk and other
traffic lawfully using the intersection, the operator may:
(1) turn right; or

(2) turn left, if the intersecting streets are both one-way streets and a left turn is permissible.
14.
respondeat superior in that Defendant JOHN DOE was acting within the course and scope of his
employment with the CITY OF SAN ANTONIO, at the time the incident occurred.

negligent entrustment;

negligent retention;

negligent maintenance.

negligently entrusted the vehicle to JOHN DOE, when it knew or should have known that JOHN
DOE was an incompetent or reckless driver.

subjective awareness of the risk involved in the above described acts or omissions, but
nevertheless proceeded with conscious indifference to the rights, safety, or welfare of Plaintiffs
and others similarly situated. Accordingly, Defendants conduct constitutes gross negligence as
that term is defined in Section 41.001(11) Texas Civil Practice and Remedies Code. Therefore,
Plaintiffs sue for exemplary damages in an amount to be determined at trial.

Defendants were heedless and reckless, constituting an extreme degree of risk, considering the
probability and magnitude of the potential harm to others, and Defendants were aware of the risk
but nevertheless proceeded with conscious indifference to the rights, safety, and welfare of
others, including Plaintiff. The above acts and/or omissions were singularly and cumulatively
the proximate cause of the occurrence in question and the resulting injuries and damages

back, and other parts of her body generally. Her entire body was bruised, battered and contused
and she suffered great shock to her entire nervous system. The injuries are permanent in nature.
The injuries have had a serious effect on the Plaintiff's health and well-being. Some of the
effects are permanent and will abide with the Plaintiff for a long time into the future, if not for

her entire life. These specific injuries and their ill effects have, in turn, caused the Plaintiff
physical and mental condition to deteriorate generally and the specific injuries and ill effects
alleged have caused and will, in all reasonable probability, caused the Plaintiff to suffer
consequences and ill effects of this deterioration throughout her body for a long time in the
future, if not for the balance of her natural life. As a further result of the nature and consequences
of their injuries, the Plaintiff has suffered great physical and mental pain, suffering and anguish
and in all reasonable probability, will continue to suffer in this manner for a long time into the
future, if not for the balance of her natural life.

As a direct and proximate result of the collision and the negligent conduct of
Defendants, Plaintiff, TOMEKIA BALDWIN, suffered severe bodily injuries to her head, neck,
back, and other parts of her body generally. Her entire body was bruised, battered and contused
and she suffered great shock to her entire nervous system. The injuries are permanent in nature.
The injuries have had a serious effect on the Plaintiff's health and well-being. Some of the
effects are permanent and will abide with the Plaintiff for a long time into the future, if not for
her entire life. These specific injuries and their ill effects have, in turn, caused the Plaintiff
physical and mental condition to deteriorate generally and the specific injuries and ill effects
alleged have caused and will, in all reasonable probability, caused the Plaintiff to suffer
consequences and ill effects of this deterioration throughout her body for a long time in the
future, if not for the balance of her natural life. As a further result of the nature and consequences
of their injuries, the Plaintiff has suffered great physical and mental pain, suffering and anguish
and in all reasonable probability, will continue to suffer in this manner for a long time into the
future, if not for the balance of her natural life. As a direct and proximate result of the collision
and the negligent conduct of Defendants, Plaintiff, TOMEKIA BALDWIN, has suffered
permanent brain damage and severe cognitive insults, resulting in a total loss of bodily function.

Additionally, as a direct and proximate result of the occurrence made the basis of

this lawsuit, Plaintiffs, TOMEKIA BALDWIN and AJUANA BALDWIN, were caused to incur
the following additional damages:

Pursuant to Rule 193.7 TRCP, Defendants are hereby placed on notice that the
production of any document in response to written discovery authenticates the document for use
against that party in any pre-trial proceedings or trial.
JURY DEMAND

In accordance with Rule 216 of the Texas Rules of Civil Procedure, Plaintiffs
hereby make an application for a jury trial and request that this cause be set on the Courts Jury
Docket. Plaintiffs acknowledge payment this date of the required jury fee.

