FLEET SAFETY PROGRAM

The intent of this program is to ensure the safety of company employees, to protect
drivers, vehicles and equipment of the company as well as to protect the public. The
policies set forth in this program are to be followed by all company employees.
These policies are designed to follow the requirements of the Federal Motor Carrier
Safety Regulations CFR Title 49 for Transportation. These policies only outline some
of the requirements for drivers. All drivers must obey state and federal driving laws in
addition to the rules described in this program.

I. HIRING PROCEDURES FOR DRIVERS
A. We strive to create safe and healthful working conditions for all employees at and
away from the workplace; this includes driving all company vehicles. We have set
certain DOT qualifications to ensure that only qualified individuals can drive
company vehicles. Company vehicles include but are not limited to trucks, fork
lifts, skid loaders, boom trucks, cranes and so forth. The following qualifications
must be met to be considered as a potential driver for the company:
i. Minimum age requirement of 21 years old
ii. A valid U.S. drivers license
iii. Ability to obtain CDL if needed:
iv. Back ground checks on:
a. Motor Vehicle Record (MVR)
1. If the MVR shows any of the following the applicant will be disqualified
from driving any SG vehicles:
2. DUI within the past (3) years
3. Implied Consent Refusal
4. Drug related offense
5. Reckless/Careless offense
6. Negligent vehicular homicide
7. Felony using a motor vehicle
8. Driving on a revoked or suspended license
9. Leaving the scene of an accident
10. Fleeing an officer.
Note: Any perspective employee who has had a statutory or major
violation in the last 3 years agrees to complete a “Safe Driver Course”
or a “Defensive Driving Course” as prescribed by HR

v. Past employment
vi. Can pass the Companies Drug and Alcohol screening
vii. Have or can attain an updated Department of Transportation Health card
viii. Complete a walk around inspection and road test as prescribed by HR.

II. VEHICLE INSPECTIONS AND REPORTING

A. Every vehicle shall be systematically inspected, repaired, and maintained. Parts


and accessories shall be in a safe and proper operating condition at all times.
These include parts and accessories which may affect safety of operation,
including but not limited to, frame and frame assemblies, suspension systems,
axles and attaching parts, wheels and rims, and steering systems. For vehicles
controlled for 30 consecutive days or more, the following records for each vehicle
shall be maintained:

i. An identification of the vehicle including company number, if so marked, make,


serial number and year. In addition, if the motor vehicle is not owned by the
company, the record shall identify the name of the person furnishing the
vehicle

ii. A record of inspection, repairs and maintenance indicating their date the
nature of repair.

B. Driver Vehicle Inspection Reports

i. Every driver shall prepare a report in writing at the completion of each day’s
work on each vehicle operated and the report shall cover at least the following
parts and accessories.

1. Service brakes including trailer brake connections

2. Parking (hand) brake

3. Steering mechanism

4. Lighting devices and reflectors

5. Tires

6. Horn

7. Windshield wipers

8. Rear vision mirrors

9. Coupling devices

10. Wheels and rims

11. Emergency equipment

12. Wind shield glass and windows

13. Trailer

14. Tie downs and load securement

III. Maintenance

A. The vehicle inspection report shall identify the vehicle and list any defects or
deficiencies discovered by, or reported to, the driver which would affect the safe
operation of the vehicle or result in its mechanical breakdown. If no defect or
deficiency is discovered by or reported to the driver, the report shall so indicate.
In all instances, the driver shall sign the report. On two-driver operations, only
one driver needs to sign the driver vehicle inspection report, provided both
drivers agree as to the defects or deficiencies identified. If a driver operates more
than one vehicle during the day, a report shall be prepared for each vehicle
operated.

B. Corrective Action

i. Prior to requiring or permitting a driver to operate a vehicle, every motor carrier


or its agent shall repair any defect or deficiency listed on the driver vehicle
inspection report which would be likely to affect the safety of operation of the
vehicle. Every motor carrier or its agent shall certify on the original driver
vehicle inspection report which lists any defect or deficiency that the defect or
deficiency has been repaired or that repair is unnecessary before the vehicle
is operated again. The original report must be maintained at the office with

the certification of repairs, and the certification of the driver’s review for three
months from the date the written report was prepared.

IV. Driver’s Record of Duty Status. (Log books),

A. Every driver who operates a commercial motor vehicle shall record his/her duty
status, in duplicate, for each 24 hour period. The duty status time shall be
recorded on a specified grid; this section may be combined with any company
forms.

B. The logs must be turned in every week to the office.

C. The duty status shall be recorded as follows:

i. “Off duty” or “OFF.”

ii. “Driving” or “D.”

iii. “On duty not driving” or “ON.”

