Our Summary of the Ministry of


Justice Code of Practice for Victims of
Crime
This is the statutory code which sets
out the minimum level of service
victims should receive from criminal
justice agencies. The Victims Code
applies to all criminal justice
agencies, including the Police, Crown
Prosecution Service, Courts Service,
and providers of the Probation
Service. It sets out what each agency
must do for victims, and the
timeframe in which they must do it. It
tells victims what they can expect and
allows them to hold the system to
account
The service to which victims are entitled
includes:
An assessment of your needs.
An explanation, and written
information, on what to expect from the
Criminal Justice System, such as the
Information for Victims of Crime
leaflet or the details of a website with
the information.
Agreement on how often you will
receive updates on the status of your
investigation.
Updates at key stages, for example, if
a suspect is arrested, interviewed
under caution, released with no further
action, released on police bail or
charged, within five working days or
one day for enhanced service.
An explanation of a decision not to
investigate a crime within five working
days, or one day for enhanced service.
Advice when an investigation into a
case has been concluded with no-one
being charged and to have the
reasons explained within five working
days, or one day for enhanced service.
Be referred to organisations supporting
victims of crime and information about
victims services including contacts so
you can access their support any time.
An explanation that if you are making a
witness statement this may result in
you needing to give evidence at court
if the case goes to trial.
Help to make a Victim Personal
Statement at the same time as making
a witness statement. A VPS gives you
an opportunity to explain in your own
words how a crime has affected you
and gives you a voice at court.
The dates of all criminal hearings and
of any requirement to give evidence if
the case goes to court.
Notification of the outcome of a case
and an explanation of the meaning and
effect of the sentence.
An enhanced service if you are a
victim of the most serious crimes,
persistently targeted or vulnerable or
intimidated.
The freedom, at any time, to opt out of
receiving services under the Victims
Code, or to opt back in again.