for temporary injunction and in connection therewith, presents a motion for a temporary
restraining order together with an affidavit supporting the motion presented.

employees or anyone acting in concert therewith, are immediately deterred from taking any
action that might alter, damage or destroy the 2013 Black Lincoln Navigator, LP# CPY-8002,
VIN# 5LMJJ2H58DEL08368 involved in the April 18, 2015, collision at East Houston and
North Hackberry, and its component parts to include electronic control module and any data
already downloaded from the electronic control module involved in the incident on April 18,
2015, any video recording device on-board the vehicle, and any other evidence, to include, but
not limited to, blood, urine, blood and urinanalysis tests, results, reports, etc. of Defendants, they
will not commit said acts before notice of the hearing for a temporary injunction can be served
and hearing had; that if the commission of said acts are not immediately restrained, Plaintiffs will
suffer irreparable injury, to wit: Defendants repair, removal, destruction, disposal, inspection or
testing of the evidence involved herein may destroy or severely alter the condition of the
evidence and prevent Plaintiff from asserting the right to inspect or test the evidence as provided
by the Texas Rules of Civil Procedure.

action that might alter, damage or destroy any cellular phone or other hand-held device in the
possession of Defendants, at the time of the collision on April 18, 2015, including any GPS
tracking device on that cellular phone or other hand-held device or any downloaded information

relating to any GPS tracking device or system on that cellular phone or hand-held device, GPS
tracking device on the Lincoln Navigator or any downloaded information relating to any GPS
tracking device or system on the Lincoln Navigator, any and all operational or trip related
documents created or received by Defendants, CITY OF SAN ANTONIO and JOHN DOE, to
include any trip tickets, daily logs, record of JOHN DOES duty status, payment of services,
JOHN DOES Qualification File and Personnel File as required by any applicable regulations for
Defendant, CITY OF SAN ANTONIO, all maintenance records, repair reports and any other
document related to repairs or maintenance of the Lincoln Navigator involved in the incident on
April 18, 2015, and any other documents, reports, or memoranda related to this incident, it will
not commit said acts before notice of the hearing on the Motion for a temporary injunction can
be served and hearing had; that if the commission of said acts are not immediately restrained,
Plaintiffs will suffer irreparable injury.

Court order that Defendants, CITY OF SAN ANTONIO and JOHN DOE, their agents, servants,
employees or anyone having knowledge of this order are hereby commanded forthwith to desist
and refrain from the following:

Taking any action that might alter, damage or destroy the Lincoln Navigator
involved in the April 18, 2015, collision and its component parts to include electronic control
module and any data already downloaded from the electronic control module involved in the
incident on April 18, 2015, any video recording device on-board the vehicle, and any other
evidence to include, but not limited to, blood, urine, blood and urinanalysis tests, results, reports,
etc. of Defendant JOHN DOE; and
6.
Taking any action that might alter, damage or destroy any and all cellular phone
or other hand-held device in the possession of Defendants, CITY OF SAN ANTONIO and

JOHN DOE, at the time of the collision on April 18, 2015, including any GPS tracking device on
that cellular phone or other hand-held device or any downloaded information relating to any GPS
tracking device or system on that cellular phone or other hand-held device, any GPS tracking
device on the Lincoln Navigator or any downloaded information relating to any GPS tracking
device or system on vehicle; and
7.
Taking any action that might alter, damage or destroy any and all operational or
trip related documents created or received by Defendant, CITY OF SAN ANTONIO and JOHN
DOE, to include any trip tickets, daily logs, record of JOHN DOES duty status, payment of
services, JOHN DOES Qualification File and Personnel File as required by any applicable
regulations for Defendant, CITY OF SAN ANTONIO; and
8.
Taking any action that might alter, damage or destroy any maintenance records,
repair reports and any other document related to repairs or maintenance of the Lincoln Navigator
involved in the April 18, 2015, collision, and any other documents, reports, or memoranda
related to this incident or involved in the incident on April 18, 2015, and any other documents,
reports, or memoranda related to this incident.