D. For each change of duty status (e.g., the place of reporting for work, starting to
drive, on duty not driving and where released from work), the name of the city,
town or village, with State abbreviation, shall be recorded.

i. If a change of duty status occurs at a location other than a city, town, or


village, show one of the following: (1) the highway number and nearest
milepost followed by the name of the nearest city, town, or village and State
abbreviation, (2) the highway number and the name of the service plaza
followed by the name of the nearest city, town, or village and State
abbreviation, or (3) the highway numbers of the nearest two intersecting
roadways followed by the name of the nearest city, town, or village and State
abbreviation. The following information must be included on the form in
addition to the grid:

1. Date;

2. Total miles driving today;

3. Truck or tractor and trailer number;

4. Name of carrier;

5. Driver’s signature/certification;

6. 24 hour period starting time (e.g., midnight, 9:00 a.m., noon, 3:00 p.m.);

7. Main office address;

8. Remarks;

9. Total hours (far right edge of grid)

ii. Failure to complete the record of duty activities of this section or failure to
preserve a record of such duty activities, or making of false reports in
connection with such duty activities shall make the driver and or the company
liable to prosecution.

iii. The driver’s activities shall be recorded in accordance with the following
provisions:

1. Entries to be current. Drivers shall keep their record of duty status current
to the time shown for the last change of duty status.

2. Entries made by driver only. All entries relating to driver’s duty status must
be legible and in the driver’s own handwriting.

3. Date. The month, day and year for the beginning of each 24 hour period
shall be shown on the form containing the driver’s duty status record.

4. Total miles driving today. Total mileage driven during the 24 hour period
shall be recorded on the form containing the driver’s duty status record.

5. Commercial motor vehicle identification. The driver shall show the number
assigned by the motor carrier or the license number and licensing State of
each commercial motor vehicle operated during each 24-hour period on
his/her record of duty status. The driver of an articulated (combination)
commercial motor vehicle shall show the number assigned by the motor
carrier, or the license number and licensing State of each motor vehicle
used in each commercial motor vehicle combination operated during that
24-hour period on his/her record of duty status.

6. Name of motor carrier. The name(s) of the motor carrier(s) for which work
is performed shall be shown on the form containing the driver’s record of
duty status. When work is performed for more than one motor carrier
during the same 24-hour period, the beginning and finishing time, showing
a.m. or p.m., worked for each motor carrier shall be shown after each
motor carrier’s name. Drivers of leased commercial motor vehicles shall
show the name of the motor carrier performing the transportation.

7. Signature/certification. The driver shall certify to the correctness of all


entries by signing the form containing the driver’s duty status record with
his/her legal name or name of record. The driver’s signature certifies that
all entries required by this section made by the driver are true and correct.

8. Time base to be used 70 HOURS 8 DAYS RULE

E. The following are the regulations pertaining to the filing of the log:

i. The driver’s duty status record shall be prepared, maintained, and submitted
using the time standard in effect at the driver’s home terminal, for a 24 hour
period beginning with the time specified by the motor carrier for that driver’s
home terminal.

ii. The term “7 or 8 consecutive days” means the 7 or 8 consecutive 24 hour
periods as designated by the carrier for the driver’s home terminal.

iii. The 24 hour period starting time must be identified on the driver’s duty status
record. One hour increments must appear on the graph, be identified, and
preprinted. The words “Midnight” and “Noon” must appear above or beside
the appropriate one hour increment.

iv. Main office address. The motor carrier’s main office address shall be shown
on the form containing the driver’s duty status record.

v. Recording days off duty. Two or more consecutive 24 hour periods off duty
may be recorded on one duty status record.

vi. Total hours. The total hours in each duty status: off duty other than in a
sleeper berth; off duty in a sleeper berth; driving, and on duty not driving, shall
be entered to the right of the grid, the total of such entries shall equal 24
hours.

vii. Shipping document number(s) or name of shipper and commodity shall be


shown on the driver’s record of duty status.

viii. Graph grids. The following graph grid must be incorporated into a motor
carrier recordkeeping system which must also contain the information
required in paragraph (d) of this section.

ix. Graph Grid Preparation. The graph grid may be used horizontally or vertically
and shall be completed as follows:

x. Off duty. Except for time spent resting in a sleeper berth, a continuous line
shall be drawn between the appropriate time markers to record the period(s)
of time when the driver is not on duty, is not required to be in readiness to
work, or is not under any responsibility for performing work.

xi. Driving. A continuous line shall be drawn between the appropriate time
markers to record the period(s) of driving time as defined in 395.2.

xii. On duty not driving. A continuous line shall be drawn between the appropriate
time markers to record the period(s) of time on duty not driving specified in
395.2

xiii. Location - Remarks. The name of the city, town, or village, with State
abbreviation where each change of duty status occurs shall be recorded.

xiv. Filing driver’s record of duty status. The driver shall submit or forward by mail
the original driver’s record of duty status to the regular employing motor
carrier within 7 days following the completion of the form.

xv. The driver shall retain a copy of each record of duty status for the previous 7
consecutive days which shall be in his/her possession and available for
inspection while on duty.

xvi. The graph grid, when incorporated as part of any form used by a motor
carrier, must be of sufficient size to be legible.

