MUNICIPAL ORDINANCE NO. 10-2014

GRANTING A PERMANENT PARADA IN THE MUNICIPALITY OF GUINOBATAN
FOR PUJs BOUND TO JOVELLAR, ALBAY & TRICYCLES-FOR-HIRE BOUND TO
PARIAAN, CAMALIG, ALBAY.

WHEREAS, in the grant of permanent parada for the applicants, reference shall be
made to the implementing guidelines of the LTFRBs Franchising Authority over Tricycle-ForHire to Local Government Units Pursuant to Local Government Code of 1991 (R.A. No.: 7160),
where the operators of Tricycle for Hire may be allowed to operate within more than one
Municipality provided that the operators shall secure MTOPs from each municipalities having
jurisdiction over the area covered by the Zone.
WHEREAS, the divers/operators of Tricycles-For-Hire of Pariaan, Camalig Albay who
usually & regularly park, load and unload right in front of the Public Market alongside with the
PUJs bound to Jovellar, Albay, filed an application through the SB Committee Chairman on
Transportation for the grant of permanent parada in this Municipality;
WHEREAS, giving due consideration to the application will mean additional income to
the LGU-Guinobatan and an increase to the share of the TKF and PPDAF from the Tricycle fees
& charges;
WHEREAS, to fix a permanent parada for the said applicants together with the PUJs
will necessarily decongest Mabini Street from heavy traffic and will give delivery trucks of
various goods in the Public Market enough parking space in the area;
WHEREAS, to avoid competition with the PUJs bound to Jovellar, Albay in a Public
Hearing conducted for the purpose, the parties agreed to limit the zone or route of the TricyclesFor-Hire from parada in Guinobatan, Albay to parada in Pariaan, Camalig, Albay only;
WHEREFORE, in view of the foregoing premises,
BE IT ORDAINED BY THE SANGGUNIANG BAYAN OF GUINOBATAN,
ALBAY, THAT:

SECTION 1. SCOPE AND COVERAGE. The grant of parada under this ordinance is
limited only to the original twenty-one (21) Tricycles-for-Hire applicants and to the PUJs bound
to Jovellar, Albay that usually or regularly park, load and unload in front of the Public Market.
SECTION 2. AREA DESIGNATED AS PERMANENT PARADA. The permanent
parada (parking area) for the concerned Tricycles-For-Hire and PUJs shall be the open space
along the Ola Street beside the old commercial & residential ancestral house of Mr.
Buenaventura.
SECTION 3. COVERED ZPNE/ROUTE. The route of Tricycles-for-Hire under this
ordinance shall be from the designated parada up to Pariaan, Camalig, Albay only and vice
versa, while the route of PUJs shall be form the designated parade up to Jovellar, Albay and vice
versa.
SECTION 4. OBLIGATIONS OF THE 21 TRICYCLES OPERATORS. The
twenty-one (21) tricycle operators shall perform the following obligations to validly exercise this
privilege of using the designated parada:
a. To apply for a Special Municipal Tricycle Operators Permit (MTOP) at the
LGU-Guinobatan;
b. To load and unload passengers only at the officially designated parada
SECTION 5. NATURE & LIMITATION OF SPECIAL MTOP. The grant SPECIAL
MTOP for Tricycle-for-Hire bound to Pariaan, Camalig, Albay shall not be construed as a permit
for Tricycle Drivers and/or Operators to pick up and convey passengers at any place within the
jurisdiction of the Municipality of Guinobatan.
SECTION 6. PENALTY CLAUSE. Any driver and/or operator of Tricycle-for-Hire or
PUJ found violating the provisions of this ordinance shall pay the following fines:
a. 1st Offense
b. 2nd Offense
c. 3rd Offense and Succeeding Offense

SECTION 7. SEPARABILITY CLAUSE. If, for any reason/s, any part/s of this
Ordinance shall be held unconstitutional or invalid, other part/s hereof which are not affected
thereby shall continue to be in full force and effect.
SECTION 8. REPEALING CLAUSE. Any other ordinance/s or part/s thereof which
are inconsistent with any of the provision/s of this Ordinance are hereby repealed, amended or
modified accordingly.
SECTION 9. EFFECTIVITY. This ordinance shall take effect upon its approval.
