SPECIAL INSTRUCTIONS TO THE TENDERERS

Subject: Work of erection of 220/33 KV 50MVA Transformer at 220KV Jeur

EHV S/stn under the jurisdiction of EHV O&M Division Solapur
INSTRUCTIONS TO THE TENDERERS.
1) The tenders should be submitted online on internet of MSETCL E-tender Website in two
separate attachments (Bids) i.e. (a) Technical bid containing proof of pre-requisites and (b)
Commercial bid as detailed in the tender notice.
SPECIAL CONDITIONS:
Your offer should be submitted in two separate bids 1 & 2
1. (Technical Bid)= This should contain following documents certificate as a proof of
qualifying pre-requisites, broachers, attested certificates from MSETCL authority (i.e not
below the rank of Executive Engineer) or any gazette officer etc.
REQUISITES:
a. Proof regarding payment of E.M.D & E-Tender Fee.
b. Proof regarding payment of Income Tax to Income Tax Department in SARAL FORM for the
year 2011-12, 2012-13, 2013-14 (Last Three Years) with copy of PAN Card.
c. Solvency certificate from schedule/nationalized bank to the extent of 100% of the estimated
amount. ( Solvency is valid for one year from date of issue of the certificate)
d. Proof of registration of firm under Bombay shop & establishment Act
e. Updated Electrical Contractor License.
f. Valid E.P.F. Registration Certificate, & proof of paid Challan for month Jan-Feb-March 2015
g. Valid Insurance of Labour under Workman compensation Act
h. Proof of registration under Service Tax & proof of returns for months : Jan-Feb-March 2015
i. Proof of registration under VAT/TIN Tax & proof of returns for months : Jan-Feb-March 2015
j. Average annual financial turnover/balance sheet duly audited by CA during the year 2011-12,
2012-13, 2013-14 ,last three years should not be less than 100% estimated amount.
k. The Agency should have successfully completed work of Errection of at least two nos. of 25
MVA or above capacity Power Transformers along with other related allied works in any
transmission utility in India. Work completion Certificate from Authorized Person / Competent
Authority (not below the rank of Executive Engineer) regarding completion of above work
satisfactorily.
l. List of works currently in hand along with order reference, amount of the order with work order
copies.
m. List of technical persons, machinery & T&P, which will be used for tender works in question.
n. Joint Ventures will not be allowed.
o. The duly filled Questionnaire is to be uploaded with technical bid
(Format of Questionnaire is enclosed with this tender document)
p. Contractors Under Taking is to be uploaded with technical bid
(Format of undertaking is enclosed with this tender document)

Commercial Bid
This should contain only price bid i.e. all tender documents. Rate should be
quoted Inclusive of Taxes. You should quote the rate schedule A&B
After verifying the full documents/certificate, pre-qualifications as above in Bid
No. 1 (Technical Bid), fulfilling the desired pre-requisites, the Bid No. 2 (Commercial Bid)
will be considered / opened. If the same is not found to be meeting the pre-requisites, the Bid
No. 2 shall be kept without opening. Tender with incomplete details or not submitted on
prescribed tender form etc. are liable for rejection. This office will not be responsible for
delay due to internet connectivity problem or website problem. Commercial Bids
comparison will be done as per rate quoted in schedule A&B. This office reserves the
right to reject any or all tenders without assigning any reason thereof
The bidder should not quote conditional rates related to quantity of work.
The rates written should be legible & there should not be any overwriting / corrections. Over
writing / corrections in tender will not be accepted. The rates should be quoted figures upto
two decimals only.

