O R D E R:
Orders were issued in the G.O. 1st read above permitting Sri
K.Radhakrishna Murthy, Deputy Executive Engineer (R&B) to retire from
service on 30.06.1996 pending finalisation of the disciplinary case
contemplated on him for the irregularities in construction of bridge across
river Swarnamukhi. After conducting departmental enquiry orders were
issued in the G.O. 2nd read above dismissing Sri K.Radhakrishna Murthy,
Deputy Executive Engineer (R&B) from service.

Aggrieved by the said orders, Sri K.Radhakrishna Murthy, Deputy
Executive Engineer (R&B)(Red.) filed O.A.No.1933/97 in the Andhra Pradesh
Administrative Tribunal.
While allowing the OA, the APAT in its order
Dt.12.07.1999 has ordered that the respondents to proceed against the
applicant in accordance with the rules.

After careful examination and following the due procedure,
Government have revised the earlier orders and imposed the punishment of
with-holding the pension in full permanently on Sri K.Radhakrishna Murthy,
Deputy Executive Engineer (R&B) (Retd.) vide G.O. 4th read above.

Aggrieved by the said orders, Sri K.Radhakrishna Murthy, Deputy
Executive Engineer (R&B)(Retd.) has filed another O.A.No.3928/2001 in the
Andhra Pradesh Administrative Tribunal. The APAT allowed the said O.A. on
13.11.2007 granting the reliefs sought for by the applicant i.e.,
(a) declaring, that, G.O.Ms.No.48, dated 27.03.2001, of
Transport, Roads & Buildings Department, as illegal arbitrary,
etc;
(b) declaring, that, the applicant is entitled to full pension;

Government after careful consideration of the matter have decided to
implement the orders of the Honble APAT in O.A.No.3928/2001 dated
13.11.2007 in respect of Sri K.Radhakrishna Murthy, Deputy Executive
Engineer (R&B)(Retd.).

Accordingly Government hereby cancel the orders issued in G.O.4th
read above and release full pensionary benefits to Sri K.Radhakrishna
Murthy, Deputy Executive Engineer (R&B)(Retd.).
7.
The Engineer-in-Chief (R&B) Administration, AP, Hyderabad shall take
necessary action in the matter accordingly.
