Sample Written Warning for Misconduct and Unprofessional Behavior

Dear NAME:
On DATE, a meeting was held with you, witness names, your union representative, and me. We
discussed a complaint that occurred in the County District Courtroom on DATE, concerning your
attitude, courtroom demeanor and unprofessional behavior. I investigated the alleged problem and
letters that were submitted by Deputy County Attorney and the official Clerk Reporter. I also
interviewed NAME, who had experienced your behavior that day on DATE and past
unprofessional behavior. You were notified of this matter; however, you requested further
investigation by an independent investigator.
NAME conducted this investigation and turned in the report on DATE. You were given this
report on the same date. It was noted in the final report, and in his/her own words, confirmed much
of the same information collected by me at the onset of the complaint. It also stated other court
officials confirmed a similar description of the current issue as well as other resembling incidents
that occurred in the past. NAME also noted, in his/her report, that this was the fifth complaint from
the County Attorney's office. Complaints were received on DATE, DATE, DATE, DATE and
DATE and that you had been contacted regarding these complaints on DATE, DATE, DATE,
DATE and DATE. Documentation of these complaints shows a pattern and repeated problem.
You have been counseled repeatedly for like behaviors which indicate that you have failed to see
the severity of the situation and the significance of a good relationship with all parties in the court
system. I am hereby formally warning you that future inappropriate conduct and unprofessionalism
may result in additional disciplinary action up to and including termination of your employment
with this agency. A copy of this letter will be placed in your personnel file for the next year.
You will correct this problem reading, signing and returning the Code of Ethics form by DATE.
You will pay specific attention to the following items in the Code of Ethics:
1. I shall perform my duties with high standards of honesty, integrity, and impartiality, free

from personal considerations, favoritism and partisan demands. I shall be courteous,


considerate and prompt when serving the public.
2. I shall maintain respect and professional cooperation in my relationships with other

Department staff members. I will not sexually harass or condone sexual harassment of any
person. I shall treat others with dignity, respect and compassion.
6. I shall conduct myself in a manner that will not demean offenders, fellow employees or
others.
8. Whether on or off duty, in uniform or not, I shall conduct myself in a manner that will not
bring discredit or embarrassment to the NAME of COMPANY.

You will also find and submit to me for prior approval by DATE an educational seminar(s) in the
area of Human Interpersonal Relations. I recognize that you may not be able to attend until a later
date.
You may provide a written response and/or file a grievance in accordance with 3-0125, Montana
Operations Manual, Volume 3. (Apply union grievance process where applicable.)