TERMS & CONDITIONS
1) SCOPE OF WORK: - Work of erection of 220/33 KV 50MVA Transformer at 220KV Jeur EHV S/stn
under the jurisdiction of EHV O&M Division Solapur as per Schedule- A&B, for the Maharashtra State
Electricity Transmission Co. Ltd.
a. Mobilization and Demobilization charges will not applicable
b. The work is to be carried out as per MSETCL standard terms & conditions & full satisfaction of
undersigned
2) VALIDITY OF THE TENDER: - All tenders shall be open for acceptance by the Company for a
period of 90 days from the date of opening of the tender. All quotations submitted against this tender
shall be deemed to comply with the conditions unless otherwise agreed by the Company.
3) SUBMISSION OF TENDER: - The tenderer must quote his rates specified in the Schedule in figures
as well as in words. Any variation/revision in the rates will not be allowed on any grounds such as
mistake, misunderstanding etc; after the tender has been submitted. The tendered rate must include as
per Schedule- A&B,
The tenderer are prohibited from making any additions or alternations in the description of articles
mentioned in the Schedule. They should quote the rate for the work, described either in the Schedule or
write the word No rate against item. If they wish to quote for similar item,
they may do so by adding such items at the end of each Schedule.
The tenders must be submitted in this form only and must be clearly and legibly filled in. The quoted
rates and remarks must be either in Ink or Typewritten. Being E-Tender which will be digitally signed
by bidders tender signatory, there is no any necessity of self attestation of the documents. Further it
will be presumed that all tender conditions that uploaded in this tender are agreed by you. The signature
on each tender document page is not necessary. If there are deviations if any, then the duly filled
deviation sheet should be submitted. Every scratching /overwriting must be rounded or Stikine
Through clear figures / alphabets should be placed for its place. While uploading or attaching
documents problem due to MSETCL E-tender site, company will not be responsible for this problem.
4) EARNEST MONEY DEPOSIT:- Each tenderer, will be required to pay an EMD of RS: 59,330/(Rupees Fifty Nine Thousand Three Hundred Thirty Only) before the due time of closing through
On-Line Only. Request for exemption from EMD shall not be considered on any grounds. Request for
payment of EMD after closing of tender and considerations of the tender shall not be entertained.
The EMD is liable to be forfeited under following conditions:a) In case the tender is withdrawn after the specified time or date of tender opening, but before
expiry of the validity period.
b) In case, the tenderer refuses to accept the order placed during the validity period.
c) In case tenderer fails to pay the prescribed Security Deposit against an order placed within the
prescribed period.
The EMD should be paid by On-Line Only. No interest shall be allowed on the EMD
in respect of unsuccessful tenders. The EMD will be returned as soon as the tender is finalized and
upon the tenderer returning to the Company the receipt thereof duly discharged in favor of the
Company. In case of successful tenderers the EMD will be adjusted against the Security Deposit on
specific request by the tenderer.
5)

ACCEPTANCE OF TENDERS:- The Company does not bind itself to accept the lowest or any
tender neither will any reasons be assigned for rejection of any tender. It is also not binding on the
Company to disclose any analysis report of tender.

Disclosing untrue and / or false information, or withholding information or part of information.

Record of poor performance such as unsatisfactory work of abandoning the work etc.
Financial shortcomings or failures in past certificates.
Insufficient experience, or employing insufficient number of employees, or not employing
qualified employees.
e. Non payment or requisite EMD & Tender Fee.
f. Documents without attestation will not be considered & that turn to cancel the Bid.

The company reserves to itself the right to reject tender which does not confirm to any of the
conditions.

8)

Every tenderer whose tender is accepted either in whole or in part must deposit money within ten days
from the date of receipt of intimation by way of Security for the due and proper fulfillment of his
contract by D.D. Security Deposit is payable at 5% of the amount of the order.
In the event of the contractor failing to deposit such security within the stipulated period the
company shall have full discretion to cancel the acceptance communicated to the said tenderer.
Subject to deductions if any as per the terms of the contract, the security deposit will be
returned in the normal course within 3 months after the expiry of the completion of the work. No
interest will be allowed on this deposit.

EXECUTION OF WORK: - In the event of the tender being accepted in the whole, the successful
tenderer, hereafter referred to as the contractor shall execute order immediately as per detailed work
order.

10)

SECURITY DEPOSIT:
Successful tenderer should pay security deposit equivalent to 5% of the value of the order.
Security Deposit is payable by (a) FDR (b) D.D. (c) Bank Guarantee from a nationalized scheduled
Bank. The S.D. will be refunded after satisfactory completion of the work. If you fail to do so, the SD
will be recovered from 1st R.A bills with interest.

11) CONTRACT PERIOD:

The work in full must be executed within the time limit of Three Months from the date of handing over
of site. The time being reckoned from the date of order, including monsoon season.
12) MATERIAL QUALITY & DRAWING APPROVAL:
The material is to be supplied from approved vendor list of MSETCL. The drawing approval is to be
given by the undersigned. The terms & conditions, standing instructions of MSETCL are binding on
bidder
13) FINAL TESTING:
The final testing of transformer& their equipments is to be done by MSETCL.
14) OPERATING AUTHORITY:
The concerned Executive Engineer in consultation with the undersigned is the competent operating
authority.
15) SUBMISSION OF BILLS:a. The bill in triplicates should be submitted to the concern division along with the MOM for the concern
work with M. B. recording, the payment will be done at The Suprintedning Engineer,EHV O&M
Circle Solapur.
b. The each RA bill should not be less than 10.00 Lakhs
c. The payment will be effected as per availability of funds.
16) PENALTY FOR DEFAULT :- Penalty @ 1% (or 10% of maximum of order value) of the approved
rate will be deducted from your bills as penalty in case you default in providing Operator & Junior
Technicians during contract period. The deduction will be limited to the actual period of default.

