FACTS:
Corales was the Mayor of Nagcarlan, Laguna for three
consecutive terms.
First term: Appointed Dr. Angeles to the position of
Municipal Administrator, whose appointment was
unanimously approved by the Sangguniang Bayan
Second and third terms: Renewed the appointment of
Dr. Angeles, but the Sangguniang Bayan disapproved
Dr. Angeles appointment. Even so, petitioner Dr.
Angeles continued to discharge the functions and
duties of a Municipal Administrator for which he
received an annual salary.
Following an audit, Andal, the Provincial State Auditor of
Laguna, issued an Audit Observation Memorandum
addressed to petitioner Corales who was asked to
comment/reply. The aforesaid AOM, in sum, states that:
1.)
Dr.
Angeles
appointment
as
Municipal
Administrator (during the second and third terms of
Corales) was without legal basis;
2.) Dr. Angeles can be considered as a de facto
officer entitled to the emoluments of the office for
the actual services rendered;
3.) It is not the Municipality of Nagcarlan that should
be made liable to pay for Dr. Angeles salary; instead,
it is Corales
4.) Corales should be liable to pay P1.2M+, as shown
by a post audit of payrolls
5.) it is recommended that an appropriate Notice of
Disallowance be issued for the payment of salary
expenses incurred without legal basis by the
Municipality of Nagcarlan
