KNOW ALL MEN BY THESE PRESENTS:


This instrument is entered into by and between RACQUEL MARTINEZ LUNA, Filipino, of
legal age, married to JOEL L. LUNA and a resident of NJK Subdivision, Purok Lusaran, Dao, Pagadian
City, hereinafter referred to as VENDOR and RIZALDO B. GABATO, Jr., Filipino, of legal age,
married to ROSELYN D. GABATO and a resident of, hereinafter referred to as VENDEE.
Witnesseth:
That the VENDOR is a lawful owner of a real property, which is particularly described as a
house and lot known as Blk. 5, Lot 14, Phase 2 of JM Homes Subdivision located at EJC Montilla,
Tacurong City. Said land, where the house is erected contains an area of____ sq.m real property, which
is a parcel of land covered under Transfer Certificate of Title No. T-48123;
That for and in consideration of the sum of FIVE HUNDRED THOUSAND PESOS
(P500,000.00), TWENTY THOUSAND PESOS (P20,000.00) of which is paid in hand by the
VENDEE as DOWNPAYMENT and acknowledged by the VENDOR to have received, and by virtue of
these presents, does hereby SELL, TRANSFER, and CONVEY unto said VENDEE, his heirs, assigns
and successors-in-interest the 212 sq.m real property (with improvements consisting of house with
fence, electric pump, fruit trees), a parcel of the above-described real property;
That the remaining balance shall be paid by the VENDEE to the VENDOR upon release of
payment of Housing Loan from Home Development Mutual Fund (PAG-IBIG);
That the VENDOR warrants that the said real property is free from all liens and encumbrances.