17) TAX DEDUCTION AT SOURCE:-In accordance with IT Act 1961, Income Tax will be
Deducted at source at the prevailing rates from the bills. Similarly any other tax deductible at source if
applicable to this particular contract as per statutory provisions (laid down by Central or State
Government.) will also be deducted from the bills at the prevailing rates.
18) DAMAGE TO PERSONS AND PROPERTY: - The contractor shall indemnify the Company against
any losses and claim in respect of injuries or damage to any persons, material or physical damage to
any property whatsoever, which may arise out of or in consequence of the execution of the work.
19)CONDITIONS OF TENDER AND CONTRACT:- The tender and order/contract placed against this
specification shall be governed by the companys General condition of contract and the tenderer is deemed
to be fully aware of these conditions and any ignorance thereof shall not exempt him from his liability to
abide by these conditions. The enclosed schedules, tender notice, tender from and instructions to the
tenderers also form a part of these specifications.

20) TERMINATION OF CONTRACT: -The undersigned reserves the right to cancel the contract, after
giving due notice to the contractor, in the event of the breach of contract and unsatisfactory services in
any respect.
21) SIGNING OF CONTRACT:- Within 7 days from the date of receipt of the work order, the contractor
shall enter into an agreement with the M.S.E.T.Co. Ltd. in the prescribed format on stamp paper.
Further until the agreement is executed, the M.S.E.T.Co. Ltd. will not be liable to pay, nor the
contractor shall be entitled to claim amount due or payable under the contract. The necessary stamp
duty for the agreement shall be borne by the contractor. The work should not be started until the
agreement is executed.
22) JURISDICTION:
All disputes, differences related to the tender / contract shall be subject to Jurisdiction of Solapur Court.
23) Please quote your MVAT, PAN No. TIN No. on the bill.
24) All statutory requirements and provisions in regard with Factory Act Workmen. Compensation Act
Shop and Estt. Act are binding on you e.g. CPF, insurance & others. The Deviation of any of the
provision you are responsible & you have to deal it with your own cost.
25) Workmans Insurance:- The Contractor shall obtain the Insurance Policy as Contractors All Risk
Insurance (CAR) or Transit Cum Erection (TCE) Insurance or Erection All Risk (EAR) insurance for all the
workman engaged by him for this works at MSETCL site. The policy should be drawn from insurance
company entrusted by Directors of Insurance, Government of Maharashtra i.e. M/s United India Insurance
Company Co. Ltd. on co-insurance cum servicing basis in the ratio of 40:60 (i.e. the Government Insurance
Fund @ 40% and United India Insurance Company @ 60% which will be valid for 2 Years from date of
work order.
26) The Competent Authority reserves the right to relax any of the above conditions without
assigning any reason thereof.

no doubt / objection regarding the tender and its conditions and instructions and hence I/We hereby
offer to carry out the works described in the tender documents and the said specifications schedules
at the rate entered in the schedule .

specification and instructions the particulars entered in the schedules attached to the specifications
and in accordance with the Conditions of contract applicable for MSETCLs contract.

INDEMNITY BOND FORMAT

Whereas we are the contractors to the Maharashtra State Electricity Transmission Company, Trans
O&M Circle, Solapur& the contract of ____________________________________________ entrusted by
the company vide order No. __________________________. We bind ourselves to indemnity & make
good any loss in the all costs & expenses which may be incurred by the MSETCL in respect of the above
work in the course of its execution & undertake that;
1) We shall make good any loss, shortage, damage to above work in the course of the same work
during handing of the same.
2) We shall make good the amount of loss within the period of one month from the date of report
by the concerned Executive Engineer & further agree to authorize the MSETCL in case of our
default to make good the amount of loss to recover from our pending bills with the MSETCL or
from any other payment due to us including the Security Deposit place with the MSETCL under
the same terms of this contract.
3) We shall Indemnify & save the MSETCL harmless at all the time from any loss. Costs &
consequence in respect of above mentioned work entrusted to us & agree that in case of any
default or failure on our part to discharge the above mentioned obligations, the MSETCL shall in
addition & without prejudice to its right of recovery provided therein or in our contract with the
MSETCL be entitled not only to terminate the contract at our cost, but also be held us liable &
take
the legal action against
us. IN WITNESS:We have herein to set hand on this -----------------------------------in the presence of contractors