V. Annual Inspection

A. The company shall not use a commercial motor vehicle unless each component
identified in Appendix G of the Federal Motor Carrier Safety Administration has
passed an inspection in accordance with the terms of this section at least once
during the preceding 12 months and documentation of such inspection is on the
vehicle. The documentation may be:

i. The inspection report prepared in accordance with paragraph 396.21(a), or

ii. Other forms of documentation, based on the inspection report (e.g., sticker or
decal), which contains the following information:

a. The date of inspection

b. Name and address of the motor carrier or other entity where the inspection
report is maintained

c. Information uniquely identifying the vehicle inspected if not clearly marked


on the motor vehicle

d. A certification that the vehicle has passed an inspection in accordance with


396.17.

B. In lieu of the self inspection provided for in paragraph (d) of this section, the
company may choose to have a commercial garage, fleet leasing company, truck
stop, or other similar commercial business perform the inspection as its agent,
provided that business operates and maintains facilities appropriate for
commercial vehicle inspections and it employs qualified inspectors.

C. Vehicles passing roadside or periodic inspections performed under the auspices


of any State government or equivalent jurisdiction or the FMCSA, meeting the
minimum standards contained in Appendix G of this subchapter, will be
considered to have met the requirements of an annual inspection for a period of
12 months commencing from the last day of the month in which the inspection
was performed, except as provided in 396.23(b)(1).

D. It shall be the responsibility of the company to ensure that all parts and
accessories not meeting the minimum standards set forth in Appendix G to this
subchapter are repaired promptly.

VI. ACCIDENT PROCEDURES (The following section is taken from Part 390 of the
Federal Motor Carrier Safety Regulations).

A. Accident means:

i. An occurrence involving any company vehicle operating which results in:

a. A fatality;

b. Bodily injury to a person who, as a result of the injury, immediately
receives medical treatment away from the scene of the accident; or

c. When one or more motor vehicles sustain any damage.

ii. The term accident does not include:

a. An occurrence involving only boarding and alighting from a stationary


motor vehicle

b. An occurrence involving only the loading or unloading of cargo.

B. IN CASE OF AN ACCIDENT: FOLLOW THE CLAIMS MANAGEMENT


PROCESS

i. AID THE INJURIED.

ii. Call for medical assistance if necessary; 911.

iii. SECURE THE SCENE.

a. Move to the side of the roadway

b. Set up traffic control

iv. CALL THE POLICE

a. ALL ACCIDENTS

x. DO NOT CLAIM FAULT

a. ONLY DISCUSS THE ACCIDENT WITH THE POLICE.

b. DO NOT ARGUE WITH ANYONE AT THE SCENE.

xi. IMMEDIATELY CALL MANAGEMENT AT :

i. OFFICE #

ii. CELL#

xii. TURN ACCIDENT REPORT INTO THE OFFICE, THAT SHIFT OR WITHIN
12 HOURS OF THE ACCIDENT.

VII. ACCIDENT REGISTER

A. The company will maintain an accident register for a period of one year after
the date of each accident. Information placed in the accident register will contain
the following:
i. A list of accidents as defined by 390.5 for each accident:
a. Date of accident.
b. City or town, or most near, where the accident occurred and the State
where the accident occurred.
c. Driver Name.
d. Number of injuries.
e. Number of fatalities.
f. Whether hazardous materials, other than fuel spilled from the fuel tanks
of motor vehicle involved in the accident, were released.

ii. Copies of all accident reports required by State or other governmental entities
or insurers.

VIII. DRIVER SAFETY RULES
A. The use of a company vehicle while under the influence of drugs and alcohol is
strictly forbidden and is sufficient cause for discipline up to and including
dismissal.
B. No driver shall operate a company vehicle when their ability to do so has been
impaired by illness, fatigue, injury or prescription medications.
C. All drivers and passengers operating or riding in company vehicles must wear
seat belts.
D. No unauthorized personnel are allowed to ride in company vehicles.
E. Drivers are responsible for securing company vehicle. The vehicle engine should
never be running unattended, the ignition keys shall be removed and the doors
locked.
F. Always ensure that loads are secured to prevent movement. Check loads again
after traveling some distance.
G. No unauthorized drivers shall driver any company vehicles.
H. Company vehicles are to only be used for company business; personal use of
company vehicles is only allowed with prior approval by management.
I. All drivers must obey state, local and federal laws.
J. Do not use a cell phone while driving.
K. You are driving a company vehicle, drive defensively, if you are careless or
reckless you may lose your right to drive which means you could lose your job.
