prudentmantobelievethatanoffensehasbeencommittedbythepersonsoughttobearrested.
Fortheissuanceofasearchwarrant:
Probablecausewouldmeansuchfactsandcircumstanceswhichwouldleadareasonablydiscreet
andprudentmantobelievethatanoffensehasbeencommittedandthattheobjectssoughtin
connectionwiththeoffenseareintheplacetobesearched.
Note:ProbablecausefortheissuanceofasearchwarrantdoesNOTrequirethattheprobable
guiltofaspecificoffenderbeestablished,unlikeinthecaseofawarrantofarrest.

ExistenceofprobablecauseDETERMINEDPERSONALLYBYTHEJUDGE
ThejudgeisNOTrequiredtopersonallyexaminethecomplainantandhiswitnesses.Whatthe
Constitutionunderscoresistheexclusiveandpersonalresponsibilityoftheissuingjudgeto
satisfyhimselfoftheexistenceofprobablecause(Solivenv.Makasiar,167SCRA394).
Tobesure,theJudgemustgobeyondtheprosecutorscertificationandinvestigationreport
whenevernecessary(Limv.Felix).
Procedure:

Definitionofexpostfactolaw.
1)Onewhichmakesanactiondonebeforethepassingofthelaw,andwhichwasinnocent
whendone,criminal,andpunishessuchaction.
2)Onewhichaggravatesthecrimeormakesitgreaterthanwhenitwascommitted.
3)Onewhichchangesthepunishmentandinflictsagreaterpunishmentthanthatwhichthe
lawannexedtothecrimewhenitwascommitted.
4)Onewhichaltersthelegalrulesofevidenceandreceiveslesstestimonythanthelaw
requiredatthetimeofthecommissionoftheoffenseinordertoconvicttheaccused.
5)OnewhichassumestoregulatecivilrightsandremediesonlyBUT,ineffect,imposesa
penaltyordeprivationofaright,which,whendone,waslawful.
6)Onewhichdeprivesapersonaccusedofacrimeofsomelawfulprotectiontowhichhehas
becomeentitledsuchastheprotectionofaformerconvictionoracquittal,oraproclamationof
amnesty.

withoutjudicialtrial.

MEMBERSofaGROUP.
