20 heading “Additional Causes of Action,” which was filed on April 19, 2004.

2 FIRST AFFIRMATIVE DEFENSE
3 RealNetworks’ “Additional Causes of Action” are prohibited under Federal Rule of Civil
4 Procedure 7(a).

5 SECOND AFFIRMATIVE DEFENSE


6 The filing of RealNetworks’ “Additional Causes of Action” is an attempt to amend its
7 Complaint as of right. Such an amendment is prohibited under Federal Rule of Civil Procedure

8 15(a), because, at the time of its filing, RealNetworks had already been served with MLBAM’s

9 responsive pleading to RealNetworks’ Complaint.

10 THIRD AFFIRMATIVE DEFENSE


11 RealNetworks’ “Additional Causes of Actions” are barred because RealNetworks’ failed
12 to comply with the requirements of Federal Rule of Civil Procedure 11.

13 PRAYER FOR RELIEF


14 WHEREFORE, MLBAM demands judgment against RealNetworks and in favor of
15 MLBAM as follows:

16 1. An order dismissing RealNetworks’ “Additional Causes of Action” on the merits


17 and with prejudice;

18 2. An award of reasonable attorneys’ fees and costs; and


19 3. Further equitable relief as the Court deems just.
