INITIAL INFORMATION:

On Saturday May 30th, 2015, at approximately 2346 hours, I, Officer Nachtrieb of the Longmont Police Department, was
dispatched to
reference a 911 hang up. Longmont Emergency Communications Center (LECC) advised via
radio that upon call back a male stated "I'm going to kill
" and hung up the phone.
INVESTIGATION:
Upon arrival, LECC advised per historical record, the call was believed to come from apartment
.I
approached the apartment taking note of the numbers on the doors as I made my way north through the parking lot. I
could hear a female crying as I approached.
Upon locating
a female, VICTIMstepped out of the apartment.
was in
a black dress with no shoes, was crying and noticeably upset.
saw me and immediately rushed over to me
stating "please help me! He tried to kill me! He hit me and choked me! He is still inside and he has a knife!".
At that moment a male, ARRESTEE-Richard Martinez (Richard), stepped out of the apartment door. I observed Richard
to be wearing a white t-shirt, tan pants, and holding two large knives in his left hand. When Richard saw me, he grabbed
one of the knives with his right hand (having one in each hand) and took approximately three to four steps in my direction.
The knives were large knives with red handles that appeared to have come from a kitchen block.
With
gripping my vest, hiding directly behind me, I backed up to gain distance and drew my handgun. I
commanded Richard to drop the knives. Richard did not comply though I had him at gun point. I advised via radio that I
had Richard at gunpoint.
I continued to give Richard commands to drop the knife and stated I would shoot him. At this point, Officer R. Douglas
arrived on scene. Richard stated "shoot me, just shoot me. You're going to shoot me anyway!". I commanded Richard to
drop the knives and told him I would not shoot him if he dropped the knives. Richard still would not comply.
I observed Richard to be in an aggressive, bladed stance and was clenching his fists around the knives. I feared that
Richard was going to aggressively move toward me with the knives as
was behind me and I began to squeeze
my trigger. Richard was approximately ten yards from me, with the blades of the knives pointed upward. Richard's
behavior was becoming increasingly aggressive as I commanded he drop the knives. I knew from training and experience
that Richard would be able to reach Officer Douglas,
and I very quickly and be able to injure or potentially kill one
of us.
Sergeant A. Feaster arrived on scene as well as Officer A. Jonas. I heard Sergeant Feaster yell "Taser, Taser!" and I
observed the red dots from the Taser's laser sights appear on Richard's right upper torso and right leg. Sergeant Feaster
deployed the Taser and Richard dropped the knives just prior to be struck by the Taser probes.
As Richard fell to the ground, Officers Douglas, Jonas and I approached and removed the knives from Richard's reach.
Richard was placed into custody without further incident.

away from the scene.
was still gripping my uniform, crying and begging me not to leave. I
explained to
that she was now safe and I needed to know what happened.
though frantically crying, was
able to explain that she and Richard were at a birthday party earlier in the evening and then had gone to a bar.
stated when they got to the apartment, that Richard had called her a "whore" and began to become verbally aggressive
with her.
stated Richard then slapped her with open hands on both sides of her face.
explained that
Richard had also punched her in the stomach and tried to choke her.
stated Richard then grabbed the knife and had been waiving it in her direction down toward her abdomen.
stated when she called police, Richard became more aggravated and took the phone from her.
