Thecopyrightownermayelect,atanytimebeforefinaljudgmentisrendered,torecoverinsteadofactual
damagesandprofits,anawardofstatutorydamagesforallinfringementsinvolvedinanactioninasum
equivalenttothefilingfeeoftheinfringementactionbutnotlessthanFiftythousandpesos
(Php50,000.00).Inawardingstatutorydamages,thecourtmayconsiderthefollowingfactors:
(1)Thenatureandpurposeoftheinfringingact;
(2)Theflagrancyoftheinfringement;

(3)Whetherthedefendantactedinbadfaith;
(4)Theneedfordeterrence;
(5)Anylossthattheplaintiffhassufferedorislikelytosufferbyreasonoftheinfringement;and
(6)Anybenefitshowntohaveaccruedtothedefendantbyreasonoftheinfringement.
Incasetheinfringerwasnotawareandhadnoreasontobelievethathisactsconstituteaninfringementof
copyright,thecourtinitsdiscretionmayreducetheawardofstatutorydamagestoasumofnotmorethan
Tenthousandpesos(Php10,000.00):Provided,Thattheamountofdamagestobeawardedshallbedoubled
againstanypersonwho:
(i)Circumventseffectivetechnologicalmeasures;or
(ii)Havingreasonablegroundstoknowthatitwillinduce,enable,facilitateorconcealtheinfringement,
removeoralteranyelectronicrightsmanagementinformationfromacopyofawork,soundrecording,or
fixationofaperformance,ordistribute,importfordistribution,broadcast,orcommunicatetothepublic

216.2.Inaninfringementaction,thecourtshallalsohavethepowertoordertheseizureandimpounding
ofanyarticlewhichmayserveasevidenceinthecourtproceedings,inaccordancewiththerulesonsearch
andseizureinvolvingviolationsofintellectualpropertyrightsissuedbytheSupremeCourt.(Sec.28,P.D.

Theforegoingshallnotprecludeanindependentsuitforreliefbytheinjuredpartybywayofdamages,

SEC.23.Section217.2.ofRepublicActNo.8293herebyamendedtoreadasfollows:
217.2.Indeterminingthenumberofyearsofimprisonmentandtheamountoffine,thecourtshall
considerthevalueoftheinfringingmaterialsthatthedefendanthasproducedormanufacturedandthe
damagethatthecopyrightownerhassufferedbyreasonoftheinfringement:Provided,Thattherespective
maximumpenaltystatedinSection217.1.(a),(b)and(c)hereinforthefirst,second,thirdandsubsequent

practicable,notifytheownerofthecopyrightinquestionorhisauthorizedagentoftheseizureordetention,
asthecasemaybe.
SEC.26.Section226ofRepublicActNo.8293isherebyamendedtoreadasfollows:
SEC.226.Damages.NodamagesmayberecoveredunderthisActafterthelapseoffour(4)yearsfrom
thetimethecauseofactionarose.(Sec.58,P.D.No.49).
SEC.27.ChapterXXofRepublicActNo.8293isherebyamendedbyaddinganewsectionattheendthereofto
bedenominatedasSection230,toreadasfollows:
SEC.230.AdoptionofIntellectualProperty(IP)Policies.Schoolsanduniversitiesshalladopt
intellectualpropertypoliciesthatwouldgoverntheuseandcreationofintellectualpropertywiththe
purposeofsafeguardingtheintellectualcreationsofthelearninginstitutionanditsemployees,and
adoptinglocallyestablishedindustrypracticefairuseguidelines.Thesepoliciesmaybedevelopedin
relationtolicensingagreementsenteredintobythelearninginstitutionwithacollectivelicensing
organization.
SEC.28.Section230ofRepublicActNo.8293isherebyrenumberedasSection231,andallsucceedingsections
ofthesameActareherebyrenumberedaccordingly.
SEC.29.ImplementingRulesandRegulations.Withinonehundredeighty(180)daysfromtheeffectivityofthis
Act,theIntellectualPropertyOffice,inconsultationwiththeNationalBookDevelopmentBoard,theNational
Library,theSupremeCourtLibraryandotherrelevantagencies,shallpromulgatetherulesandregulations
necessarytoeffectivelyimplementtheprovisionsofthisAct.

SEC.30.RepealingClause.Alllaws,decrees,executiveorders,issuancesorregulationsinconsistentwiththe
provisionsofthisActareherebyrevisedoramendedaccordingly.
SEC.31.SeparabilityClause.IfanypartofthisActisdeclaredunconstitutionalorinvalid,suchpartsor
provisionsthereofnotsodeclaredshallremainvalidandsubsisting.
SEC.32.EffectivityClause.ThisActshalltakeeffectfifteen(15)daysafteritspublicationinatleasttwo(2)
newspapersofgeneralcirculation.
