Upon extra-judicial petition for sale under Act 3135, as amended by Act
4118 , filed by LEILANI M. ESPINOLA , mortgagee, against the mortgagors,
SPS. LOPE LEIDO and AURELIA BACOSA-LEIDO, with address at 132 Camia
St., De Roman Subd. Tanza, Cavite , to satisfy the mortgaged indebtedness, in
the total amount of ONE MILLION EIGHT THOUSAND PESOS
( Php1,108,000.00 ) as of July 20, 2007 including principal, interest and
penalty charges but not including attorneys fees and all the legal fees and
expenses for the foreclosure and sale , the undersigned Notary Public for and in
the Province of Cavite will sell at PUBLIC AUCTION, to the highest bidder, FOR
CASH and in Philippine Currency, on __________________________at
__________________________________, or soon thereafter, in front of the main
entrance of RTC-Trece Martires City, Cavite, the following described real estate
properties, together with all the buildings and improvements existing thereon,
to wit :
A parcel of land ( Lot 21, Blk. 2 of the subd. Plan, ( LRC ) Psd87713 being a portion of the lot 769-B, described on plan Psd55114, LRC ( GLRO ) Rec. No. 6832 ), situated in the Bo. of Sanja
Mayor, Mun. Of Tanza, Prov. of Cavite. Bounded on the NE., pts. 12 by Lot 23, Blk. 2 ; on the SE., pts 2-3 by Road Lot 1 ; on the SW.,
pts. 3-4 by Lot 19 ; and on the NW., pts 4-1 by Lot 20, both of Blk. 2

Madam :
We have the honor to request your good Office to undertake the public
auction sale of the real properties, together with all the buildings and
improvements existing thereon, covered by a Real Estate Mortgage executed on
July 20, 2006, to secure the payment of the loan in the total amount of ONE
MILLION EIGHT THOUSAND PESOS ( Php1,108,000.00 ) as of July 20, 2007,
which Mortgage was foreclosed for breach of the terms of the said Mortgage.
In support of said request, we enclosed herewith copies of the following
documents, to wit :
1. Real Estate Mortgage for Php 800,000.00 dated July 20, 2006, in favor of
LEILANI M. ESPINOLA , covering a parcels of land, together with all the
buildings and improvements existing thereon, which is particularly described
as follows :
2. Demand Letter dated July 23, 2007 , addressed to SPS. LOPE LEIDO and
AURELIA BACOSA-LEIDO which is the latest written demand for payment of
the past due loans.
We foreclosed the aforementioned Real Estate Mortgage pursuant to the
provision thereof, which provides :

Provide, that if we shall pay or cause to be paid to LEILANI M. ESPINOLA,
the aforementioned amount of Php800,000.00 within a period of ONE ( 1 ) YEAR
from and after the date of this instrument, together with an interest of Three Point
Five Percent ( 3.5% ) per month, payable monthly, then this mortgage shall hereby
be discharged, otherwise, it shall remain in full force and be enforceable in the
manner provided by law.
If at any time the MORTGAGROS fails or refuse to pay the obligation herein
secured then this obligation of the MORTGAGORS secured by this mortgage shall
become due and payable and the MORTGAGEE may immediately foreclose this
mortgage judicially in accordance with the rules of Court or extra-judicially in
accordance with Act. No. 3135 as amended. For the purpose of extra-judicial
foreclosure, the MORTGAGORS hereby appoints the MORTGAGEE as their
attorney-in-fact to sell the property mortgaged under Act. No. 3135 as amended.
To sign the documents and perform any act requisite or necessary to accomplished
the said purpose.
because the Mortgagor / Borrowers failed and refused to pay the balance of his
loan secured by the aforementioned Real Estate Mortgage, notwithstanding
demands to pay made upon him.
Pursuant to the terms of the said Real Estate Mortgage, you are hereby
appointed and requested to undertake the public auction sale of the aforesaid
foreclosed real properties, in accordance with the provisions of Act No. 3135, as
amended , and other applicable laws.

to the best of our knowledge , no such other action or claim is pending therein ;
if there is such other pending action or claim, we must state the present status
thereof ; if we should thereafter learn that the same or similar action or claim
has been filed or is pending , we shall report that fact within five ( 5 ) days
therefrom to the Office of a Notary Public for and in the Province of Cavite
wherein the aforesaid Petition has been filed.
